Senator Roger Wicker just said on the Paul Gallo Radio Show (WFMN) that the Senate should not confirm any Supreme Court nomination submitted by President Barack Obama to replace Justice Antonin Scalia. The President announced he will submit a nomination after Justice Antonin Scalia died Saturday.
Senator Wicker said:
My constituents deserve to know where I stand on the issue of moving forward this year of confirming a replacement for Justice Scalia...
My position is this decision is too important and too consequential to let this current President make the decision in an election year. That the next president should choose Judge Scalia's replacement....
The Senator also cited none other than Senate Democrat stalwart Chuck Shumer's remarks from 2007 in defense of his stand:
We should reverse the presumption of confirmation,’ Schumer told the American Constitution Society convention in Washington. ‘The Supreme Court is dangerously out of balance. We cannot afford to see Justice [John Paul] Stevens replaced by another [Chief Justice John] Roberts, or Justice [ Ruth Bader] Ginsburg by another [ Samuel] Alito.’” Mr. Schumer went on to say that he would recommend to his Senate colleagues “that we should not confirm any Bush nominee to the Supreme Court except in extraordinary circumstances
Senator Thad Cochran issued this statement:
U.S. Senator Thad Cochran (R-Miss.), chairman of the Senate Committee on Appropriations, today released the following statement regarding the process by which the Senate may consider filling the seat held by the late Antonin Scalia on the U.S. Supreme Court:
“There is significant precedent for holding a Supreme Court vacancy open through the end of a president’s term in an election year. This is a good policy that has served the nation well and should continue to guide us. I think it is appropriate that the next president be accountable for this nomination.”

I certainly agree with Senator Wicker. Any nomination that Obama would submit would be extremely liberal and would therefore make the Court a liberal one. Many of our ideals that we have always lived with could be in jeopardy.
Ironic that the Senators wanting to ensure another Scalia is on the bench refuse to do what Scalia would have done and abide the Constitution's authorization of power to the sitting President to make this call.
I feel certain that with the cooperation of McConnell, things can proceed at a stately pace and manage to not come to a vote before February or March of 2017. This is, after all, one of the reasons the American people voted in a Republican Congress.
If the shoe was on the other foot, would Roger still feel this way?
I'm sure you were offended over the treatment of Janice Rogers. Oh, that's right, she is a black conservative jurist, she deserves every bit of punishment she gets.
I have heard this talk big and carry a small stick talk before and still say that an Obama nominee will be confirmed.
There was a time when many people said Mr. Obama was playing fast and loose with the constitution. "He had no respect for the document". Now they are hypocrits who play a dangerous game by effectively denying a president they don't like his constitutional responsibility and right (without considering his nomination at all). The next president will undoubtedly rub some people the wrong way and will probably be called a traitor by some, but being white and hopefully Republican he won't be told that when he does his job according to the constitution he will still be blocked before he gets the chance to do it! Politics before principle. Is he any more a demagogue than his accusers? These people don't want to straighten the country out, they want to usurp the rule of law by political fiat. A glass house is a dangerous place.
The junior senator is such a lightweight. Little man with a big ego. Always against something and not creative enough to come up with important legislation on his on. But we're stuck with him.
Dontcha just love it when the liberals come slinking in, hat in hand, singing the 'can't we just get along' song in a whiney, monotone collection of whispers?
Look! We already know about the 'shoe being on the other foot'. It was on Bush's foot when Schumer inserted his in his own mouth. And another Junior Senator, Hussein Obama, agreed loudly with Schumer.
I have heard this talk big and carry a small stick talk before and still say that an Obama nominee will be confirmed.
Mail your fifty bucks to Kingfish and I'll send him mine. You can retain your anonymity and I'll collect your cash. He won't know who you are but he'll know me when I pick up the bag money.
I am a conservative and haven't voted for a democrat except some local elections in the last twenty years. However, Wicker is dead wrong on this issue. Obama will nominate someone, probably someone that I will not like, and the Senate is obligated to carry out the process outlined in the Constitution. That doesn't mean they have to seat the nominee. Eventually Obama will send over a compromise nominee or his time will run out. But this foolish stance will gain nothing positive.
I agree that the junior senator is a light-weight. I also agree that the senior one is DEAD-weight. We have painted ourselves into this conundrum-cawnuh.
Wicker is scared to death of a primary challenge. So is Tate Reeves in 2019.
9:54: Janice Rogers. Alberto Gonzales. Some minorities are apparently more equal than others.
The dems would also see it differently if shoe was on other foot. Bottom line is that all politicians are hypocritical on a subject when it benefits them. Meanwhile, the sheep follow blindly.
This country was created with many check and balances. It was to be a weak and limited Federal government. The required action of the Senate is part of the checks and should be used as needed. If do not like what the Senate does we can elect new members. When that said , block anything that this president wants to do.The man is pure evil.
10:24 way too reasonable of a stance. It's politics and self-promotion first, country last. Get it straight!
Both sides do the same thing. If they would have kept their mouth shut and went along as usual there would not have been time for Obama to get one through.
They had to run their mouth to try to get a couple more votes.
Why do we even vote for politicians this dumb?
Nice try Kingfish. I don't vote or support a person just because they are black.(Rogers) Show me where the Senate said they would block ANY nomination of Bush BEFORE he made a nomination. So answer this question, When the election is over and the next POTUS is a democrat, what then? What excuse will they have then? Besides, wasn't Scalia a staunch constitutionalist? Seems to me the best way to honor him is to stop poliTricking and follow the constitution. If Romney was President then he should get to do his job. The same should be for Obama. All we ever ask is for a fair, level, even playing field. But alas, we cant seem to get that.
I'm sorry but I just have a really hard time believing that THIS will finally be the time when Congressional Republicans finally stand up to Barack Obama. His nominee will be an apparent moderate, and the Senate will confirm. Cochran and Wicker will help carry Obama's water just like they always have.
Prediction: Senate refuses to confirm Obama nominee. Clinton is elected, nominates Obama. Taft was president before serving on the Court. How now, brown cow?
President Obama is going to nominate a right of center conservative judge. Someone who is known to have those leanings and try to use this as a wedge in battleground states to elect more Democrats (potentially retake the Senate) and to help either H. Clinton or B. Sanders in the general election.
that way, they can say that the Republican party even blocks it's own that aren't extreme right-wingers...it would be a brilliant move. does not 'hurt' the Democrats and has the potential for huge gain.
Alright, you lefty prog commies, you want the senate to play by the exact letter of the law, deal, we ask the same of you and appreciate you not assaulting the 1st, 2nd, 5th and 10th amendments as well.
There will be another Civil War. The Federal Government is powerless to control our armed population.
The senate is not in session. Obama will executive power a justice, that will hold appointment until 2017, then depending on the election, a liberal, moderate or conservative appointee will go through the process.
The SCOTUS has a liberal bloc. They rarely break rank and vote similarly on most every issue. The other side has a much more varied set of jurists, with only Thomas as a solid, unwavering conservative. Funny how that works. We never have liberal justices turning conservative, but we have justices who were nominated by Republican presidents going moderately left (O'Connor) to full tilt liberal (Souter).
Wicker is correct to delay this pick. If a Democrat wins the presidency, then it's their pick, but Obama has already stamped the court with Sotomayor and the execrable Elena Kagan.
12:20 is right. It's coming. Central Mississippi will be wild land when it does.
I really don't understand all this delay. If Oboma nominates another nut job just take a vote and say no. Submit another one. (Hint: Obomacare is not constitutional. Gay marriage, or marriage to a goat, or any marriage, is not a federal question, but a state question - if you follow the constitution.) If that one is a nut job, vote them down too. Keep doing that until he sends someone who will support the constitution or until his term expires. Just do your job. It is very simple.
Nothing is going to happen. It is just a way for both sides to get some votes. Democrats are wishing the republicans will black them as they think they will gain a few votes. Republican will say they are going to block the democrats just so they can get a vote or two.
If you are old enough to vote you should already know how it works. If you don't already know you should not be allowed to vote. Some of you probably still think there is a difference in a democrat and a republican.
I'm pretty far left, but the arguments on both sides are pretty unconvincing. Obama has the ability to appoint a justice, and the Senate has the right to refuse that nomination. Both are constitutionally mandated powers.
However, I do hope that the voters realize in November that, despite all the Republican rhetoric about Reagan and consensus building, the Republicans are only interested in being obstructionist and holding fast to their party line. If the Republicans block a nomination, they should be punished in the polls.
The appropriate thing would be for Obama to appoint a more moderate liberal to the Court and for the Republican Senate to give a proper consideration of that nomination. I think that it is blatant and harmful partisan nonsense to state, before a nomination has been made, that all nominations will be blocked.
Just because someone is nominated doesn't mean it's over. Remember poor Mr. Bork who had to jump through burning hoops and still didn't make it to the end. Too bad cause he was a true legal scholar.
1:04 you can replace any reference to party and rightly recognize that we are governed by career politicians whose entire life is dedicated to the pursuit of money and power for their personal gain. They simply choose a side early on based on what they perceive is best for themselves at the time and then they hold fast to it for life. There are no statesman left, if there ever were any beyond the 9th grade civics student's imagination...
I'm pretty far left, ...
So what? Odd how similar your train of thought is to @10:24 who prefaced their comment with "I am a conservative".
Seems no one remembers the Senate Democrats' behavior for ALL judicial appointments during Bush's second term, when they threatened to filibuster any appointment. Not filibuster...THREATEN to filibuster, meaning that Bush was stonewalled because the Senate Democrats said they would filibuster anyone.
Who was the chief filibuster threatener? Hillary Rodham Clinton, Junior Senator from New York.
1:16 poor mr bork. yeah, like roll back civil rights and equal access to voting
What if Justice Scalia had died in December instead of March? This is simply a question of timing. Neither the President nor the Senate should be rushed to make or confirm an appointment.
1:04 "However, I do hope that the voters realize in November that, despite all the Republican rhetoric about Reagan and consensus building, the Republicans are only interested in being obstructionist and holding fast to their party line."
That, after how nice and conciliatory the Democrats have been toward the Republicans for, well, forever?
I tell you what, the Republicans damn well BETTER hold fast on this nomination. If they were to give in on this, they can kiss away being in the majority again in perpetuity!
Just typical politics, everybody can see through it. A Republican President would not wait why should a Democratic President?
An ignominious end 2:03 to a party that has allowed itself to go rotten to its core.
Will this be just like all the faux votes they've taken to defeat Obamacare, the most intrusive piece of legislation since the 1930s?
All of Mississippi's Federal Republicans must go on a very long steady walk to regain my trust.
All I want is the opportunity to run a business without the Gov't being this huge obstacle to startup or continuance. Only large corporations can compete now. Small businesses create so many more jobs than do corporations but its hardly worth it in this environment. Kill the regulations and forced expenses and let Americans go back to work.
Senators Wicker and Cochran, I won't be holding my breath waiting on you to "hold the line" on this Supreme Court Appointment. Your recent voting history speaks volumes. Obama has proven his resolve and will are stronger than yours.
The End Justifies the Means
Two Wrongs Do Make a Right
Everyone Else Is Doing It So It's Okay
Aside from the above being anti-Christian notions, the idea that your party should be as bad or worse rather than better is what is wrong with our Nation!
It is the height of hypocrisy for those who claim to revere The Constitution.
It is proof that politicizing the court rather than insisting that jurists be the most qualified available has and will continue to harm our Nation!
All of you suggesting that no nominee be seriously considered don't believe in our Nation. You believe only in your political party.
Your Us vs Them mentality has historically led to civil war and the outcome of civil war isn't usually good or don't any of you read?
Way to go assholes.
7:05
Apparently you don't read at all, or listen to and/or watch the news. It's been reported for years.
In the past, Americans had voted in a majority of democrats to sway the country along their way of thinking. Now people have put in place a majority of republicans who want to sway the pendulum in a different direction. This is done by voters. How else would you have it done?
To start you missive with noble thoughts of Two Wrongs... and preaching hypocrisy, you end with your personality reveal by calling all others A$$holes. Got it.
Sad that both sides cannot wait until the body is cold before getting into a fight regarding his replacement.
@3:29, You are so right. And what Wicker said about the decision being too important for the President to make is one of the most outward racist comments I've heard in a long time. Comments like his will keep Mississippi on the bottom of every good list and at the top of every bad list. Now, Cochran, he's just too pitiful to acknowledge.
Comments like his will keep Mississippi on the bottom of every good list and at the top of every bad list.
Comments as dense as your own are as contributory as anything Wicker might offer.
If it was all about words and rhetoric, the Kenyan would have the whole world sitting on a green hillside, enjoying a Coke handed out by an army of numbskulls like Ladd and Head, while listening to the sputtering of his absolute bullshit about Islamic "values" of peace and female subjugation.
7:49 said '...Wicker said about the decision being too important for the President to make is one of the most outward racist comments I've heard in a long time... and I say BULLSHIT.
If you want people to take black folks seriously you need to stop playing the race card. The president has proven over and over and over the he is a flaming liberal, very many think a socialist. There can be no doubt that he is viewed this way. You may agree with him on many things. OK, fine. But use your brain man - Anyone who says and does the things that this president had said and done is going to anger a LOT of people. It matters not what color the president is. We have seen the content of his character. For a person who is conservative to say they do not want this president to send another person to the court is not racists at all. It is a reaction to the man's politics. An attempt to save the country. Do you really want to stop racism? Then stop crying wolf about things that are clearly not racist.
Wicker is correct. All we need is a left leaning court to continue the downward spiral this great country is in.
Why is everything racist to a certain segment of the population. It only puts you in the Stokes world it is all the white mans fault.
