Rankin judge dies.

JJ confirmed Rankin County Chancellor Dan Fairly committed suicide this afternoon on the Natchez Trace near Highway 43.  He had been off the bench for several months this year due to a medical leave. More details will be posted when available.

Well, I saw first hand, this "good man" buy the lies of a certain overzealous highway patrolman cover his ass and cause a really sweet young lady to have a criminal record.
And I have a background in law enforcement.
We ALL know about the good 'ol boy system within the Rankin County Judicial System.

8:38 - I think that's true of lawyers nationwide. Lots of stress, lots of substance abuse. From our shoes it looks like judges have it easier, but perhaps not.

I just wish that he could have been strong enough to remember that no matter how bad the situation seems to be, there's always a light at the end of the tunnel.

@813 is right too. Because he was a public official, his death is considered news. The demons he struggled with will be debated and discusses.

Good will come of this though. The good Lord promises it always does. Prayers for his family during this extremely difficult time.

But this is such a small pond it seems so pronounced here. Perhaps more brutal? Perhaps so small that they care too much what others think of them? Also, few admit that a suicide occurred and it seems to just disappear from discussion quickly. How can the family heal properly if everyone is supposed to go on smiling like it's all fine and we are not going to talk about? I hope more therapy and understanding comes from this one. No need for our lawyers/judges to lose all hope they are loved even when they are imperfect and broken...

Dan Fairly was a good and honest Christian man. No one knows what the person standing beside them is going through in life, whether it be pain, personal struggles and/or hardships. All people go through bad times in life, sometimes, it seems more than you can handle and that is the sad part. My thoughts and prayers are with this family and the pain they are going through. May GOD wrap His arms around them during this time of need.

Yes Fairly had family, like a lot of others affected involving minor children. We pray for all the families, but we all choose our destination in life and God will be the Judge from this point, which Fairly decided this himself. I can forgive but never forget. He chose the cowardly way out and has to deal with God now, instead of the determined demand for justice Rankin county citizens he ran from with a one way ticket. A strong honest man faces his accuser if he has nothing to run from, especially a judge who makes decisions based off testimony from both sides. Fact is he had good decisions; however, there was obviously enough out there he felt like he could not face that would result in answering to bad enough he would take his own life. This is a result of questionable judgements and integrity involving several cases. He was under investigation for a fact and served by the Judicial Performance on his first day back on the bench this month after 90 days rehab, if you wanna call that medical leave..

Judge Fairly came to the bench with a perspective that most judges do not. He respected the litigants and their attorneys as persons, but also saw through the bullshit and lawyering used to mask real issues dealing with real human beings. He, whether his approach heightened the stress that already exists in the practice of law and the conflict between him and the attorneys or litigants drove him to his last action is an issue none of will ever know. Chancellors have a wider latitude than other judges, for they have the discretion to weigh the situation and issues in their courtroom and make the best decision based on the circumstances and the law. Judge Fairly did that and as result saved many families and children from abuse by addicted and mentally ill individuals who would have escaped notice by some other politically correct chancellors.. RIP Judge Fairly we failed you too by not reaching out to you soon enough.

We do not know his particular circumstances that would cause him to do this. I understand one of the prior posts said he spent 90 days in rehab. I'm wondering why didn't those professionals didn't spot something wrong? 90 days of rehab and they couldn't tell something was wrong with him? That's the place I would start if I were the family. With that being said, are these so called rehabs just a sham to get money from insurance companies? I am thinking that this will begin (and hopefully it does) an investigation into his Rehabilitation Clinic where he sought treatment.

I'm quite sure there will be enough voices of his peers that the tree will be shaken and root out why his problems were overlooked.

None of us are without fault or sin. This world is getting worse everyday. Only he and God knows what he battled with inside. May he rest in peace.

Lawyers are weak minded English majors who should have been trash collectors to begin with. Give them a few years parading back and forth in our pathetic judicial system and add some pseudo-Christianity into the mix and you now have the perfect recipe. (Greg Harper, is a perfect example). The entire process is a sham.
Fairly always looked high anyway. Maybe Rankin County should be sued for all of his erroneous decisions??

The rehab? How the hell are you going to help someone who's 50 plus years old ??? People need to read instead of watching TV like the rest of the Obama lovers. Maybe then you could logically think

There are so many cases coming forward now that showed he grossly misused his power that destroyed many lives including children. He should have been man enough to faced his owned justice. The same that he wrongly gave others. I am saddened for his family but at the same time am thankful he is off the bench.

Tried to have a nice $5 breakfast at the Kroger in Madison early this morning. At another table sat an individual spilling the most vilel vitriol about the deceased at a volume for all to hear. Another patron expressed the view that the speaker should be ashamed of himself and his comments. The speaker directed profanity in the patrons direction and continued his diatribe. The level of hostility and vulgarity by those that see themselves as moral and righteous amazes me. It is my prayer that when Judge Fariley closed his eyes to the demons of this world and opened is eyes in eternity that he was free of his torment. I also hope that the speaker will find his humanity.

Judge Fairly played God with the lives of innocent people. We are taught to believe that in our legal system we are innocent until proven guilty.
Five minutes before Judge Fairly is all one needs to shatter that belief. A black robe and a gavel does not give you the right to play God with people's lives.

KF refused to run my previous short post describing what a member of his family told a member of my family on Friday about the chain of events. By all means, let's not wait for the body to be lowered into the ground before presuming to judge a man for committing suicide, based on our zero knowledge of what went on in his head.

So-called "Christians" whose reaction to a suicide is to presume the victim is gone to hell are walking, talking advertisements for atheism. They should be more concerned with plucking out the beams from their own eyes.

I worked for Dan when I was younger. He treated me, and everyone around him, with an uncommon amount of respect. My interactions with him, and other lawyers like him, were a major factor in my deciding to become a lawyer.

In my years of practice, I only had one case before Judge Fairly. It was a small issue, but one I wasn't very familiar with because I didn't do chancery work. He was the same guy I remembered, and he basically walked me through the entire process to make sure I didn't screw it up. At the end, I thanked him for his help and then mentioned our prior connection. We exchanged pleasantries and chatted, briefly, about some of the people we worked with, and I left. I wish I had told him about the impact he had on my life and how much I appreciated him.

Having known Dan as an attorney, he might approve using the tragedy of his death as a sharing/learning moment. Basically, there are two main depression scenarios which lead to suicide: 1) Situational—This is usually caused by a severe physical illness, traumatic or adverse life events, and is considered by some to be a form of PTSD. 2) Major Depressive Disorder—This can be brought on by genetics, brain chemistry, early childhood environment, PTSD, brain trauma, or any combination thereof. Both can be aggravated by alcohol, opiate, and other drug use. When left untreated, the person may develop an overwhelming compulsion/need to die, causing him to act out on that compulsion. Having known Dan, I don't see him using suicide merely as a means to escape. I suspect that he too was laboring under an overwhelming compulsion that he needed to die.

1) Behavior is ignored.
2) Family is in denial or ignorant about positive intervention. Most of these lawyer are someone's meal ticket.
3) Fear of loss of career because of punitive versus positive help from professional organizations.
4) Minimal cutting edge therapy available locally.
5) Low moral standards yet "everyone us a deacon" in church (see Martin craziness).
Intervening for a loved one can be done but you will face headwinds and possibly be ostracized from your family and your social group. Many here can't stand the thought of that.
Not too many brave folks. Bravery saves lives.

I was recently in Judge Fairly's court room. His very first opening statement " I am God in this Court Room". He was drunk that day and even an uneducated person like myself reconized he had no business ruling on my child custody case. He would not allow my key witness to testify. Kept my child on the witness stand for over 2 hours until she broke down. He was sick and it makes me mad that Rankin County officials (attorneys) did nto do anything tohelphim and it was the people with small children that suffer based onhis drunk decisions.

If such an incident really happened, there are several people (bailiff, court reporter, attorneys, clerks, parties, etc) that would have taken action (such as reporting the behavior) to stop him. Even if they didn't want him to get into trouble, they would try to stop the behavior so he could get help. If this behavior really happened, tell us the date, time, and the names of everyone present so your story can be fact-checked. Providing this information can't cause you further problems with him since he is deceased. If you don't tell us, then that confirms that you are lying, mentally ill, and/or just mean as hell.

The story may well be made up, but you underestimate all those people's fear of antagonizing a sitting judge.

Bench and bar both do a bad job of policing themselves.

The Judge Fairly I knew was a pleasant gentleman - evidently a much better human being than 11:22 above. I agree that if 2:40's story is true, some corroboration would be nice. Judge Fairly plainly isn't going to retaliate.

Dan Fairly was a good man, father, judge and lawyer. He wasn't perfect but I never saw him exhibit the attitudes some on here are so quick to attribute to him as a judge. I don't know what caused him to take his life, but I believe his family is due respect and grace while they work through their grief. On this Easter Sunday, above all other days, we should try to exemplify the grace and mercy that was shown us in the death and resurrection of Christ.

The very first time I was ever arrested was when me and a friend were at Poets. Departing we noticed a fight in the courtyard and were standing watching it when several JPD 'officers' rolled in. They approached me and asked me what I was doing still here and I responded what are you doing here? They arrested both of us. My friend and Fairly were friends at Belhaven and my friend called Fairly who posted our bail.

My understanding was he was at an alcohol treatment center in Tennessee for sixty days and went there at the urging of the Commission.

Good luck getting that confirmed on the record but frankly, the Commission on Judicial Performance owes us some answers. Period.

Kingfish, are you saying that just because a person is a public servant, that he loses his right to privacy under the medical privilege if a particular medical/psychological condition could have an impact on his ability to serve the public interest? One of the main purposes of the medical privilege is so that when a problem is detected, the affected individual can then be encouraged to get the help he needs without fear of public exposure where he may suffer vitriol at the hands of the mob. On the other hand, if the Commission "owes us some answers" as you contend, and violates Judge Fairly's medical privilege, what kind of signal does that send to other lawyers, judges, doctors, engineers, legislators, governors, nurses, pilots, train engineers, boat captains, priests & ministers, school teachers & administrators, etc.--all of whom are individuals who serve in positions of trust--who need and want to receive help?

I watched this man rip apart families as well. I watched him choose mothers over fathers for no good reason. I watched him, as others have said, say "I am God in this room."

I would love to know why the media haven't picked up on the backstory yet. Is it out of "respect" for the dead?

It seems that if there is a backstory - such as this judge being under the influence, or having such poor judgment, then someone needs to break this open.

And David, while HIPPA certainly applies, I believe that those who wield great power should by default undergo additional scrutiny. Look at the German pilot who crashed the plane.

People with severe issues should not be in a position to impact other people's lives.

As an attorney I practiced before Judge Fairly the entire time he was in office, having trials, in chambers conferences and motion hearings--on no less than 20 separate occasions. Never once did I have any suspicion whatsoever that he was impaired in any manner and no one ever made such a suggestion. When he took a leave of absence, people who knew him thought it must be for some serious physical health problem. This all seems so out of character for such a fine person and one of our better chancery judges. He is now unable to defend himself and everyone should follow what your mother always told you--don't speak ill of the dead. He should be allowed to rest in peace and his family should be allowed to grieve in peace.

Most people who go into "rehab" do so because of depression. Some also have alcohol problems. Rehabs generally DON'T get paid big bucks by insurance companies. Most take payment out-of-pocket upfront - some as high as $25,000/month. If Judge Fairly paid for 2 months, he was VERY interested in getting well. Third, Judicial Review is not brought about after one or two newspaper stories, regardless of how poorly they were written, nor by one case, no matter how narcissistic the defendant. Fourth, the legal profession takes great pains to police their members and they do an excellent job. Most of the comments are made by sick, angry, and ill-informed pesople.

The hurt that this "God" of the courtroom rained down on people in said courtroom while possibly being under the influence, can not be ignored. I practiced before Judge Fairly and would not have ever suspected that he was impaired, if in fact he was. As far as the comments, I have seen him grant men equal time with women for visitation...in fact that was his standard. Second, it is really easy to find out if he said the he was "God in this courtroom." Transcripts are readily available. Just name the case, ask for one and pay the fee. Prove that he said it.

Judge Fairly's "suicide" is under investigation. Good. I hope The Truth comes out. There are suspects ...... people who made vaguely veiled threats. "A party to welcome him back ..." ???!!!!! Judge Fairley made good decisions based in the facts he had --- those of you who were denied custody were denied for a reason. Man up and stop blaming everyone except the person where the blame really lies -- yourself. Judge Fairly tried to protect children from abuse. His reward was death. There's a special place in Hell for those who abuse children. May you enjoy that special place soon.

I am also an attorney who practiced before Judge Fairly on dozens of cases over the years he was on the bench. From the very first time I entered his court room, he always treated the parties and counsel with respect and dignity, unless they deserved to be treated differently as a result of their own actions. In other words, if he, as the trier of fact, deemed that someone was lying, manipulating, or taking advantage of or abusing others, he would call their hand on it. At no time did I ever witness Judge Fairly even imply that he was "God", and instead, he distributed justice in a fair, albeit stern, and even handed manner. I agree with Derek Hall and other attorneys who have indicated that he was one of our better Chancery Court judges and I too never witnessed or even suspected that he was impaired in any manner in his court room. Judge Dan Fairly will be missed in our legal community and for those who seem insistent on spewing venom and muddying Judge Fairly's name, just remember there will be another judgment day. God bless you and keep you Judge Fairly, rest in peace.

I am an attorney that practiced before Judge Fairly on many occasions to include trials, conferences, hearings and in chamber meetings. He was always fair and treated all parties with respect and dignity. At no point did he ever refer to himself as "God in this courtroom" or anything similar. In contrast he put up with a lot of antics from attorneys and did so with a calm and professional demeanor. Further, he always placed children and families first.

I only post here so that if, for some odd reason, the family and friends of Judge Fairly peruse such sites they will see kind hearts in addition to the vitriol. Judge Fairly was a breath of fresh air every time I was in front of him. Yes, I am one of those dreaded attorney folks as well. Now...whether that air was a strong gust or a gentle breeze depended a lot on the circumstances. My experience was all the latter. He was a good public servant and a better man. A man with demons and sin. His sin shouldn't viewed as better or worse than anyone else. I wish his family peace and that they know he was much more revered than hated.

Appeals... They will pile up one after the next... It doesn't matter if he was on medical leave or not for whatever reason.... He was under investigation period! That is what will be released to the public... That is our right as a citizen to know what the investigation was about and for them to proceed with the investigation period. I'm sure if the investigation reveals horrible things then they will bring his rehab into the picture.... Until then no one knows and people need to calm down and let the family mourn. We soon shall see the truth be reveiled.

Are you saying you were in the courtroom with him EVERY SECOND he was on the bench, every case? In you weren't, why should we believe you. He could easily have said anything when you were not there.

Having been involved in sending people to rehab since 1988, often (usually?) involuntarily, I can say with certainty that statement is barnyard manure (acceptable, KF?). Depression may be treated in an inpatient psychiatric facility, but alcohol far outweighs depression when someone is sent to "rehab".

Or he was wealthy man willing to pay whatever he was ordered in order to not lose his job. No one can read his mind to assess how committed he was to his own recovery.

Depression is treated in psychiatric facilities AND in "rehab." Why is it that you think people drink ?? The vast majority are depressed. It is a form of self-medication. If you've been "sending people to rehab since 1988," you should know this. If you don't know this ..... I pray that you will wake up and realize the cause of most addictions. You will be able to help a lot more people if you understand the cause.

As someone who has firsthand knowledge of judicial review, I can tell you that state's DO do a good job of policing their own. The Bar does not deal with innuendos and frivolous complaints brought about by dissatisfied defendants or plaintiffs.There has to be a body of evidence before they consider disbarment. Obviously, there was no body of evidence against Judge Fairly.

Second, which "rehab" have you been involved with? If you are so closely connected to the 'rehab industry" since 1988, why are you making fun of people who have to go there? You sound like a real asset to the recovery and/or mental health community. Having been clinical director of Jackson Recovery Center, head of the dual diagnosis unit at both Charter Hospital and Brentwood, past director of a half way house for women called New Life, worked with first and second offenders from Jackson City courts, and currently a partner in three "rehab" programs, I'll use my credentials to verify that I know what i'm saying. You don't even seem to know the current role of what you are referring to as 'rehab centers.'With the possible exception of the skid row type facilities, most modern centers specialize in dual-diagnosis patients. They have discovered in the past 30 years that depression needs to be treated before sobriety is possible. In the 1970s and 1980's the AA community taught that sobriety would naturally lead to good mental health, even for bi-polar or chronically depressed patients. I noticed that you didn't dispute my argument about insurance companies paying big bucks. Try to get admitted with just a BCBS card and see how far you get. When i stated that his out-of-pocket costs proved his commitment, you instead chose to change the subject to 'mind reading.' Seriously, you have repeatedly told what you thought was in his mind but now flip-flopped. And finally, the one argument that you might be willing to gain some traction and you chose a character attack and another change of subject. Interesting. My thoughts are not opinion or conjecture. Judicial Reviews are not prompted by angry defendants. There is one person IN EVERY JUDICIAL CASE that leaves angry. News paper stories by Kate Royals don't prompt Judicial Reviews, either. As for the answer to your disbarment question, there are hundreds who have been disbarred. were you expecting them to notify you? That information is relatively easy to find, by the way.

Larry Butts: Group insurance programs pay for rehab. Surely you know that rehab centers won't even give you a handshake before they are on the phone verifying the limits of your coverage. Then they note your 'graduation date' at a point in the future to coincide exactly with the expiration of your coverage. Miraculously, the patient receives a diploma commensurate almost exactly on the 'limit of coverage' date.

The good judge did not have to put up the farm and ridin' cultivator as collateral for his mandated rehab. Your off-hand assumption that since rehab costs so much he must have been serious about it is awkward, if not absurd.

Your appeal to authority (by listing your credentials) falls flat as support for your several statements in your posts.

I'm sure more than a few of us are wondering why you're such an angry man (as evidenced in your posts). And I learned a long time ago that a man who enters into a discertation proclaiming his credentials and wisdom, as you have done, is not to be paid much attention.

Rehab centers expect and demand payment up front -- not after the fact in the very rare instance where they are partially reimbursed for the service by insurance.

YOUR offhand assumption that Judge Fairly was not serious is absurd. You do not know what was in his mind any more than anyone else. The assumption is that someone is willing to pay a lot of money for an outcome, so thus, by definition, they must WANT the outcome, is a totally valid point. Again, YOUR assumption is awkward and absurd.

Why such an "angry man?" ????? Perhaps he knows the Truth. The Truth in this matter will make all sane and sensible people angry.

He lists his credentials because his authority was questioned. Please note that until then, no credentials were mentioned nor listed.

I, personally, question YOUR interest in this and your credentials for your statements. Please state your interest and list your credentials. Otherwise, clam up.

My credentials and my name are only to demonstrate to the "anonymous" rumor mongers that I'm willing to debate any topic you're willing to debate if you have a name or a credential. Having managed and owned several treatment/rehab centers, i don't believe you have the believability to dispute my facts not my opinions. I know what i'm talking about. You act like you do. As for my anger, i'm only angry at those psychopaths who are crude and heartless enough to make up lies about a man whose death is still under investigation. All who knew Dan personally, loved and respected him. And please, don't try to lecture me about how insurance works and what they pay for. I'm in the treatment business. I KNOW how it works. I'm trying to find an inpatient center for a client as we speak. She has great insurance. Her primary diagnosis is substance abuse. No one will accept her unless she has underlying psych diagnosis. If you're so smart, let me get a release signed and YOU find a place for her. But I don't think "Anonymous" is a legal term to use on a release of records, do you? Your poor understanding of human motivation is appalling. You say MY assumption that if someone puts up $50,000 for treatment, that doesn't prove he's motivated is laughable. Seriously laughable. You refer to that belief as "awkward and absurd." Check your dictionary to see the definition of those two words and then get back to me about what you intended to say, since you statement made no sense to anybody.

Mourn the deceased. This is very sad. Maybe he was a great guy or maybe he was a jerk. Everyone has or has a family member with an addiction of some kind. Sometimes it hurts families and sometimes they hurt themselves. Please pray for his family. Death of a family member is a very difficult situation. And, until "you" to experience it, you will never be humbled.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
