Carl Nicholson Indicted

A federal grand jury indicted major Hattiesburg player Carl Nicholson.   The eleven count indictment charges he helped an attorney loot a trust and also filed phony tax returns.  The actual alleged offenses are conspiracy to defraud the federal government, filling fraudulent tax returns, and helping others file bogus tax returns. The indictment is posted below.

I know Carl personally and these charges are bogus. He is a good Christian man that lives his life with honor and integrity. He would NEVER commit the crimes he has been accused of.

The Accountant that prepared the tax returns for attorney JL looks to be in a lot of trouble given Charles Bolton's accusations against Mr. Nicholson. This may be a get of jail card for Charles Bolton's. The charges on their face are substantial and should not be dismissed as bogus even if Nicholson is a great guy. Maybe he can make a lot of friends in prison.

3:42, I know Carl personally as well. And yes, he would and I'm sure did, do these things. Probably for several other folks as well. The entire H'burg 'power structure' that begin falling with the indictment of C.D. Plookey, and the many folks connected to former Mayor DuPree - and the Forest General crowd - all better be holding their breath while waiting for a dozen other shoes to drop.

Missing in Action; Hattiesburg American and WDAM TV News caught napping. Not a peep out of either despite Nicholson's arrest yesterday and his arrainment and unsealing of indictment today

Yes,
He was the jackass that was drunk and got arrested going to bail out a buddy.
His firm was also one of the top guys doing the BP lawsuit accounting....stuff.
And to 3:42, as a general rule of thumb, when the feds come down with charges,
it’s typically a done deal. “All over but the crying”,,,,as it were.

Actually, he was trying to get his son out of the Lamar County jail. Not sure about BP (Horne maybe?) but he was auditor for the Kemper fiasco...

What about the others at Nicholson's CPA firm? Wouldn't the partners and other accountants there know about some of this?

Also, didn't his firm do the audit of the construction costs for the Kemper County Power Plant?

If I'm not mistaken, Carl is no longer associated with his old firm - the one bearing his name. Several issues, not the least of which his drunken effort to get his drunken son out of the Lamar jail, caused a realignment of the firm's ownership.

One of the CPA's in Nicholson's CPA firm did testify in Chief Forrest County Deputy Bolton's (aka Plukey) tax evasion trial. So, @5:28 I would think some of the employees of Carl's former firm are complicit in this matter. As info Carl is no longer with the firm that once proudly displayed his name.

Well it looks like all the jackass commenters here have already convicted him. Why even have a trial at this point? Carl is being treated very unfairly and I just ask that those throwing stones to put yourself in his shoes and imagine how awful it must be to be wrongly accused and indicted by the corrupt federal prosecutors operating in Mississippi. This is total BS and I feel really bad for Carl and his family and am praying for them.

Hey 5:09 pm a federal indictment can be beaten, if you have the money to fight it and you don’t make a last minute plea deal. Former Jackson mayor Frank Melton beat them and also former USDA head Nick Walters. The fed wants to load you up with felony indictments and overwhelm you so bad that you are so scared and worn down that you will accept a deal that inevitably involves plead guilty to at least one felony. Most people are afraid to fight them and just take the early plea deal. Carl N has the $$$ to fight them and if he is innocent, he will fight it out. Heck, he might fight it out even if he’s guilty...

Times 3 (or 4?) on knowing Carl personally, and also know that this has been a long time coming. You should also know that the Federal conviction rate is above 90%. When they come a knockin’, they already have you.

Look for the GroundWorx debacle to be the next big Hattiesburg thing with big name indictments.

I should’ve clarified. Their firm represented loads of BUSINESSES recouping their losses. Horne rep’d the state primarily.

The reason the federal conviction rate is so high is that all of the plea deals count as convictions in the 90%. If the accused has the money to hire good lawyers and fight it out, he or she can win. Indictments are easy to get; plea deals from scared or broke defendants are easy to get; but a conviction of a wrongly accused defendant who has the means and will to fight is hard for the Federals to get and that is why 10% beat the feds.

If you know anything about Hattiesburg and Carl's ties to the corrupt influencers in South MS, this comes as zero surprise. There's an entire cadre associated with him and he's by no means the head of the snake. It should also come as no surprise that Jimmy Dukes is by his side in this.

6:06 PM - You might be right that others in his CPA firm knew at least some of this and went along with it. It is unlikely that Nicholson prepared those tax returns by himself. Even if the name of the CPA firm has changed, the same folks are still there. Banks, bonding companies, etc. will be looking closely at this.

@10:43 Having served on a grand jury, I assure you that indictments are not easy to get. The success rate has to do with the facts and testimony heard in the closed grand jury room. The Feds know this and they have their ducks in a row before they head to that grand jury room.

Per the Hattiesburg American: "A shackled Nicholson seemed unfazed by his arrest. He appeared affable, joking with his attorneys and supporters who attended the hearing." Demeanor at arraingments tends to differ significantly from demeanor at sentencing hearings.

Melton didn't beat the indictment. He passed away before the jury rendered their verdict so he is automatically no guilty by law. He beat the State charge.

Thankfully the drunken escapade happened in Lamar County and not Forrest County.

The Forrest County syndicate takes care of each other.

I’ve always heard if you are facing conviction/major prison sentence or worse if it’s a capital case, there’s one person to call in Forrest County.

It will be interesting to see if any of these syndicate players cross over into the cream scheme cases.

Jimmy Dukes? This won't end well. This is the same bunch down in Hattiesburg that includes (or included) Bud Holmes and Walt Nixon.

For those that don't know/remember, Holmes was the DA in Forrest County and Nixon was a Federal judge. Google them for details if you care about the details, but both were supposedly permanently disbarred for some serious stuff, especially for lawyers who were also officials (lying to Grand Juries, etc.) and deservedly so. Nixon was impeached and went to prison. I cannot recall if Holmes did. Both were reinstated by the Mississippi Bar - I'll leave that to imagination of the reader - and resumed practicing. If I'm not mistaken, both Holmes and his daughter, who is also an attorney, were in or at least connected with at least a couple of other iffy situations within the last year or two.

Walter Nixon was a federal judge, who as I recall accepted a bribe from Hattiesburg businessman Wiley Fairchild in conjunction with a case involving Wiley’s son.

I’m pretty sure one of the major players in the cream scheme indictments is Wiley’s granddaughter.

This Hattiesburg stuff is better than a Grisham novel.

How can such a sleepy little Southern college football town, a veritable Baptist and devout Catholic enclave, include such a large nest of bad actors? This ain't supposed to happen in Murica.

Only thing I can figure is all these honest men, over the decades, driving down to the Superdome on game days finally got influenced by the Louisiana crime syndicate. How else can you 'splain this?

Next thing you know Hattiesburg will be full of seedy motels.

It is hard to see a vigorous defense mounted on behalf of Carl Nicholson unless his legal team adds a heavy hitter with some success in defending IRS criminal prosecutions. It is doubtful if there is one in this State. Mr. Dukes was in his prime a great trial lawyer but that was long ago. He played a minor role in the Dupree case. He appeared to been caught sleeping during Dupree' s trial.

An interesting sidebar to the recent Hattiesburg stuff:

The US Attorney who was brought in for the Walt Nixon/Bud Holmes/Wiley & Drew Fairchild mess was a sharp young AUSA named Reid Weingarten. Most folks in MS have likely never heard or recognize the name, but he has since become a *_major-league_* white collar crimes defense lawyer up in DC with Johnson and Steptoe. From his time with the on-going Walt Nixon fiasco, he knows just how iffy MS officials often are and how many are connected throughout the years, and a lawyer of his caliber, ability, and instinct wouldn't take long to fill in whatever missing pieces there might be.

Recently, he was approached by the Trump team for obvious reasons and declined involvement. But the scuttlebutt is that he does have friends within the administration who are very close to Trump and family. Many of Trump's friends and family are not keen on Mississippi and Alabama officials - think how far Sessions has fallen. Think also about how Chris Christie (who prosecuted Jared Kushner's father) got tossed off and under the bus once he was no longer useful. It's pretty clear that Trump will need distractions, at a minimum, in November and again beginning in late 2019 and busting a bunch of crooked redneck MS state GOPers would get a lot of national traction as well as give numerous folks in the inner Trump orbit personal satisfaction. Moreover, Trump appears to have MS already locked up for 2020 and busting a bunch of crooked MS pols would add to, not detract from, his popular support in MS.

It all may just be friends doing the normal social things that friends do, but considering the folks doing it, it might be a lot more serious for quite a few folks. Ah, well, time will tell.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox.
