Angeliqe Lee won Tuesday's election to replace Jackson Ward 2 City Councilman Melvin Priester, Jr.. However, the Northwest Jackson candidate voted in Ridgeland as recently as March.
Mr. Priester resigned from the City Council on October 2. Angelique Lee led all candidates in Tuesday's special election with 40% of the vote. Former Hinds County Sheriff Tyrone Lewis placed second with 31%. 259 votes separate the two candidates. James Paige placed third at 12%.
Madison County voting records show that Ms. Lee voted in several Madison County elections:
March 10, 2020: Democratic Presidential Primary
November 5, 2019: General Election
August 6, 2019: Democratic Primary Election
November 27, 2018: Runoff Election
November 6, 2018: General Election
However, she did vote in Hinds County prior to the 2018 general election:
August 7, 2018: City of Jackson school bond issue
November 7, 2017: Hinds County Prosecuting Attorney
May 2, 2017: City of Jackson Democratic Primary
November 6, 2012: General Election
November 2, 2010: General Election
Ms. Lee registered to vote in Hinds County on October 19, 2020, 17 days after Mr. Priester announced his resignation.
There is actually a conflict among state laws. Yes, that is state laws as in plural. Section 23-15-300 of the Mississippi Code states:
(1) Any candidate for any municipal, county or county district office shall be a resident of the municipality, county, county district or other territory that he or she seeks to represent in such office for two (2) years immediately preceding the day of election. The provisions of this section shall not apply to any municipality with less than one thousand (1,000) residents according to the latest federal decennial census.
(2) A candidate shall prove in his or her qualifying information that he or she meets the applicable residency requirement or provide absolute proof, subject to no contingencies, that he or she will meet the residency requirement on or before the date of the election at which the candidate could be elected to office. The appropriate election official or executive committee, whichever is applicable, with whom a candidate files qualifying information shall review and determine whether the candidate meets the applicable residency requirement according to the procedures in Section 23-15-299. The appropriate election commission shall review and determine whether a candidate required to file qualifying information with it meets the applicable residency requirement according to the procedures in Section 23-15-359.
(3) If the qualifications for an elected office include a specific residency requirement, the residency requirement in this section shall not apply.
(4) This section shall apply to elections held from and after January 1, 2020.
The Legislature passed the law in 2019. However, Section 21-8-7 states:
(4)(a) ...... Council members elected to represent wards must be residents of their wards at the time of qualification for election, and any council member who removes the member's residence from the municipality or from the ward from which elected shall vacate that office. However, any candidate for council member who is properly qualified as a candidate under applicable law shall be deemed to be qualified as a candidate in whatever ward the member resides if the ward has changed after the council has redistricted the municipality as provided in paragraph (c)(ii) of this subsection (4), and if the wards have been so changed, any person may qualify as a candidate for council member, using the person's existing residence or by changing the person's residence, not less than fifteen (15) days before the first party primary or special party primary, as the case may be, notwithstanding any other residency or qualification requirements to the contrary.
Ms. Lee is hanging her hat on this part of the law. Her campaign told WLBT:
Ms. Lee has held residence within the ward beyond the period that is prescribed by law. Efforts are being made to use her registration history as evidence that she has not lived in the ward for the legally prescribed period of time.
Ms. Lee freely admits her failure to timely change her voter registration from an address that she temporarily held to the address that she has lived in for more than two years.WLBT story.
She actually claimed two different Madison County addresses over the years. Voting records show she lived on Camden Park Drive and Glastonbury Circle in Ridgeland. Her registration records are posted below.

The statutes are not inconsistent. If they can be read in harmony, you must follow both. For example there are federal train speed laws. If a local train speed law is different, you have to follow both. Having two different laws to follow does not mean the laws are per se inconsistent. You have to have been a resident of the municipality for 2 years prior to election and a resident of the ward at the time of election. One does not get to choose one law to follow and disregard the other.

These laws aren’t conflicting. They’re actually concurrent. The problem for Miss Lee is if she’s elected it was said a new law president for residency qualifications and municipal elections. With the verdict still out on Archie, Folks can claim they live anywhere and still get elected if people are going to play favorites and never put up a legal challenge.
Voter registration roles are not proof or lack thereof in regards to place of residence. They're only an indicator. There are plenty of other ways to prove residency.

No problem here, the two statutes are not inconsistent. The second statute applies to a specific situation that is not applicable to the one at hand.
And at least Ms Lee didn't use the tactic of Judge Westbrook and vote in BOTH Madison and Hinds in the same election.

They just want what "they want", and that is to illegally elect a very impressive young lady from Ridgeland to the JACKSON City Council. From what I know, Lee is probably the best possible choice. A fresh face, a bold new voice. At some point it’s needed.
