Today has been a busy day in the Ridgway Lane embezzlement scandal. The Bridgewaters appeared in court today while the Palisades and the Diplomat sued Ridgeway Lane, David W. Lane, and David L. Lane for embezzling hundreds of thousands of dollars from their bank accounts. Ridgway Lane managed homeowners associations in the Jackson metro area .
Judge Extends Freeze and TRO
A quartet of attorneys appeared before Circuit Judge John Emfinger today in Rankin County Circuit Court.* Judge Emfinger extended a temporary restraining order against Ridgway Lane, David W. Lane, and David L. Lane. The order freezes the assets of all defendants.
The Bridgewater lawyers protested to Judge Emfinger that David W. Lane quitclaimed his Deerfield home to Bethany Lane in violation of the TRO. The house is listed for sale. He asked the court to delist the home. "I don't want Mr. Lane to have any funds in his possession," said Mr. Lidell. He said the Lanes have not provided a list of their assets and that failure to do so violated the TRO as well. The attorney argued the Lanes could sell the home below market value and cheat the alleged victims out of their rightful recovery.
Mr. Malouf tried to argue that his client never received proper notice for the TRO but Judge Emfinger said Mr. Lane called his office yesterday so he knew of the order. Mr. Lane's lawyer disagreed with the plaintiffs. He said the freeze order prevented Lane from being able to take care of himself. He said keeps him from getting a job, paying bills, or even buying food.
The court rejected Mr. Malouf's arguments. However, it told the plaintiffs to file motions to show cause if deadlines were not met. Mr. Malouf's cited the Fifth Amendment in arguing his client shouldn't have to turn over documents. However, Judge Emfinger ordered him to provide the requested documents and specify which ones qualify for Fifth Amendment protection.
A full hearing on the TRO and a preliminary injunction will be held on December 12.

David W. Lane quitclaimed his Deerfield home to Bethany Lane on November 12, the same day Judge Emfinger froze his assets.
The Diplomat
The Diplomat Condominium Association sued the Ridgway Lane, Papa Lane, Baby Lane, and some John Does in Rankin County Circuit Court today.
Ridgway Lane managed the association since 2005. Unfortunately, The Diplomat gave the company the authority to establish and "maintain" a bank account. The complaint alleges the Lanes stole "tens of thousands of dollars." Over $28,000 was missing from the reserve account. The Lanes allegedly provided false reports as well.
The lawsuit charges the defendants with breach of contract, negligence, fraud, unjust enrichment, and breach of fiduciary duty. The complaint also makes a claim against the fidelity bond of Ridgway Lane.
Attorneys Michael Akers and Stephen Edwards represent the plaintiffs.
The Palisades
The Palisades homeowners association finally sued the Lanes today in Rankin County Circuit Court today. The case is assigned to Circuit Judge Steve Ratcliff. The plaintiffs sing a song that is familiar by now. Ridgway Lane managed the bank accounts for the HOA. Ridgway Lane allegedly provided false reports to the board.
PHA discovered the alleged embezzlement in October. The plaintiffs discovered the Lanes transferred PHA funds to other Ridgway Lane accounts without approval. The transfers were $155,020 but the net loss was $87,000.
The lawsuit charges the Lanes with breach of contract, fraud, breach of fiduciary duty, negligence, and unjust enrichment. Attorney Roy Liddell represents PHA.

Any word on status of criminal investigations? Our HOA advised us the Rankin DA became involved a week ago.
The older David Lane also owns a Condo in Chicago he just bought a few years ago (his wife is from Chicago) and he owns a place in Oxford also (most likely all in his wife's name).

You are correct. I have absolutely no experience with the extreme panic that sets in after it has been exposed that I was involved in embezzling millions of dollars of others people's money to which I had no legal right to steal. I don't know in the least what it is like to go through that.

I don't know either of the David Lanes. But I have known Bethany for years. She has never been anything but an honest, kind hearted, lady. She worked in the dementia unit at St Catherine's for years taking care of the elderly. She took phone calls from concerned family members on nights and weekends. She went above and beyond to help our family through a difficult time. David has to face what's coming to him. But my heart breaks for Bethany.
My hat is off to KF on this one. Takes a lot of time and effort to gather all of this and share it.
Why aren't the 5:28's of the world mad at WLBT, WJTV, WAPT and that liberal rag that calls itself a daily "newspaper?" Oh yea, they get their stories from Kingfish's page. If any of them had broken the story would 5:28 be pissed off at them? I doubt it.
Likewise, I had no idea what Commissioner Epps and his wife were going through after it was revealed that he was involved in a deep, criminal enterprise of his own design. I should have backed off in my judgment, not assumed guilt and sat back and enjoyed my popcorn as it played out over the course of five years. And Jesus would have had me pray for the Epps couple because even good people can be led astray and make poor choices. Plus Mrs Epps is a very good woman and has been a pillar of her neighborhood for awhile.
Disclaimer here: I am a plaintiff (member of Diplomat Condo Assn). It appears someone has stolen from me, and naturally, I do not appreciate it. Further, I am not especially sympathetic to the feelings of the thieves, if this is what Lane and his ilk are. I, for one, appreciate the updates, KF. May the wheels of justice turn . . . .

I would remind everyone that many wives are completely ignorant about their husband's business dealings. That is especially true of those who were married before "women's lib" took root.
I would also point out that a few decades ago, less than 4% of females in Mississippi had even 1 year of college so understanding of finance was not going to happen unless a woman became self-educated.
I have many widowed friends who'd never balanced a checkbook and trusted their husbands completely when asked to sign documents. This was a disservice rather than a kindness and for some, a disaster.
I have no idea "What Bethany knew or when did she know it?" and I doubt those commenting do either.
Obviously if David lane was involved he needs to pay the price but I always feel sorry for the persons family. I have known several people whose parent has embezzled monies and how it devastates the whole family. People will be mean and rude to the Lane extended family. They will find invites dropping off and people avoiding the like the have a disease. Usually most of the family knew nothing about the crime. This is something else the crook didn’t don’t consider or care about when committing the crime.

Experience covering this stuff over the years is the families usually don't know what is going on. Think about it. A wife may see everything in her husbands checking account but unless she is the business manager for his business, she probably doesn't see the inner workings of what he does for a living. For example, the wife in the Evans Brothers case had no idea. The day he got sued by MVT, he walked out on his family, while cleaning out their accounts of course. They never saw him until he was sentenced and that was because they came to court. Thankfully the wife was once a nurse so she could fend for herself. That's just one example. Too often the families are left destitute. Little money, no home, and must find a way to take care of themselves.
I agree that it sucks for the families, but that’s not the public’s fault. Their loved one’s created their situations. I’m sure the Mrs. both have people they can turn to for support. The hubby thieves trying to give them assets after the fact is neither valiant nor just. It’s illegal and wrong. It’s not the public’s fault they may have to reduce their standard of living. That’s what us regular folks have to do when times are tough.
Speaking of not knowing anything... I wish I knew more about Ridgway. Why did they part ways? Why did he remain within the partnership legally? Just a couple of months ago, his status changed from member to manager (sounds more involved to me)... why? Did he know something was amiss before he left? Did he leave and not cut the cord out of loyalty to Lane, Sr.? IF he knew ANYTHING, he should be held equally accountable. I’m curious to see how far back missing funds can be proved and how that fits timeline of Ridgway’s departure.
I don't buy the notion that 'the wives' don't know what's up. They may not know of be involved in the inner workings of the crime, but, at best, they're enablers.
I may not know where my daughter gets the weed or how much she spends on it, but if I do her laundry and see all the stems and seeds in her pockets and watch her coming home stoned every night, I'm enabling the behavior.

The fact that he tried to quitclaim his property the day of the TRO shows there is no remorse. He's admitted he stole, and he's trying to keep it. WHY IS THIS PERSON NOT IN JAIL?
