Attorney Warren Martin, Jr. issued the following statement.
Statement from Attorney Warren L. Martin, Jr., Counselor for D’Allen Washington
We understand that the Madison County Grand Jury returned an indictment against my client, D’Allen Washington, for accessory after the fact. While we await the discovery, here are some facts we know. On the night in question, Mr. Washington did not own a cell phone. Also, on the night in question, Mr. Washington did not drive the vehicle to Madison County. Lastly, when he became a person of interest, Mr. Washington voluntarily turned himself in to the Hinds County Sherriff’s Department. We are eager to review the evidence the State will present and plan to mount a vigorous defense.
Like so many, we mourn the loss of Kingston Frazier, and have refused to use this case as a media spectacle. Mr. Washington and his family have been mostly silent during this tragedy out of respect for the Archie and Frazier families. However, we only want to see those responsible for Kingston’s death, held accountable for this tragic event.

I can believe he didn't own a cell phone.
Now how many did he steal and use?
Still perplexed anyone would hire Warren Martin for a criminal case this serious.
So he didn't have an Obamaphone either ?
"Ladies and gentlemen of the jury, I submit to you that my client could not have possibly robbed that liquor store as the prosecutor claims because he is not old enough to enter one. And he could not have possibly used the weapon the prosecutor claims as he is not old enough purchase a handgun..."
Maybe his esteemed counsel is setting up ineffective assistance grounds. I have to admit, based on this statement I'm inclined to see some merit in it.
Hell, most of the lawyers in Mississippi don't OWN a cell phone. The Right Reverend Hugh didn't OWN "his phone," either. Hell, a lot of folks I know, myself included, haven't actually OWNED a vehicle in about 30 years.
So what if he didn't OWN a cell phone or DRIVE the car. If he had a cellphone (find me a teen in this state who doesn't have a cell phone) in his possession and if he was in the car (saying he didn't drive it is not a denial that he was there)then who cares. Was your client involved in the car theft and abduction which led to the death of a child? It's a yes or no question.
@ 4:55 p.m. I think that he is trying to piggy back off of the foundation laid by Wakefield's attorney. If Wakefield's charge is less severe while having more culpability than Washington then there is merit that Washington's charges should be less than or equal to Wakefield's.
You get two or three ignorant-assed people on the jury and they'll believe this kind of crap and acquit. It's basic and simple strategy. Piss in the jury pool early and often.
7:40 --
It's gonna be a Madison County jury.
Mistrial? Impanel another jury. And another. And several more.
These goons will get the needle, or life without.
It ain't Hinds County.
9:32 - Have you witnessed jury selection in Madison County lately? 80% are from Canton which is north Hinds County.
Get 'em up, get 'em up, get 'em up.
I want those who killed Kingston Frazier held responsible to the full extent of the law.
That said, I am appalled by the " lynch mob" mentality of some of these comments. So much for the value of " innocent until proven guilty" these days.
I suspect what the attorney hopes to prove is that his client did not know his companions intended to commit a crime , had no means of alerting law enforcement once in the car, and went to law enforcement the very next day after telling his parents what had happened.
I don't know whether that is true or not or how much it would weight I would give that set of facts if true, as I have not heard or seen the evidence.
What I do know is that all of the commenters , should they have teenage children now or ever, better know a great deal about their kid's friends. More than a few in my high school and my children's high school seemed like good kids and came from good families but got into serious trouble. Their siblings did not. What is it about the crimes of those who are white and prominent that have been reported on this site don't y'all understand?
"Appalled" but anonymous. YAWN.
If all three were together when the car was stolen they all three deserve the same penalty.

You’re right. Poor little darling is a victim.
He comes from a culture that discourages responsible fatherhood, encourages crime and places little to no value on human life.
Here’s an idea: don’t run with thugs who steal cars and kill children.
Your permissive, liberal attitude does nothing but encourage such behavior by removing accountability.
Theirs is a toxic culture. Yours is an enabling attitude.
The only thing I'm enabling, 6:29pm, is a trial by jury based on the evidence and the legal presumption of innocence until proven guilty and the rule of law as essential to liberty and freedom.
The " lynch mob" assumes there is an "alternate culture" based on race. I hate to break the news to you , but that "alternate culture" exists in every race and society. Every race and culture on the planet has sociopaths, criminal gangs, and murderers.
Have you never heard of Harlen County , Kentucky's culture of crime or that in Brighton Beach? Have you never heard of the Outlaws, the Hell's Angel's, the Italian and Russian Mafia families and their gangs. Do you not know they recruit young as well? Google " white gangs" and see what you get. It's a long list of names. Look at the 13 gangs that most concern the FBI.
A white man with a criminal history was just arrested in N.C. today for killing the beautiful three year old daughter of his girlfriend. But, you aren't reading condemnations of the entire race of whites on sites in N.C. based on this incident.
And, may I remind you the opioid crisis is primarily in the white community. Are you so ignorant that you imagine those addicts' dealers are not white or they aren't stealing to get their fixes?
9:02, we are not condemning an entire race, just the people involved.
10:28, Read the comments by 6:29 again. 6:29 is condemning an entire race of people, and I think by being an African American, that I'm part of that race that is being condemned. Black men do not hold the monopoly on dead-beat fathers. I work in Chancery Court, and I've seen plenty white men leave their wives and children "out of sight, out of mind" to struggle emotionally and financially while that same man will go on to support a younger version of his wife.
I came from a loving home with two black parents, but I have several white friends who did not. I don't for one minute believe that if my dad wasn't around that my mom would have let me run wild. My mom do not take crap from anyone. However, from my experience, and admittedly I'm not that old, I do believe white people are more likely than black people to hide shameful things in their upbringing. I have a couple of white friends who had horrible parents who were thought to be the pillar of high society, and as one of them always says, "We were not allowed to talk about it at home nor in public."
If the only black people 6:29 knows are toxic, then he/she needs to get to know more black people. Chances are 6:29 has never had a meaningful conversation with any black person nor has visited any black person's house.
If everyone would just get their facts from the police investigators and not from "gossip of mouth", they would realize that this is a simple case. No one said those two other boys they knew McBride was going to steal a car nor kill a baby. Where are you people getting all this erroneous information?
Don't matter if they knew he was going to steal a car or not.
If they were with him and got into the car they deserve the same thing the killer gets.
No one forced them to get in the car. It was still a stolen car.
