Nutt calls Ole Miss's bluff.

Houston Nutt called Ole Miss's bluff.  Ole Miss said that the former football coach was only interested in money after he sued the school for breach of contract in U.S. District Court.  However, Mr. Nutt offered to settle the case in exchange for a public apology and a donation of $500,000 to establish a sports integrity commission in Mississippi. The settlement dispute is currently moot after the lawsuit was dismissed for lack of jurisdiction last week although Mr. Nutt said he will re-file the lawsuit in state court.

Mr. Nutt accused former head football coach Hugh Freeze and Athletic Director Ross Bjork contacted journalists and defamed him to deflect attention to Ole Miss's NCAA problems away from themselves.  The NCAA sent two notices of allegations to the university.  Ole Miss will appear before the Committee on Infractions on September 11.

The Clarion-Ledger reported on August 3, 2017:

"Mr. Nutt’s lawyer mentioned an apology in passing in a couple of conversations and in one email earlier this spring. The University asked Mr. Nutt’s lawyer to identify statements for which Mr. Nutt wanted an apology," said Paul Stephenson, attorney for the university and the IHL board. "Mr. Nutt’s lawyer never provided anything. To be clear, this lawsuit was never about an apology. It is about money. But Ole Miss has paid Mr. Nutt everything that it ever owed him."
 Houston Nutt wasted no time in responding to Ole Miss's public statements.  He sent a settlement offer to Ole Miss the next day.  The offer  requires Ole Miss to apologize to Mr. Nutt for its alleged statements:

 In an effort to bring this matter to conclusion without the need for further litigation and discovery, I have been authorized by Houston Nutt to make the following settlement proposal:

UM, OMAF, and Coach Nutt will issue a Joint News Release that includes the following information:

1. Ole Miss makes appropriate acknowledgement of false statements made about Coach Nutt and offers appropriate apology for any resulting damage to his reputation.

2. Coach Nutt accepts and expresses appreciation for the University's apology. He also expresses his hope for positive closure of the distractions the football program has confronted in recent years. Coach Nutt confirms that his attorneys will immediately dismiss his lawsuit with prejudice and that he has signed a full release.
a. No admission of liability to Coach Nutt.

b. No admission of any conduct that might constitute a violation of NCAA Cooperation Principles.
Then there is the matter of the $500,000 donation:

UM and OMAF announce that, as a condition of the settlement of Coach Nutt's lawsuit, the Foundation will contribute $500,000 to fund the creation of an intercollegiate commission to study, make recommendations, and implement programs designed to place more emphasis on the importance of fairness and integrity in Mississippi college sports. The announcement will also include the following:

a. The commission will be chaired by Ole Miss Law School Dean Susan Duncan, or her law school faculty designee, and its members shall include at least one representative of each four-year state college and university in the State of Mississippi.

b. The commission will make a publicly-available initial report of its findings and recommendations in 2018 and will issue annual, publicly­ available reports thereafter so long as sufficient public or private funding is available to continue any programs implemented based on the commission's  recommendations.

Yes, let's say Ole Miss were to offer to pay $500,000 for an "Integrity" campaign...well, that would be admitting that the school was guilty in the lack thereof (of integrity) and that Ole Miss conceded that they had done something wrong...and that is not going to happen, period.

What is ironic is Nutt saying that an "integrity Panel" is needed for the State of Mississippi, when in fact Nutt had none when he was having ACT scores fixed...THAT IS RICH.

Nutt is washed up and he has bilked the State of Miss. out of all of the millions he will ever get...stick a fork in him...he is DONE! Good riddance.

Breech of contract you dumbasses. It's cut and dry. The "University" said bad things about him to the media which was NOT supposed to happen per the agreement ya'll signed with Nutt. The argument that the University was made up of different people at the time the contract/ agreement was signed to avoid paying damages is null.

In a state so poor, we cannot take care of our elderly, our insane, and our children (or our roads, or our bridges), the LAST thing we need, is to have resources diverted to something so inconsequential as SPORTS.

The MSU hate of Ole Miss shows exactly what wee little people they are. So sad. Their lives revolve around working to take OM down. Their lives must have no meaning. What worthless pitiful souls. Their world revolves around Ole Miss. Their Sports Information person devotes his life to tearing down another University. Well, I am an OM graduate and my life does not revolve around football. We know we are better than the inbreds. Football has nothing to do with the realities of life. Just stay in that awful ugly town of Starkville and out of Oxford. You would lower our property values.

Rankin-based keyboard lawyers will tell you that proposing a settlement that forces the opposing party to admit wrongdoing, all before your first hearing, is a great idea. This is another reason State fans will always be the little brother.

I live in the heart of MSU country as an Ole Miss graduate and fan. The vast majority of MSU fans are very nice, decent people who never voice crap like posted here. Anyone who feels compelled to post garbage like posted here are very unbalanced personalities with huge inferiority complex issues.

I'm a fan of Ole Miss, but not a fan of the cheating and have developed an intense dislike of Hugh Freeze because he is an absolute hypocrite.

Houston Nutt is using/wasting oxygen that a viper could be using, This asshole crashed the program, took his cash, and ran like a rodent and now feels insulted that he was accurately described after the fact. The contract did not prevent comments on his role in the football program. Any new lawsuit will fail just as he did as a coach at two SEC programs...

@ 9:07, it is evidently NOT in the contract. Nutt asked for it, but Ole Miss did not agree to it. There is a vague directive in there about not needlessly bad-mouthing Nutt. That is very different from a non-disparagement clause, though.

Also, I'd still contest that of all the things of which the NCAA has accused Ole Miss, the worst things happened under Nutt's watch. Academic fraud is serious.

9:49 AM Yes, the contract language is public. It doesn't say what you think it says. This case, even if refiled in State court, will never make it past summary judgment for the defendants. The no case here. Mars has the reputation of being a terrific lawyer - probably well deserved - but he has a loser of a case.

From the outside looking in - it seems OM is imploding daily. If the administration there doesn't start conceding on some of these items in question or just stop defending the offenders. The fire is out of control and it appears they just want to argue about what color the fire engine is. Look if this isn't drained completely and soon, the big brother/little brother antics are laughable as it will clearly be Orphan (OM) and Only Child (MSU)in MS for the next decade or more. After the power outage in Oxford comes about, who know how long it will take to recover; and if there is any residue remaining after this, it will resurface as it is now. History has proven this at least once at OM; leaving bad apples in the basket will not work. And the NCAA will be watching even more closely as to how you will cleanup & rebuild. I really hate that young men and women students who were seeking a foothold in their lives have to go through this because the adults were only looking out for "the program" / "the network" / themselves. The students lose no matter the final outcome. The NCAA should allow anyone that wants to leave now - can go. It has to be poisonous on campus at OM right now and the future doesn't look to bright for anyone there.

Frankly, we know better than to get involved with recruits that Bama and UGA are in a bidding war over. You touch the conference protected class, and you draw back a nub. We seem to do a better job of staying in our lane and understanding our role as conference hind tit-sucker.

I actually feel sorry for you jackasses. All that blatant asshattery and nothing to show for it. It must suck something fierce to know your program remains the only original west member never to have made it to Atlanta.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online).
