Belhaven shooting victim recovering.

Carolyn Temple continues to recover after she was shot last week during a robbery attempt in Belhaven.  Her daughter, Tress Gardner, told JJ her mother was still in ICU but is in stable condition.  Police continue to search for her assailants.

She said Ms. Temple is awake, alert, and able to talk.  Doctors removed her ventilator during the weekend.  Ms. Temple told her "I'm so lucky just to be here."  There are no surgeries scheduled for Ms. Temple.  Ms. Gardner said her kidneys were not working and it is not known if they will function again. She said the bullet nicked her pancreas and liver but missed her stomach.  Doctors inserted a draining tube into the pancreas and repaired her liver.  She said the extent of her injuries will not be known until she can better move around.  The bullet is currently lodged in the spinal canal.  It is apparently not affecting anything at this time but more will be known when she is more mobile.  Ms. Temple's daughter did say her "feistiness" is starting to return in what is an encouraging sign.

Ms. Gardner also said Precinct 4 Commander James McGowan has been in contact with Ms. Temple's family on a daily basis.  Ms. Temple was shot Tuesday night during a robbery.  She arrived at a friend's house on Euclid. She noticed the garbage cans were still by the street.  She carried her purse while walking to the garbage cans. A maroon Chevrolet Impala stopped and a man got out of the car and tried to take her purse.  Ms. Temple resisted and was shot in the abdomen.  She was taken to UMC and underwent two surgeries. 


*The car is thought to be a Chevy Impala.  Police sources said the vehicle could very easily be a similar make and model such as a Lumina.

Kingfish note: If these guys are caught, this will be a great time to use the Attempted Murder statute.

Black on white crime, sadly it will never be seen by the authorities as anything more than reparations for slavery. If the tables had been reversed and 2 white hoods had gunned down an older black woman, lord help us, Jesse and Al would have flown in overnight, and paid out of state agitators to fight with the police and stage rallies. Poor Carolyn, get well soon.

The risk with attempted muder is that a prosecutor would have to show intent to commit murder. Under M.C.A. section 97-1-7, the jury must return a guilty verdict on "attempted muder" and then in a separate hearing the same jury would have to agree to fix the sentence at life. If unable to do so the punisment is left up to the judge to be sentenced according to what is allowed by the attempt statute.
Armed Robbery does not require the State to show an attempt or intent to commit murder, only the use of a deadly weapon in the commission of the robbery. Again, after a guilty verdict, the same jury has to fix the penalty at life and if they can't agree, the penalty is in the hands of the judge, in accord with what the statute allows.
It appears to me that charging an attempted muder crime would place an additional burden on the prosecutor in seeking an indictment and getting a guilty verdict at trial.

So, Kingfish (or whoever might have one), what's your theory as to how it happened that the thugs were present when she arrived and walked to the end of the driveway?

It's unlikely that they were just ridin' along whistlin' and decided suddenly this would be a great crime of opportunity.

If Jacksonians need to second guess a seemingly simple decision about retrieving their emptied garbage cans after dark in order to protect themselves and their family members from robbery and violence then the battle for Jackson is lost.

2:12 she was likely followed. Saw it reported that she was @ McDade's minutes before the incident.

Senior citizens in NEJax have been frequently targeted in the same manner and robbed in their driveways immediately upon returning home from the Kroger on I55 and other frontage road businesses.

Bull shit on the abandon Belhaven comment (2:33). Not only is this type of event unheard of in Belhaven, it's unheard of in the worst neighborhoods. Pick a neighborhood. A nearly 70 year old grandmother's getting shot by the trash can at the street is a big deal anywhere. This is a huge deal, and it warrants a definite, strong response from the Belhaven neighborhood. But bull shit that this is some new form of business as usual in the neighborhood requiring abandonment. Total bull shit.

Hate to burst your bubble, but when I heard about this I wasn't surprised at all. Nor am I surprised to hear about the auto and home burglaries, or young women being followed. To each is on. I hope you stick it out as long as you can. As for myself, I enjoy being able to spend time in the front yard or in the neighborhood in general after dark.

Well, if nothing else, Ms Temple's unfortunate attack has reminded me to never walk to the street with my purse. I'm notorious for doing just what she did. Prayers for a speedy recovery.

After shopping at Kroger on I55 North, I usually drive in the opposite direction of my house and make a few blocks before going home to make sure no one is following me. Sad, but necessary after my neighbor was held up after going directly home from Kroger one day in broad daylight.

You are correct; the judge just sets the sentence if the jury is unable to agree to life. The statute provides for 3 years to life, I think.

No, this does not happen everywhere. Just where thugs feel to shoot helpless people with nothing being done to them. Many in Hinds county think Mrs Temple is at fault for not just giving up her purse.

This was not an unusual or unforeseen crime for the Belhaven area. These type crimes are not frequent, but yes, these type crimes can happen anywhere, anytime.

No one blames the victim here, but the best response is to not resist. These criminals are hunters looking for easy victims. They are often impaired by substance abuse and easily panic if their "script" goes off track. JPD won't find these guys, the trail is too cold and the clues very vague. They won't devote much capital to it.

Here's hoping that all systems will return to normal and that the lodged bullet will do no damage. She was being "fiesty" in not wanting to give up her purse and I will never blame the victim.

Will pray for her to get out of ICU soon. Jackson is not to blame for these evil people who prey on others. Look to the criminal justice system after arrest and exorbitant time until trial for the fault. Bet when they are caught, and they will be, that JPD has a rap sheet on them.

Whoever on this list of posts Is badmouthing Jackson but lives within 35 miles of it, you have nothing to gain. A loss or negative press in Jackson is negative press for you all. Everytime something goes awry in Jackson, your little clean-toilets/white bread/ public school-going leased BMW life in madison/Brandon/whatever is one day closer to the same problem. The comfy feeling-of your washed gravel driveway and the 68 homes that match yours on your street -becomes more synthetic with each breath.

If things don't get better in Jackson, things don't get better anywhere. Rooting for Jackson is rooting for mississippi- rooting for jackson is rooting for your property values- no matter where you live in the metro.
For that matter, if you live in mississippi, you should care about the Capitol.

The whole thing about blaming this woman for resisting is ridiculous. My purse was stolen at the Chevron by Highland Village about two years ago. On instinct I resisted and simply got pushed away while he ran to a waiting car. I realize now how lucky I was the guy didn't have a gun but she didn't have time to think she just reacted. It sounds harsh to say, but I truly think that the only thing that will stop this is some of these guys getting shot and killed when they try to rob someone. It will get rid of them and (maybe) make others thinking about doing the same thing think twice.

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear.
