Jackson Municipal Court Judge Ali Shamsid-Dunce released without bond a man accused of shooting a seven-year old child in the neck. The Clarion-Ledger reported:
A child in an adult's vehicle should never have to worry about being shot simply for being a passenger, but it has happened in Jackson for the third time in two months..The mother told WAPT that her cousin was keeping the children overnight and they were going to the zoo the next day. It appears the fight started over a drug-ripoff. Watch the interview.
The man accused of that shooting, after his court appearance, is back home.
Seven-year-old Abigail Smith and her 3-year-old sibling were in a pickup Monday night when police say Donald Nunnery shot out the back window. Abigail was shot in the neck.
According to others who were in municipal court Tuesday, a detective told Judge Ali Shamsiddeen that Nunnery was shooting in self-defense because, as he was trying to break up a fight, someone had attacked him with a tire iron.
Court officials confirmed Shamsiddeen put Nunnery on house arrest with a tracking device — released on his own recognizance with no bond — and was ordered not to make contact with anyone else involved in the fight.
It started around 11 p.m. when "a lot of adults" were involved in an altercation on Greenview Drive, Jackson Police Department Cmdr. Tyree Jones said. They all knew each other, and while the fight started between two people, it ended with four or five involved.
The driver of the pickup was initially identified as Abigail's mother, but Abigail's mother, Tara Smith, told WAPT's Ross Adams the child was with her cousin and her cousin's husband.
As the woman and the children attempted to leave the scene of the altercation, at least one shot was fired through the back window of their pickup.
The woman drove to a nearby Church's Chicken for help, police said.
"From all indications it seemed to be at that time of night probably the only well-lit business where they could go to seek shelter and seek help," Jones said.
Abigail is expected to recover, Jones said.
"From what I understand she's stable right now, but a gunshot wound to the neck is a serious injury so I'm sure she's being monitored," Jones said.
For reasons unknown to police, the driver's husband, who was in the truck with the family when they arrived at the scene, was no longer with them at the time of the shooting. He was later located as officers conducted the investigation.
Nunnery, 28, faces two counts of aggravated assault and shooting into an occupied vehicle. Jones said Nunnery turned himself in to police overnight.

What a nice way to nurture and entertain a 3 year old at 11:00 at night. Take the child to an "adult altercation" with all of the bells, whistles, and gun play.

I believe the report I saw said the girl was staying with the cousin and her "boyfriend" to watch movies and eat popcorn and allegedly they decided to make a run to buy some drugs. Being the responsible adults they are, they obviously decided to take the kids and not leave them home alone. Then some sort of rip-off of the dealer went down, fight broke out, then the shots. If this is accurate, hopefully the "adults" will be arrested and charged. I fault them more than the guy who fired the shots.
No, 10:50 - fault them equally with the guy that fired the shots. One should never pull the trigger if they don't know where it is aimed; once they break that cardinal rule, they are at fault.
But - I agree totally if the narrative you cite is correct in that the parents (or whatever relation) carried the kid along for a drug buy, particularly at this time of night in this neighborhood.
And the Dems wanted to take our 2nd amendment rights away. I guess the new rules of criminal procedure should be ignored whenever a judge deals with a guilty person, huh? (Sarcasm).
The presumption appears to be release on recognizance, under the new rules. Thus. The judge is following the rules. I think he's only being criticized because he has a funny name.
Yes; 4:06, 'particularly at this time of night in this neighborhood'. Now if it had been early in the day and the trip was to NIKNAR, that would have been different. Not nearly as dangerous and the Culpability/Negligence scale comes into play in these things.
The drug culture has taken ahold of our country and trying to ruin it. Marshall Fisher wrote an article the other day- think it was the clarian liar- that spoke to potential corrections. Worth a read. However, any person who fires a gun and shots another person who is innocent of a crime - in this case, a child- needs to be locked up with a high bond. This man is a criminal. If it was my child you can rest assured the bold new city and clown show Hinds DA just saved money. The judge is a POS who needs to be removed. If our MS Supreme Court doesn't encourage motions then they are as guilty as the judge.
Last report I saw was the shooter was trying to break up a fight and got attacked with a tire iron, at which point he pulled a gun and started shooting, with a bullet striking the girl. No doubt he should go to jail.
That being said 10:14, if it were my child, the first people I'd go after would be my relatives who decided to take my child to a drug deal. But that's just me. Hopefully I wouldn't be leaving my kids with a relative with a drug problem to begin with, but unfortunately you never know these days.
