Update: There were two outstanding warrants for McDonald's arrest at the time of the shooting. One involved a police chase. The motion for bond states that he was "involved in a house burglary and almost shot by homeowner." See motion posted below.
"Criminal is what I think is going on and what has happened to my dad" said the son of accused killer Wayne Parish. He was indicted for murder in the shooting death of 17 year-old Charles McDonald last June. The shooting occurred when McDonald jumped out of his mom's car and ran away when she attempted to take him to Henley-Young Youth Detention Center. Parish confronted McDonald as he broke into a secretary's car. Security camera video shows a struggle over the gun taking place when McDonald was killed. JPD declined to arrest him at the time. The police report is posted below.
Josh Parish, the son of Wayne Parish, said his father shot Charles McDonald in self-defense. Josh said Performance Oil employees heard McDonald breaking into the car. Wayne Parish and three women were the only employees on the premises. His father went outside with a Smith & Wesson .38 revolver. Josh said "my dad's intention was to scare him off. He just wanted him to leave. He told him to leave several times but he refused to do so. My dad was trying to keep the car between him and the kid. The kid finally got to him and the struggle for the gun began. He was a pretty big kid." He said his father even fired a warning shot into the ground.
The family provided a copy of this photo that was taken after the shooting. Wayne went to the doctor for an examination shortly after the incident. The picture shows two marks on his face.
Josh said his father told him "I thought if he got that gun, he was going to kill me." Josh said that at some point in the struggle, the gun was fired and McDonald was shot twice in the chest. Josh said his family didn't think Wayne would face criminal charges because JPD officers said they were classifying the homicide as one of self-defense and thus justifiable.
A Hinds County grand jury indicted Wayne Parish for murder in September but he was not arrested until December 29. The family had no idea that Wayne was arrested. He did not show up for work that morning. The owner of the company was concerned and called the Copiah County Sheriff. Deputies conducted a welfare check at his home. Possessions such as his keys and cellphone were present. A search of local jails and hospitals yielded no results. The Sheriff finally saw that there was an active arrest warrant for Parish in the computer system and investigated. He informed the family that Wayne was arrested for murder and that the warrant classified him as "armed and dangerous".
Wayne is represented by attorney Merrida Coxwell. He will be arraigned Tuesday morning in Judge Kidd's courtroom. The prosecutors assigned to Judge Kidd are Shontae Washington, Kimalon Campbell, and Greta Mack. Mr. Coxwell has also filed a motion to set bond. Josh said the District Attorney has "no interest in talking to us."
Josh insisted on addressing any charges of alleged racism that has been made in social media. He said "my father has four mixed-race grandchildren. He's not racist. He doesn't have a racist bone in his body. My father lost a child when my brother drowned as a kid. He's been through alot. The last thing he wanted to do was shoot that kid that day and see that mother experience the tragedy of losing a child. I can promise you he shot McDonald in self-defense."
The younger Mr. Parish also said that he offered to provide copies of the security camera video (posted below) of the shooting to the local media. He said only WJTV accepted the offer but only posted a few seconds of the video. WJTV didn't provide any coverage of the video until this website posted it last Thursday.

If ever there was a case that qualified for a change of venue this is the one. This man will never get a fair trial by a jury of his peers in Hinds County.

Who arrested him at his residence if the local Sheriff's office was not aware? HCSO would not have jurisdiction down there would they? They would have to go through the county or local law enforcement agency.

Not only should the charges be dropped, in my opinion, the prosecutors that have brought these charges should be disbarred. If that were to happen, this man should file suit against the prosecutors to recover his legal fees. This is akin to something you would see in South Africa.

You are very right. Not a lot of people want to live in such an area. Those that are left are mainly of two groups. One group cannot sell their business or homes for enough to get out. The other group lives behind gates. The rest are mainly feral people.

Yes, I fled Jackson. My family and I made the decision to get out after years of agonizing over leaving our home and the once beautiful and safe city in which we had been raised and spent much of our adult life.
I will list a few of the reasons they caused us to leave Jackson.
*Kids couldn't wear their favorite coats and shoes to school because thug students took them, or should I use that dreadful word STOLE, and threatened bodily harm if they reported it.
*Correspondence sent home by teachers that read as if it had been written by a kindergarten student.
*Property taxes that got so high that the monthly escrow for the taxes was equal to the P&I payment.
*Property crime that cost me thousands of dollars. In one instance the thief was caught, arrested and charged with the theft, but the esteemed DA chose not to prosecute.
*Failing infrastructure that left us without potable water for long periods on several occasions.
*Damage to vehicles caused by streets that are not fit to drive on in a tank.
The list could go on but I hope you get my point from these few items. I didn't leave Jackson without much consideration. When things got so bad that my wife and kids feared for their safety I knew it was time to leave my hometown. I am not a Jackson hater. I love Jackson and would love nothing more than to see it once again rise to the great city it was in the past. At that time I would be honored to move back to Jackson and enjoy the many great things it once had to offer. Until the streets are drivable, the infrastructure is brought up to date and the crime is controlled I will stay in my small town where I can walk the streets at night without safety concerns, drive to store without knocking the tires off my car, turn on the tap and know safe drinking water is will come out of the faucet, not have to take a second mortgage to pay property taxes, know the teachers are educating the students properly, fully expect the DA to prosecute any criminals, etc...

He is covered under the Mississippi Code 97-3-15 of the Castle Doctrine, Portion e, from the way it reads. This is a waste of time and tax dollars. I don't know what the D.A. is trying to prove.
I don't think the DA has time to be grandstanding on this case. I think this indictment is the result of an incompetent group of ADAs. The qualified ADAs have quit, transferred, or retired over the last couple of years. What staff remains lack experience and courtroom skills, which includes case assessment.
I doubt this case reaches a jury.

I moved from Jackson to Hinds County when Jackson was declining, so I could least cut my losses before everything I invested at at my home was gone. Now the 'virus' is spreading to Hinds County and getting worse...Screw moving out a little farther, I'm going to move out of the state before my property value craps out on me again. I'm tired of what I keep seeing around here, I've been burned for the last time....and I'm done.
There was an earlier comment that blamed the loss of businesses for this and similar behavior; Performance Oil was a Jackson business that is now closing up shop and moving because of this incident. Until people start taking responsibility for their actions, rather than blaming something or someone, Jackson and other large cities will continue to lose businesses, money, and decent public servants? Additionally, I found out that the DA's office used the Federal Marshals to pick up Mr. Parish and bypass any kickback from local authorities to this unbelievable travesty of justice!
Seems like a set-up for a premises case for mom. If charge sticks at trial or through plea, civil case will be difficult to defend.

Sometimes a man has to stand up and be a man. Here we have an example of a man who did just that. There are not that many men left in Jackson. We need to do everything we can to encourage the few that are left. Instead of charging them with a crime we should have the mayor giving them some recognition for what they are forced to do to help the city.

Please post the video that allegedly shows McDonald charging him and grabbing the gun. This video shows Parish taking the law into his own hands and being the aggressor. It appears that McDonald is trying to get away and protect himself. Post the one that shows otherwise. Also, I'm not sure what the photo is supposed to prove. Assuming those marks are even from that incident and were actually caused by McDonald, a kid has a right to defend himself when a lunatic runs at him with a gun. As for what the kid was doing, we don't know because he's dead and we haven't seen that video.
You missed the point Kingfish, he should never have confronted the guy, he could have called the police, taken pictures etc. The moment he pulled out his gun he was the aggressor period. BTW he will not serve a day in jail for this. In a civil court he will be found liable it's the law folks. I don't like it either.
2:21, the video was posted right here on this forum on Jan 5, 2017. It clearly shows the thug trying to break into a car. Shows him going by the car a couple of times them picking up several objects and uses them to try to break into the car.
Even another thug should be able to look at the video and see what is happening. Of course we have one on here that gets his news from JFP. He will tell you the thug wears water meter covers, asphalt, and pipe for shoes. It really does or matter if you want to look at the video or depend on lies. For all my dear friends still living in Jackson(I have quite a few that I seriously care about) please take note: Under no circumstances should you defend yourself unless you are holed up in your home or you are being monitored by a security camera. Even with a security camera you run a risk of being rail roaded.
Most of us reasonable people can see this was clearly self defense and feel confident that he will eventually get his justice and walk free to move his business/home/productivity to Madison or Rankin. But what would his odds look like if there hadn't been any camera? Pretty bleak I suppose
The sad fact is the couple of posters we see on here that think thugs have rights over their victims are a sample of the majority of Jackson citizens. They were raised to believe that. The non existing parents did not teach them any better. The failing schools didn't teach them any better. Even the law enforcement comedy act didn't teach them and better. This whole horrible occurrence was caused by the city of Jackson. If the city would have provided a suitable public transportation system, this young man could have hopped a bus, train or street car and left the juvenile detention center quickly and safely without bothering the nearby businesses. It's JATRAN's fault!!
Give me 10 minutes and I could find 10 things to blame. It's the kid's fault. Mr. Parish would have never left his place of work had he not heard the commotion of this kid trying to break into the car. McDonald had every opportunity to keep walking and not engage in the criminal behavior that caused this confrontation.

Here is the deal. A lot of the liberal democrats are only able to think about one thing at a time. Yes you do not see the initial attack by McDonald. That is why the JPD used both the video and the two eye witnesses that are not employees of Performance oil or the mother. They fill in the gap as well as that Wayne told him to leave repeatedly. This is why they DO NOT SUPPORT THIS CHARGE. Please keep in mind, in addition to the video, there are 2 witnesses. From their view point they could see the entire thing. So Wayne's defense is not just based on the video even though there is a small portion you do not see in it. I would add that there have been no less than 12 people that have seen the video, not including the JPD, before it was released, and none have said that Wayne did anything wrong. All were in law enforcement with two exception, those 2 were Judges I know. And by the way, the 2 judges say the Castle Law does apply. There is a key word that some may not know the definition of. Premise, go look it up.

This is exactly why neither me, my family, nor my friends go into the City of Jackson. For work or pleasure. You play with fire, you get burned. We should build a wall.
No doubt, this was a pure act of self defense. The acting DA surely is trying to make a name for himself. Mr. Parish has made a good name for himself and makes friends everywhere he goes. The most likable guy anyone will every meet. He constantly gives of his time and is always there to help others out that are in need. Wayne Parish is the most loving Father and Grand father that anyone could ever have. For something like this to happen to such a good man is absolutely unthinkable. He never intended for that young man to die and if the young man would have asked for food or for a ride. There is no doubt Wayne would have helped him. But the boy clearly attacked him after Wayne gave the boy every opportunity to leave. Wayne Parish is being wrongfully charged and his rights have been taken away. A petition needs to be signed for Freeing Wayne Parish and for removing the DA. This DA is clearly breaking the law and is not competent in the law. 1st degree murder is a plotted and planned event. This event, definately was not.
If the laws of MS do not include the ability to go out and confront an unarmed person trying to break into your car in hopes of " scaring him away", then Madison doesn't have the laws to allow confrontation rather than to have the police handled it either.
Juries pledge to follow the law. Some juries express their unwillingness to do so but you can't blame a jury that lives up to their pledge. Nor can you blame those who see their duty as adhering to existing law rather than picking and choosing which laws to enforce.
I would suggest to you there are some dangers in allowing one person to pick and choose what laws should and shouldn't be enforced.
It's still a free country. You can live anywhere you want or leave if another country will take you.
What I object to is that you find it necessary to criticize both the place and people you left simply because it and they didn't meet your lifestyle and financial criteria.

What I object to is the fact that many of the problems Jackson faces were created by administrations while you were a resident and didn't happen overnight. You were blissfully ignorant or didn't object to prior policies and the neglect that created some of these problems but you now expect them to be solved overnight with fewer financial resources that existed when you lived in Jackson.

Have you driven on some of the roads in the older subdivisions of Madison? Annadale's roads weren't holding up well last I rode down them and even if they've been re-surfaced since, they will not hold up over time. They haven't lasted as long as Jackson's roads did for a reason.
Your neighborhoods and shopping areas are only as good as your developers and how well they prepped the subdivision and whether or not your builder was one who cared about the " bones" since building codes are poorly enforced.
Everybody and everything gets old. Everybody and everything is only as " good" as they were created, cared for and maintained.
Talk to your elected representatives about changing laws.

Agreed with many. There should be no charges. This is a racially motivated action against a white man justifiably killing an aggressive young black thug. Watch the video. The mother showed absolutely no concern of he son being shot, while she got out of her pickup. She chose to play on her cell phone instead of going to the side of her son.
