Where Does He Live?

Where does David Archie live? That t'is the question as a Judge tries to figure out if the Hinds County District 2 Supervisor-Elect will indeed remain the Supervisor-Elect.  Archie beat incumbent Darrell McQuirter in a runoff election on August 27 by 125 votes.  However,  McQuirter challenged his election, arguing his opponent lives in District 1 and thus is disqualified from running for Supervisor in District 2.

McQuirter filed a challenge with the Hinds County Democratic Executive Committee.  The Committee rejected the challenge.  He sued Archie in Hinds County Circuit Court.  A hearing was held Monday and Tuesday.

Archie claims he lives at 3426 Shady Oaks Street in Jackson in District 2.  However, Mr. Archie currently resides at 5852 Clubview Drive in District 1.  Mr. McQuirter argued the Clubview residency disqualifies Archie from representing District 2 for several reasons:

* Archie moved his voter registration from 1402 Collier in Jackson to the Clubview address in 2007.  He moved the voter registration again to the Shady Oaks address in 2010.
* The USPO returned a jury summons  for "insufficient address unable to forward."
* Election Commission received a confirmation card that was undeliverable to the Shady Oaks address.
* The Shady Oaks house was unoccupied during the election.
* The Shady Oaks home had no water service from December 2017 to August 26, 2019, the day of the election.  The would-be supervisor owed $1,240 on his water bill.
* Entergy electric meter was removed and the cover of the box was missing.  Atmos gas meter was removed.
*  Building permit tag suddenly appeared on the property on September 6, 2019.
* Archies sued their insurance carrier for denial of coverage of a claim involving their swimming pool at the Clubview property.  The pro se lawsuit states they live at 5852 Clubview Drive.
* His wife owns two Mercedes and a Honda Accord registered at the Clubview address.  Mr. ARchie owns a 2011 Tundra truck registered at the same address although he owns a 2003 Silverado truck registered at Shady Oaks.
* The Archies have a  LLC, HZ Investments, that is registered to the Clubview address since 2014.
* The Archies filed a pro se lawsuit against Travelers Insurance in July that stated they live at 5852 Clubview Drive.

JJ reported in 2017 that JPD arrested Mr. Archie for domestic violence.  The police report stated the Archies lived at the Clubview address.   Earlier post and copy of police report.

Hinds County property records state the Clubview home has an assessed value of $121,000 and has homestead exemption.  The Shady Oaks house has an assessed value of $16,000.

It must be noted that Mr. Archie's driver's license cites the Shady Oaks address as his home.

Mr. Archie replied in court he was renovating the Shady Oaks house and intended to move back into it.  His answer submitted to the court states that he used the Shady Oaks address to qualify to fun for office no less than five times.  He said "his wife owns property at 5852 Clubview Drive."  However, the county landrolls state the property is owned jointly by both Archies.  He said he is not on the insurance or mortgage for the home.

Mr. Archie said he didn't have enough information to know if the Shady Oaks home had an gas or electric meter box.  He accused anyone of inspecting the boxes of committing criminal trespass.

Attorneys Rayford Chambers and Dennis Sweet represent Mr. Archie.  The case was assigned to Special Circuit Judge Lamar Richard.

Kingfish note: Does this home look inhabited? Judge for yourself.  This is the Shady Oaks home.  The Kingfish had a professional photographer pass by the home ON THE PUBLIC STREET and take these pictures the day after the election and a day later.

However, once the rumblings about an election challenge hit the street, the house was suddenly cleaned up.

Hmm.... perhaps McQuirter should have subpoenaed the kids' school records.   It would have been interesting to see what the registered address would be on those records.

if my fellow R Clinton dwellers would have voted in the Democratic primary like I did, this wouldn’t even be in court. but i guess they wanted to make sure a good ole boy like Tater didn’t get beat by that liberal waller fellow...

Throw his ass out. Since Nissan he feels like the Archie's can do whatever they want.

Shocked that nowhere in Archie's response did he refer to McQuirter or anybody else as a 'low down dirty dog'.

Waller's candidacy was a fraud. It will all come out after the election.

Didn’t some Canton alderman do time for similar BS?

Trap house.

Most people would back down from a sham after the matter is appealed to an actual Court of Law and perjury becomes a possibility. Not Archie. There's no shame in his game... Beware Hinds County.

Yep, grill on front porch. It's occupied.

No popcorn shown in photos, but I got mine!

12:57 - Waller ran for statewide elective office. Are you suggesting he's not a resident of Mississippi?

Anonymous said...

A qualified elector of the county and a resident in the district in which he/she seeks election. Miss.
Code Ann. §19-3-3; Miss. Const. of 1890, Art. XII, §250.

It would seem the issue is where he currently resides. The fact he owns the home,or what he did in the past really isn't germane to the case. By his own admission, he did not currently reside in District 2 on August 26.

His attorneys aren't doing him any favors either, because a spectacular case for voter fraud, tax evasion, and perjury is forming. Even in the filings they continue to state that he currently resides at the District 2 address.

Not too bright...

P.S. If someone really wanted to troll this dude, they could refer the home to the code enforcement office, and the living conditions to the health department.

Grab a chair and watch this dumpster burn!

If David Archie is a bachelor, this could very well be his primary address. Kinda looks like my apartment after a long week at work.

It is amazing to me that a candidate for a public trust would perpetuate a provable fraud of where one resides. One resides where one receives homestead exemption with the key word being "homestead".

Anonymous said...

What is it going to cost him in taxes now that he is going to lose homestead exemption on the more expensive house. He should of course lose it immediately since he is under oath saying he does not live there.

So Archie says he was renovating the Shady Oaks house and intended on moving back into it ? But yet it's had no water or electricity for almost 2 years. Man, those renovations, on a house with less than 1200 sq ft, sure are taking a long time. Maybe because it's hard to renovate a house when you have no electricity in it.
Oh, I'm sure he planned on leaving a much bigger and nicer house, with a gated driveway and a pool, in a nice neighborhood next to a former country club, so he can quickly get back into a much smaller house with no gate, no pool, and no country club in one of the worst and most dangerous parts of Jackson. If that's true, we don't need such a stupid person in office.

I don't think that breaker box is up to code.

I like what they have done with the landscaping with that natural look.

Sam Begley uses and loses this sham argument every time someone gets elected who won’t grease his tiny palms.

Just Sayin' said...

He could live there. It would fit right in with the culture and the neighborhood.

who needs power when you gots cordless tools said...

Here do all these doubters come from?

Cordless tools let u git-r-dun even when the meter has been pulled.

Takeout means you can eat before the granite countertops and professional quality appliances have been installed.

Cooler with some ice means it can be beer-o-clock anytime even though the refrigerator hasn't been delivered yet.

Garbage bag in a empty mud bucket means you got a working bathroom when you need to drop a deuce and Big John's or Churches are closed.

Yall already seen the grill installed on the front porch.

If there was some way to require that he and his wife have to actually live in that house for his entire term, this whole matter would be moot. The hustle only goes so far.

Anonymous said...

Me Archie, is JUST ...the person that Hinds County Deserves !

Anonymous said...

Not too long ago a candidate for Mayor of Biloxi pulled this same stunt. Clearly living out of the City then swearing up and down he lived in district. He lost of course and still can't figure out why.

Think a similar situation happened to the ex mayor of Gulfport. IIRC the feds got involved.

If a politician or candidate will lie about where they live to get elected you can expect much worse if they actually do.

But no one on this page is the judge. Let the court decide. Right? Isn’t this a democratic society? Dont forget. Opinions are like a$$ holes. Everybody has one but they don’t mean s$it!!

Sam Begley uses and loses this sham argument ...

Tell that to Jim Evans.

There is now LAW that say a person must have water or lights. The law states that TAXES MUST BE PAID. People have the freedom to live how ever they want too..

Anonymous said...

So who revokes his homestead exemption?

Anonymous said...

@1:55 - The dang Germans got nothing to do with this. - Buford T Justus

Anonymous said...

8:05 - Nobody. The county office simply will not let you claim two under the same title name. Maybe the guy at 10:30 who has practiced criminal law for 31 years can opine with another appeal to authority.

Anonymous said...

I see @7:19 Mr. Archie reads JJ.

Let’s play “Where do Ed & Barbara Blackmon Live”..... They damn sure don’t live where they report their residence to the Secretary of States office. But the Secretary of State is scared of the Blackmons, so rules don’t apply to them.

Anonymous said...

Yeah, that where he stays.

Anonymous said...

I actually thought Robert Graham was working to become a legit representative. Stupid me.

What grasping wretched people make up the people who run for office in Hinds County. You would think Archie would be shamed and embarrassed by being caught in this farce and withdraw, but no, there is opportunism to be practiced. This is just a metro hot for the entire state.

Anonymous said...

Go McQuirter! I am praying you win this case. No county in any state deserves to be represented by Archie. The man is not sane enough to serve. He is "Certifiable" even tho' the Dem's committee certified him!

Anonymous said...

David Archie has no shame. His wife that he beats was actually defending him. What a whack job she is. He's embarrassment to society

A district that elected Archie, especially considering that many knew he didn't even live in the district, deserves him.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

This is definitely a Beaver production.
