Rights violated? We report, you decide.

Open carry zealot in Houston walks around wearing a kilt and an AR-15 slung on his hip.  He refuses to give his name or ID when asked by a cop and of course is carrying a video camera.  Just watch the video.

There is no reason to stop/harass anyone engaged in what is clearly legal activity...even if "someone does call in about it".

Carrying guns in open is perfectly legal in Texas. And just because it may make some people "uncomfortable" does not make this guy a zealot/off base.

Sorry folks I am pro gun have been all my life and the AR-15 is one of my favorite weapons---that being said I have to ask what kind of ignorant prick in kilts would walk around with a weapon and no ID and refuse to say who he is---he could have been a terrorist---Cop showed incredible restraint probably should have tazed the dumb bastard to wake up whatever brain cells he had that were still living---Good job cop!!

Lets start with law enforcement 101. What was the reasonable suspicion or probable cause for the police man to interact with the citizen. Did the officer say I recognize you as a felon I arrested last year? I think there is reasonable suspicion that you should not be in possession of that fire arm! No he did not. The "creep" went through a Federal background check before he was allowed to purchase the weapon and obtain a open-carry permit. You left out part of the process. The cop would have known he most likely was not a felon if he was carrying the weapon openly.

It is not the police department's business, responsibility or obligation to determine whether people are legally in possession of a firearm unless a crime has been committed.

The police have no right to detain, search or require ID of someone simply to find out who they are or to run a rabbit trail of determining right to be in possession of a firearm.

Here are the wrong reasons to detain:

1) I think I'll ask for his ID just so I can look at it.

2) For all I know he might be a felon.

3) For all I know he might be a jihadist.

4) He looks goofy as hell in a kilt.

5) He could be loony for all I know so I'm going to harass him to see if he goes ape shit on me.

6) A lot of people don't like guns that look like this one.

7) He doesn't look or dress like most people.

8) He might not be from 'round here.

9) Dressed like that, he could be queer for all I know.

Some of you (8:55 for example) who are assigning the status of right wing nuts or idiot, bear watching. That you don't like the law is irrelevant.

As long as we are allowed to openly carry, you might just have to like it or lump it. The open carry statute doesn't just apply to rednecks in cammo with four wheelers tied in the back of a pickup. It also applies to the fellow in a kilt who carries no idea.

Don't like that? Take it up with your legislator. Although we are allowed to open-carry in this state, there is not yet any requirement that we dress a certain way and carry ID in order to exercise that right. And there is no requirement in this state (since we are no longer in the sixties) that we answer questions posed by a policeman when there is no reason for the stop or detention. Nor are we required to carry ID. Again; Don't like that? Get it changed, Harpie.

I am a life member of NRA, staunch advocate of the 2nd Amendment, avid gun collector, owner of several AR style guns and have published articles against gun control. And this guy is a pure nut job. MINDLESS SHEEP! In America the constitution gave powers to the federal gov. In the states their constitution gave rights to to state and local gov. Amendment X of the bill of rights says" The powers not delegated to the US by the constitution, nor prohibited by it to the states are reserved to the states respectively, or to the people." That means ALL things are legal. now,since all things shouldn't be legal ,we the people have given the gov. The authority to take away some of those rights (our represenitives) . These are called laws. Laws take away our rights, The gov has been taking away our right for 230 odd years.
Now!! The open carry law gave us back (WOW) our right to amendment II of the "Bill of Rights".
This a--hole as some of you called him tested said law! ( I think he had balls) as I don't have the funds to lose this test.
The cop did not know the law even though said cop was (my opinion) pretty reasonable and kilt guy seemed to be uncooperative (a--hole).
Just remember ( anything you say can and will be used against you in a court of law. Also the Supreme Court says the police can lie to you.
So the law says you can walk the street with a AR-15 on your hip in Texas!
Whether your skin is Lilly white or charcoal black.
All this blathering you people are doing is irrelevant .

And, for the government expert: My legislator is influenced by special interests, who contributes to his campaign, and what he needs to do to get re-elected. Influencing the electorate is part of the process as well. I guess you never heard of lobbyists.

Just because lobbyist are successful ( and the NRA leadership is living high on the hog by successfully making you feel threatened) , doesn't mean the tie can't turn or a backlash won't eventually occur.

As we have more examples of those who have undergone psychiatric treatment committing murder or our homegrown terrorists start shooting up Dodge City, the tide may well indeed turn!

And, federal law trumps State laws when the State start risking our national security.

My guess is that behind whatever cover he's had constructed for him (NRA, Tea Party, whatever...), "Bagpipes" is a PLANT, from some entity which concerns itself with disarming the American populace. Bagpipes did a good job toward that end, too.

In any event, since the courts have established that it's fine & dandy to aim cameras up little girls' dresses at Target ("No reasonable expectation of privacy"), this old Cougar demands EQUAL COVERAGE. Why didn't someone aim a camera up Bagpipe Boy's kilt? I'd like to see what he's packin'. Strutting around on the sidewalk like that, he has "no reasonable expectation of privacy".

Bet many of you supporting the kilt guy took a much different stance on producing an ID when it came to Arizona's law "targeted" at illegals. When it's someone else being ask for ID, the general consensus is "just pull your damn driver's license out" or "how does anyone not have ID on them these days". Let a self-proclaimed Constitutionalist be stopped by a cop tho and it's a different story. The same crowd overwhelmingly supported voter ID laws, yet it's too much of an inconveniece to produce that same ID while wielding an AR?

PS...I own an AR along with many other guns and have my CPP. I also have a deep respect for law enforcement and realize that they are living on a razor thin edge. Cops' guards have to be up and it's damn near humanly impossible to be pleasant while dealing with the stress and unknowns of situations they face daily. Don't be that jerk that correlates producing an ID to a cavity search or producing Nazi issued geneology papers to the SS.

Been around many Kilt Boy types at local shooting ranges. They are the first to call out someone for leaving a chamber closed, not wearing safety glasses or some other minor technicallity. Mind you, they are calling out an adult acquaintance that cleared the membership requirements or has legally purchased an extra permit from the state after qualifying for the normal hunting license. Same guy thinks open carrying a hog leg .44 at Chuck-e-Cheese is a Constitutional right, tho.

You can check with the NRA as I once did on open carry. Although legal in this state, or else where in open carry states, you could be considered a public nuisance by the police.

When a cop asks you for ID you'd best produce it.

They can buy weapons with impunity even when the FBI or Homeland Security is watching them. In Mississippi, our legislature has made it impossible for federal agents to take weapons away from home grown terrorists until they engage in terror. Arms dealers have found a safe haven for moving weapons here.

To the obviously young or forgetful posters in this thread:

Twenty years ago, one could walk around in the open with a long gun (rifle, shotgun, etc) and no one would pay attention. It wasn't a big deal because it was commonplace in the rural areas.

Teachers would take their long guns from their vehicle and bring them into the classroom. High school kids would have rifles much more lethal than the one in the video hanging in gun racks in the back window of their pickups. Those people were simply returning to school after hunting the morning before.

But..... during this same time one's right to carry a handgun concealed was removed. The right to have loaded weapons in one's car for defense was constantly challenged. In fact, up until 10 years or so ago, the "gun grabbers" would infer that only "sporting guns" were necessary for the private citizen. That no one needs a "military" weapon to hunt.

Police officers were also able to articulate their thoughts about why they detain and/or arrest someone. In other words, they would "profile" and individual and the person acting "strange" with a rifle strapped to his shoulder vs the average joe just walking from his car to his office are 2 different individuals.... the weapons didn't change the perception.

Now, as quite evident with posters to this article, people are conditioned to label someone carrying a rifle as a "zealot", "off-base", "nuts", etc. Actually this is simply the removal of critical thinking from our society as a whole. Reasoning is no longer common, and society operates, as a whole, as whether the peg fits the hole.

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Trollfest '07

Jackson Jambalaya is the home of Trollfest '07. Catch this great event which promises to leave NE Jackson & Fondren in flames. Sonjay Poontang and his band headline the night with a special steel cage, no time limit "loser must leave town" bout between Alan Lange and "Big Cat"Donna Ladd following afterwards. Kamikaze will perform his new song F*** Bush, he's still a _____. Did I mention there was no referee? Dr. Heddy Matthias and Lori Gregory will face off in the undercard dueling with dangling participles and other um, devices. Robbie Bell will perform Her two latest songs: My Best Friends are in the Media and Mama's, Don't Let Your Babies Grow up to be George Bell. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
