EEOC Employee Sues EEOC for Discrimination.

An EEOC investigator accused the Director of Personnel Management for the city of Jackson  of improperly dismissing EEOC complaints against the city when she was the local EEOC Director so as to help the current Jackson Mayor. Antonio Jones the EEOC in U.S. District Court on June 26 for retaliation and violating his rights under the Americans with Disabilities Act.

Mr. Jones is a Senior Investigator at the Jackson office of the EEOC.  He accused two EEOC Directors, Delnar Thomas and Wilma Scott of illegally closing cases to help "certain employers" and said it "reflected receiving kickbacks."  The complaint charged Ms. Scott of tossing cases against the city of Jackson and JPD before they were investigated because she was friends with the Mayor.

Ms. Scott is now the Director of Personnel Management for the City of Jackson.  The city's website states:

The plaintiff charges Ms. Scott worked for the city "during the same working hours she was working" for the EEOC.  Apparently a good ole girl network exists at the Jackson EEOC because Mr. Jones said that all of the black women who worked in that office were members of the same sorority in college, Alpha Kappa Alpha.

Mr. Jones filed a complaint against Ms. Scott but alleged her boss, Ms. Thomas retaliated against him.   The complaint makes several colorful allegations:

14. Ms. Thomas paid a visit to Plaintiff after Plaintiff had returned home from the hospital after having colon and abdominal surgery, along with chemotherapy treatment.

15. During this visit, Ms. Thomas attempted to intimidate Plaintiff into revoking a complaint that Plaintiff made regarding Ms. Scott for illegally closing a case. Plaintiff felt threatened. To Plaintiff, it was like being in a government/gangster-mob movie when a person knows of a crime and the government comes to their home and warns them not tell the authorities what they saw or they would be killed. In Plaintiffs situation, it would be termination. Plaintiff refused to drop the complaint against Ms. Scott....
Mr. Jones claimed he was the "highest performer" in the Jackson office.  He accused the defendants of trying to get him to sign a false disciplinary action against him.  They allegedly retaliated by denying him his reasonable accommodations for his disabilities.  Mr. Jones says he sustained those disabilities due to his participation as a soldier who saw duty in Operation Iraqi Freedom and Enduring Freedom  He was placed on administrative leave.

The EEOC did not investigate his complaint so Mr. Jones filed his lawsuit.  He is represented by attorney Nick Norris.  The plaintiff, as well as the defendants, are black.  The case is assigned to U.S. District Judge Henry Wingate and Magistrate Linda Anderson.

The complaint charges the EEOC with violating the ADA by failing to make reasonable accommodations for Mr. Jones as well as retaliation.   He asked for reinstatement, back pay, compensatory damages, and punitive damages.

"Alpha", not Alfa

Equal employment... what a joke!!! There is nothing equal about employment. Purely reverse discrimination... white males and Asians are widely discriminated against. Look at Harvard recently on medical school... making it harder for Asian student to get accepted. Meanwhile lowering black students thresh hold. I find this racist as they obviously believe blacks can't do as well. It's total insanity and just not right.

@11:24

I am certain that KF knew what he was doing when he typed "Alfa" instead of "Alpha."

Alfa made me LOL. Thanks for the laugh

Assigned to Judge Wingate. Hope the Plaintiff isn't in a hurry.

I merely copied the complaint. See #13. It spelled "Alpha" as "Alfa".

@11:44 In 2017, Harvard Medical School admitted 235 medical students comprised of the following:
156 - Caucasians
56 - Asian Americans
33 - African Americans, Hispanic, Mexican American, and Native Americans

I was there in 2009... Asian students are accepted at a higher percentage than any other race. This has caused current policy to be reviewed and changes to be made. Personally I believe there should be absolutely no quota. If it's 75% black students so be it... if all students are required to have same qualifications then there is no problem. All men and women will be equal only then as MLK spoke about.

The discrimination claims at Harvard regarding Asians center on the undergraduate admissions policy, not the medical school.

Plaintiff isn't really showing that the accommodations proposed by Mr. Yelder were reasonable. It'll be interesting to see exactly what those looked like.

I have dealt with him in representing clients facing EEOC charges. He always seemed a decent and reasonable guy.

Anonymous said...

Don't know if he'll have any luck on the EEOC charge. I understand it's extremely difficult to make a successful claim when you're represented by a union.

But I really hope that someone looks into the allegations raised about Wilma Jones-Scott.

You know they're running out of people to sue when they start suing each other.

NEXT!!!

Having met and dealt with this woman, I find these allegations completely believable. That doesn't mean its a winning case.

Anonymous said...

What he said about his coworkers who are sorority sisters is 100% believable.

Anonymous said...

Quite true @7:55 AM....I find it 100% believable as well. There are hardly any vehicles cruising "Pothole City" that is not sporting one of those "sorority" id's. I came to the conclusion that it must be the largest "sorority" in the universe.

Free entertainment provided by the City of Jackson and employees. Get some popcorn and soft drink. This is going to be fun to watch.

What evidence exists that the plaintiff asked for reasonable accommodation and what accommodation was sought? If they don't have that they're pissing in the wind. The rest is bullshit.

To the grammarians out there: please correct me if I am wrong.
Would someone please tell those responsible for writing the City of Jackson web site that one does not use capitalization to create emphasis. To wit:

"Recruitment and Selection, Compensation and Benefits, Training and Development, and Employee Relations." How about: recruitment, selection, compensation, benefits, training, development, and employee relations?"

Thank you.

1:05 - Not sure what you're referencing, but if those are the names of departments or units within a department, it is appropriate to capitalize the words. Otherwise, relax, you're correct.

I hope this guy gets all that was taken from him and denied! This is wrong especially from an agency put in place to help people who suffer from the same exact thing he is being subjected to! Wow! This shows some secret discrimination they are doing which they suppose to be fighting against. This is bad. I hope His lawyer tear them up. I hope the Attorney General get them. I hope Donald Trump get them too.

That's why they cannot handle public cases fairly because they are too busy doing their own employees the same way we are being treated on our jobs. Wow! The EEOC IS A FLUKE! And this is no way to treat our Veterans! Just sorry!

Wow! These people in the Government keep doing their own employees like this and hide the evidence to get away. This guy is creditable because EEOC are know liars to benefit themselves. Maybe they didn’t investigate was because they knew the guy filing the charge had validity to his allegations and probably so much physical evidence and they just hid the case and didn’t do anything for that poor man. Instead of investigation this man’s allegation, it appears they retaliate against him and tried to make him quit! That’s sad. This is what I get from the lawsuit. Isn’t EEOC the agency who suppose to fight for accommodations and reasonable accommodations according to the ADA?
This is a sad situation. How can they enforce laws they are breaking, but getting away with it. I wish other companies who EEOC have sued according to the ADA, go back and reopen their cases and sue the EEOC for doing this guy like this! Sad! Fight for our Vets!

I am a JPD Officer. I knew when I saw this lady being hired with the city of Jackson, my intuition made me feel like this was the reason me and my colleagues cases didn’t go anywhere when we filed our cases with the EEOC. I am showing my lawyer this. I knew she was crooked! Our previous attorney was an AKA too. It is all falling together.

Anonymous said...

I am sickened! I hope this guy has a good lawyer to tear them up! They never did any investigation on my case either! I “CAN” now believe they did this to their own employee. That’s why they couldn’t see the wrong in my case because they have done this guy the same way my job did me! Monkey see, monkey do!

Anonymous said...

Wow! He (Jones) was the investigator in my case and basically never did a damn thing on mine! Seems like he’s getting the treatment that he gave others. Revenge is a DISH BEST served cold. TOOT! TOOT! ALL ABOARD! The KARMA train is coming into the station! Better have YO Facts straight BRO cuz Wingate is yo JUDGE! Lmao!! Every dog has his day!!! Ain’t dat right DAWG! And good luck with NICK NORRIS! Maybe all of the cases you investigated need to be re-opened cuz you sho ain’t no beta than Wilma Scott! Your intimidating messages of how you were a FEDERAL INVESTIGATOR! Ha! Get yo investigation on now! Bro!

Everyone has their opinion. Jones did a great job in my case and he comes highly recommended. He is one of the best. If he couldn't find any loop hold in your case, then maybe the evidence wasn't there. He is a great guy. That doesn't mean be can win every case for everyone. Even the best lawyers don't. But, according to this lawsuit, he is being treated worse than us in the regular working world, because he complained. And by the sound of your writing, you appear to be mean and wanted your case to go your way, and when it didn't, you got mad at the system. Jones, maybe God is showing you exactly how we are being treated out here, and He is using you to take what is happening to us, and for you to be strong, and prove to the world, bullies can be beat. Thank you for all you did for me and the others in my sexual harassment case. Stay strong Joneas.

I hate this happened to this Investigator. If it’s the light skinned brother that I’m thinking of, he is a great Investigator. It clearly shows he has disabilities. He walks on a walker everyday thru the federal building and sometimes struggle to get in his truck.. Didn’t know he was going thru this. He always has a smile. People are always asking for him to take their cases. I can’t believe this. People said that lady was dirty. I wish I could help!

This is unbelievable. I have known Mr. Jones over 20 years, indeed he’s the hardest working investigator within that Agency. I work in the Federal building and he is always cheerful, smiling and always have kind words for everybody unlike the two mentioned in the complaint. If the agency let those two perpetrators get away with this malfeasance, it would be the EEO‘s greatest failure. This Agency is suppose to protect the people from unfair employee practices but can’t protect their own employees from this gangster type mentality. THIS IS AWFUL AND I HATE THIS HAPPENED TO ANTONIO.

Can't believe this is happening on the federal level where people come to when they have been wronged. What's up with following the same rules. I know what it's like to be harassed and retaliated against by employers who has a great public image. You have no where to go and only can hope someone will listen and believe the public figures are human and sometimes allow themselves to go to a personal level on professional or work matters where they are boss. What happened to fair, and being beyond reproach, doing the right thing , integrity, and exemplary. This investigator is great in working a case thoroughlly, its beyond a shame that EEOC has treated him as they have. He is one of their own and it seems someone sold him out. He also has got to be one of their best because he has been and may still be the top in productivity. Had it not been for his dedication to his job, many people would not have their job, It's really sad when EEOC does not take care of one of our military veterans and one of their highest performers. This guy took ill and they jerked the rug and seems to try to kick him when he was a little down. What is ethical about this? Is treating people badly and making them hopeless and worthless after employers have done them wrong the price of people's friendship and sorority privilege.? We know what the principles of being sorors were founded on. It's a shame that EEOC Has this going on. Thanks Investigator for the dedication you have, I hope you have favor in getting accommodations and that you will not have to work ADA UNDER RETALIATION ANY LONGER. it's clear somebody is being mean and personal towards you.

I worked at the EEOC in the Birmingham District and as I got older I too developed a medical condition for which the EEOC refused to accommodate me and I gave up trying so I resigned. I was working with Kendra Duckworth who was the disability program manager at the time who unfortunately left the EEOC as well. Ms. Duckworth also had a disability and she was mistreated in the HR office. The EEOC is a small government agency and news gets around fast. She tried to help me while management tried to fire me for being ill. All I wanted to do was work. I feel sorry for the charging parties who are unsuccessful with their grievances and partly due to the EEOC's inability to train and keep a strong workforce.

This young man is very strong to be dealing with his ailments and still maintaining his work at an extremely high level as he did.
Mr. Jones doesn’t deserve this kind of treatment. Win Win Win!! You deserve it!!

EEOC is where the real discrimination occurs. The entire process is a joke. They are incompetent and the judges are in the pockets of the government agencies that break the law. My spouse was railroaded by a judge that accepted government motions that were lies without asking a single question. We had proof they were lying and he summarily dismissed the issue. Don't waste your time, go straight to court.

Just came here to ask a question, why is Wilma Scott posting on nextdoor with her neighborhood identified as Ashbrooke? Does she still work for the city of Jackson?

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

This is definitely a Beaver production.
