John Doe gets stay from Supremes

JJ readers will have to wait awhile longer to find out who John Doe is in the Ole Miss NCAA scandal.  The Mississippi Supreme Court issued a stay of the enforcement of Hinds County Chancellor Dewayne Thomas's order that said Ole Miss had to disclose the identity of John Doe.  The order stated:


After due consideration, the panel finds the chancery court's order should be stayed pending further order from this Court. The panel further finds that the Appellees shall file a response to Doe's motion within thirty days of the entry of this order. Doe shall file a reply to the Appellees' response within fifteen days of the filing of the Appellees' response.
IT IS THEREFORE ORDERED that John Doe's Motion to Stay Pending Appeal is hereby granted, in part.  The Hinds County Chancery Court's order is stayed pending further order from this Court.
The order was issued by Justices Dickinson, Coleman, and Kitchens. 

Kingfish note: More games by John Doe.  He lost before Judge Wise, the Mississippi Ethics Commission, and Judge Thomas while throwing up weak arguments.

Hard to believe Mississippi Supreme Court granted a stay.This would probably not happen in any other state. By the time this matter comes on before the Court, it will be moot. Looks like Booster 14 is only trying to keep his name secret from Ole Miss faithful, everyone else knows the identity of both Boosters 12 and 14. Do not understand how name of Booster 12 has been stayed. This makes a laughing stock of Court.

The speed with which the Supreme Court issued their stay leads me to believe that Judge Thomas had this worked out with the SC before he lifted his stay, knowing the SC would get him off the hook.

No. I suspect Doe already had everything written out before Thomas's order was issued.

A stay is a no brainer. As Doe argued in the motion, if the name is released before the MSSC rules on the merits, it would effectively deny his right to appeal as it would then be moot. One should not see this as an indication of the MSSC view of the merits of his claim. It is just protecting his procedural rights.

1:58 says everyone knows the names of boosters 12 and 14. If someone truly knows who they are, will it be in violation of the stay to divulge their names on here? I am not an attorney, but it seems as though there are a great number of people on here who are because they can speak the language very well where we commoners do not.

The NCAA findings describe the cars driven by the booster and his paralegal and the red hummer belonging to the paralegal's husband. Guess there aren't too many red Hummers around.

I'm on the edge of my chair waiting. This is truly important information that I need to move forward in life. I am paralyzed by the fear of not finding out who the doofus is. I don't know if I can take it for another 45 days. KF, I sure hope you can find another equally important news story to hold my attention in the interim.

I live outside of Mississippi and travel a lot around the South. In discussions on college football, it is not infrequent that the question of why Ole Miss is still in the SEC is discussed. There are a number of high quality universities in the Southern US that are not in the SEC but have advanced in all areas, particularly academically, well beyond Ole Miss. (There is also the joke around the South that if you can’t get into you own state’s university, you can always apply to Ole Miss because they accept anybody.)

Yesterday’s sports bar discussion among some well-educated college grads was that the next (and probably final) round of realignment will solve the problem because Ole Miss at that time will likely be on probation or even suspended from the NCAA. The foolishness of this current saga by Ole Miss and it alumnae-lawyers has convinced a lot of people that it’s long past time to boot Ole Miss out and include instead some modern, high quality universities into the soon to be formed new Southeast region of the NCAA.

Everyone knows who it is. What difference does it make if it is not official for another 60 days. It has no effect on the NCAA ruling. It's trivial at this point.

I have three degrees, none from Mississippi schools, including an advanced degree from a very highly ranked national university, but I am always struck by the ignorance and academic snobbery of folks who think there are such large gaps between the education one receives at Ole Miss or State and more highly ranked institutions. What it shows is that people are taken in by rankings that have little to do with the actual education received by most undergraduate students at most universities. I work with people who have undergraduate and advanced degrees from southern public universities, including Ole Miss and State, and top public and private universities from around the country. Frankly, you can't tell the difference as to who went to what school based on their intelligence, skills, and work product. I would rather hire an A average student from Ole Miss than a C average student from Vanderbilt. Top students from Ole Miss and State will be competitive with top students from most colleges and universities, even higher ranked ones, as far as their knowledge and skills.

And for record, when it comes to college sports, I "hate" Ole Miss, and I have been very critical of Ole Miss's handling of the fiasco with the athletic department.

I imagine that if I listed any of the quality educational institutions of my colleagues here you would probably use football statistics (from 1960 of course), instead of academics, research, self-funding, post education success of grads, income levels, quality of life, etc., as your idea of comparability. (But, yes we like football, too.) Tell you what, next time your Ole Miss team is in Atlanta for the SEC title game (ha ha), come on up to the GT Technology Square Research Center in Midtown and I will take you a couple of blocks over to a great spot on Peachtree and introduce you to several colleagues educated at real Southern universities so that you can see how backwards Ole Miss really is. (Leave your flag at home, though.)

6:03, don’t worry, I will order the drinks so that you will not be laughed out of town for ordering “hooch”. By the way, before you smart-off at Midtown: Mississippi leads the nation in the number of young people leaving their home state – but you poor Ole Miss people are so easy to spot.

9:37 -- and just why are you in this discussion? You are not a resident of Mississippi, proudly tell us how you're not a graduate of any schools here, and reside in Atlanta. Your point?????? (also -- I'm not 5:57 or 6:03) but just reading this --- you sound like a class one arrogant ass. Stop letting your fingers get ahead of your self-perceived Giant Brain -- step away from the keyboard, and work on getting that HUGE chip off your shoulder.

Also -- before you pile on about how ignorant we are......in my immediate family of 7, we have 1 M.D., 1 Ph.D., 4 Master Degrees, 7 Bachelor Degrees.......some from MS schools and some from other SEC schools and private schools IN the SEC.......of the 7, two studied abroad for multiple years in Europe, and one family member is in one of the top programs in the U.S. in his medical field of study...and our entire family loves Mississippi, loves Ole Miss, and respects State...... SO..........let's play poker - you throw down your qualifications. I call.

We can "fight amongst ourselves" but I'd suggest you just stay in Georgia, course I'm not sure if you get out of Atlanta much.

Also -- not sure if you run a business or not (I'd guess NOT) -- but YOU don't "hire" unless you sign the front of the check -- so check your ego. You choose people, you'd like to work for you while someone else pays for it.

Your arrogance is AMAZING. I bet your 5 feet tall, weigh 130 pounds, and are sitting in your parents basement, ordering pizza, and cruising match.com in your off hours.

John Doe got a stay from the Supreme Court. Jim Kitchens was one of them to give the stay. That's all you need to tell me! I have absolutely no trust in the legal system.

It's hard for a university's administration to control employees and fans who convince themselves that the only reason their beloved school isn't winning is because the other schools are violating NCAA recruiting rules and getting by with it.

The notion is that we should " out cheat " them.

"Everyone else is doing it or doing worse" is a poor excuse that never flies when you get caught doing the wrong thing.

The Jim Kitchens on the Supreme Court is NOT the same person as the Jim Kitchens who is circuit court judge in Lowndes County and keeps delaying the sentencing of the wife beater.

So when will our AG of Mississippi start looking into Jim Kitchens? Between the John Doe stay and the Clark boy getting off the hook in Wayne County there is a clear violation of disregard for the law. But what do expect The Supreme Court Justices are OM graduates.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
