“The President has no authority to require that Americans inject themselves because of their employment at a private business,” Gov. Tate Reeves said. “The vaccine itself is life-saving, but this unconstitutional move is terrifying. This is still America, and we still believe in freedom from tyrants.”
Take out the politics.
First, President Joe Biden did not use his authority to order anything regarding private businesses.
What Biden said was, “So, tonight, I’m announcing that the Department of Labor is developing an emergency rule to require all employers with 100 or more employees, that together employ over 80 million workers, to ensure their workforces are fully vaccinated or show a negative test at least once a week.”
Established by the Occupational Safety and Health Administration Act of 1970, the Department of Labor’s OSHA has the authority to require businesses engaged in interstate commerce to adopt practices “reasonably necessary or appropriate to provide safe or healthful employment and places of employment.”
Contrary to what the Governor said, the legal authority exists. The debatable question is whether OSHA can justify that COVID is of sufficient hazard to workplace safety and health that its rule is reasonable.
Second, injections at businesses will not be required.
The OSHA rule will allow businesses to test employees weekly if the business chooses not to require vaccinations. That also would be subject to debate over its reasonableness.
Third, it is neither unconstitutional nor tyrannical.
In 1905, the U.S. Supreme Court addressed the authority of government to require (smallpox) vaccinations. In his majority opinion Justice John Marshall Harlan wrote, “There is, of course, a sphere within which the individual may assert the supremacy of his own will and rightfully dispute the authority of any human government….But it is equally true that, in every well ordered society charged with the duty of conserving the safety of its members the rights of the individual in respect of his liberty may at times, under the pressure of great dangers, be subjected to such restraint, to be enforced by reasonable regulations, as the safety of the general public may demand.”
Put the politics back in.
“What does the President of the United States not have the ability to do?” Reeves exclaimed. “What else can he unilaterally force you to do?”
Hmmm.
“I have the ultimate authority,” President Donald Trump said on April 14, 2020 about his power related to COVID. “The President of the United States calls the shots. If we weren’t here for the states we would have had a problem in this country like you’ve never seen before….When somebody is President of the United States the authority is total.”
The Governor didn’t make the rounds on Fox News lambasting Trump, but he has for Biden. He was also quiet when Trump issued nearly 200 executive orders, many usurping congressional authority.
It is the flagrant political spin and self-promotion by the Governor in the face of nearly 10,000 COVID deaths that is disturbing, not his disagreement with the President’s policies. Perhaps rumors are true that he is seeking the national political stage for his own presidential aspirations.

So Bill, you voted for Xiden, Hillary, Obama...?
Tate's just being Tate as he nears the end of his first and last term as Governor.
I’m not putting the governor in the same boat as former president Trump yet. But the governor sure is moving in that direction by not thoroughly examining an issue before speaking. Similar to his stand on not allowing a broader acceptance of medicaid.
We all know by now that Tate is a fool, but surely even he is not foolish enough to have presidential aspirations!
Bill has never seen a government mandate he doesn't like. He and his ilk worship at the foot of Washington DC.
Tater made an absolute fool of himself on Jake Tapper’s show today.
This ghoul wants Mississippians to die so he can own the libs.
Besides bullying people into taking the vaccine what does testing the unvaxed
and not testing the vaccinated accomplish? You can STILL catch it and spread it even if you've been jabbed.
Well, it pushes the vaccine as THE answer, which it is not. And my wife and I have been fully vaxed and she's sick again with this shit.
KF, great article. No surprise, but Tater did a poor job representing himself and our State this morning on “State of the Union.” https://www.cnn.com/
Q: what are you going to do differently, if any thing, now that Mississippi has the worst covid death rate in the US and —if it was its own country, would have the worst death rate in the world, second only to Peru?
A: Nothing. Talk to your doctor. Meanwhile, when enough Mississippians die, the fatality rates will eventually go down.
………….
Also, after conceding that 90% of covid hospitalizations in MS are the unvaccinated, he couldn’t bring himself to ask Mississippians to get vaccinated. Everything is a political calculation with this man. Zero leadership. Zero.

I love it when non-lawyers give legal opinions. Or, did I miss it and Crawford actually is qualified to give a legal opinion?
Anybody who watches Jake Tapper ought to be qualified to recognize someone as a fool since that is what the host of that show is.
@1:41 PM - While I never watch CNN, I heard that Reeves was scheduled to be on that program this morning and I decided to watch it because he is our governor.
It was embarrassing to watch Reeves respond to Tapper's questions. Reeves came across poorly and unprepared. Especially, when Tapper mentioned that if Mississippi was a country that it would be No. 2 behind Peru in deaths per capita in the world.
@ 1:41, I saw the show, and what you say is partly true but leaves out the part about Jake Tapper having a fully-developed human brain, a Harvard trained physician for a dad, and a Dartmouth education. Genetics (and education) matter.
Governor Reeves may be a pitiful halfwit but is our pitiful halfwit.
Cut him some slack. Compared to some of his more substantive blunders he was as smooth as Ex Lax this morning.
I don’t get it, I have not changed much since this started other than wear a mask in public, no shot either. I haven’t caught once.
The entire "vaccine" mission is completely political for control.....otherwise the CDC would be screaming to close the southern border. Fauci, no one is talking about it. That's how you know it's all a ploy for power. Not a Tate fan, but he's on point on this.
1:51 - evidently able to hear what you want and ignore the rest. Tater has been encouraging Mississippians damn near daily to get the vaccine. The fact that he is against mandating it doesn't equate to be unwilling to bring himself to ask us to get vaccinated.
Kinda like Bill here saying that Biden didn't require anything of private employers because he instructed an agency under his executive leadership to do so. Hell yes, Biden did require it despite Crawford's parsing of words to try to make his continued attack on Reeves. Thought he was no longer on the payroll of the hospitals as he was during the '19 campaign, but evidently the love lingers.
Supreme Court ruled mandatory vacs constitutional years ago. Reeves is a fool and an embarrasment.
Bill Crawford is a Bill Krystal wannabe. Once a moderate now a inconsequential nobody. Having said that, in my 50 plus years watching politics in Mississippi Tate Reeves and Ray Mabus are the only two politicians I've seen that nobody likes including their own party.
I don't know who on Kingfish's team of authorities penned this bullshit rebuttal to Reeves, but, that's what it is. Attempting to connect Uncle Joe's latest control-dream to OSHA is indeed a dream.
And it's just as much off the table of sanity as Joe's thought that he can require millions of 'government contract' employees to be 'shot'. Nobody even knows how many there are, where they are or anything about their demographics. If YOU are reading this, you doubtfully even know what a government contractor is under EO11246. Hell, it could be Wendy's in Flowood if they have a hamburger contract with the Federal Aviation people at Medgar Wiley for delivery of Dave's Doubles every third Wednesday. It could be Johnny's Tarp Service that tarps a tank on a railcar every seven months destined for Fort Riley Kansas from Pelahatchie. 'Dear Johnny: You are to report to get yo ass vaccinated!'
And Kingfish eats all this shit up!
2:31, read the case law again. The USSCT has affirmed STATE mandates not federal government mandates.
At least he didn't again mention that because we are a predominantly Christian state we aren't scared of the virus. He has had worse showings. And, while there is much I disagree with the governor on he has allowed masks to still be a local control issue unlike Abbott or DeSantis.
I'm pretty sure Deppity Pheel would have been a mush more impressive defender of Mississippi than Tater was.
How can anyone even attempt to act like they want more people vaccinated when we have an open border allowing people from any country with any disease to walk across our border?
Why would anyone trust people who allow tis to happen?
Actually the Supreme Court decision is based on a state statute passed by a duly elected legislature
Well, at least Tate didn't sound like Haley Barbour.
I'm sure Haley would have said something about
"Hitching up our britches".
Kingfish isn’t a lawyer but he got that legal distinction correct!
“When you believe in eternal life, when you believe that living on this earth is but a blip on the screen, then you don’t have to be so scared of things”
Well said, Tate! F Biden!
Gov. Reeves represented his political constituency well. He channelled all of the sanctioned and agreed upon talking points of his counterparts. He strategically did not disavow the efficacy of vaccines, but prioritized individual freedom. He denied his politicization of mask and vaccine mandates, while attributing this motive to President Biden. Most intriguing however, was his changing the narrative from one of the Biden administration's effort to save lives with mandates, to a slippery slope power grab by the President that is a threat to all Americans. Sounded like he attended the Trump School of Gas lighting, and was a pretty good student.
Tater Tot looked pitiful...
His lower lip look like it was quivering.
2 commentators on this blog hit the nail on the head.
This pandemic is 100% political.
Sleepy Joe Biden needs to close the border to protect Americans.
"Governor Reeves may be a pitiful halfwit but is our pitiful halfwit."
@2:05 PM - That reminds me of verse from Randy Newman's song, "Rednecks", about Lester Maddox.
Well said, Tate! F Biden!
"Dying to own the libs," cried the obvious product of Jackson City Schools.
I am publicly begging Delbert to run.
Frightening how far the federal totalitarian programming has gone in stamping out independent thinking when the governor states something so inherently American and true, and gets attacked so venomously.
It never ceases to amaze me how quickly some of you are willing to give up your rights. I am fully vaccinated because I chose to do so and not because some pissant politician said I had to. Do I believe Fauci or the Cdc? No! Do I believe that Covid is a dangerous disease? Yes! Am I willing to give up my rights because I am ordered to do so by some federal asshole? No! I am also not willing to get a number tattooed on my arm and I will not get into your damn boxcars.
Did anyone watch the FDA panel and testimony on the 'booster"?
Before you say 'safe and effective' again I encourage you to do so, you might not be a vaccine koolaid drinker anymore if you do.
oh and if you can find the FDA panel review for the FDA approval of vaccine please share it with us.
Studies have shown that regardless of masks or vax, there is a 100% death rate among humans.
You know we have some very smart Mississippians, but when it come to politics we can be real stubborn. This COVID shigity ain’t stubborn it’s killing people. Yes, I know about choice and being American. I love Mississippi, my Country and my Family. We are all vaccinated, it’s our choice.
If these unvaccinated Mississippians keep dying, there will be many jobs out there for the picking!
I say don’t get vaccinated, my Grandkids will need a job when they Graduate from MSU, Ole Miss and Southern in the fall!
It ain’t about who’s right or wrong, use you good judgement.
You can lead the Ass to water but you cannot make him drink.
Right on 8:27pm. Sadly, it doesn’t matter though— never underestimate the power of denial — people simply will not entertain the idea that they were duped. They will work as hard as they can to convince themselves (and others) that they are correct. The real question will be what they will do when presented with the inevitable boosters. Perhaps they will spend some time studying the Israel example, but probably not
Tate needs to understand the game. Call Wicker in the morning and he’ll give you Nancy Pelosi’s number. Tate and Nancy need to talk about Tate’s re-election to find out what it’s worth to him. Like Roger did.
As for the vaccine, if we are vaccinating all of the workers, how about requiring those receiving government benefits to prove they’re vaccinated before they get another dollar. Biden is attacking the working people and corporations, yet says nothing about those receiving government benefits, including the thousands coming across the border.
None of what Biden does is logical,Unless you hate America.
Who will challenge Tate, will it be Delbert or Feel Jr.?
Delbert, Gunn, Shad, Waller…. Hell even Phil Bryant probably would have looked better than Tate on Tapper’s show. Tate needs to surround himself with some better staffers that will tell him when he is looking like an idiot. Political Hack Parker Briden isn’t it.
I do not know why this is so hard for some of you.
1. None of the vaccines are 100%. That is why some vaccinated people still get sick.
2. The vaccines length of protection is not clear though it appears good protection remains at 8 months ( you have to get yearly flu shots, remember? And many other vaccines require boosters at varying points in time)
3. You can be contagious with NO SYMPTOMS. Ever hear of Typhoid Mary? She never got sick but was a walking spreader of Typhoid. That is why you need to wear a medical grade KN95 or N95 MASK over your NOSE and mouth.
4. A mask reduces the amount of droplets you can spread. The more droplets there are, the greater your chances of getting sick ( it's called viral load).
5. Some people are less immune than others. Some become " long haulers". Some, as with every plague ever in human history seem to have a natural resistance ( some call it the Longevity gene).
6. And, stem cells as a part of the development means never to take a long list of over the counter meds. Google the list. It's too long to put here and includes so many commonly used over the counter "feel betters" than you will have to live with common digestive problems and aches forever once you've confessed and had communion.
There really is no longer an excuse to be ignorant and continue to have unrealistic expectations or be moral hypocrits .
1:55 a.m., Who the hell would want to be Mississippi's Governor other than the usual bevy of dimwitted lifelong PERS participants?
Serious question.
Let me say Covid 19 is real and a serious illness, but
if it is so serious that every citizen is required to do their part;
Why is it harder to eat in New York City than to enter the United States at our border?
If the government believes it is serious, wouldn't they have the same 'mandates' at our border for the invaders who are flooding in and getting a ride on plane, train or automobile to a city near you?
Thanks in advance for the answer.
If Trump had issued the same orders, and Reeves supported them, the left would be calling them both nazis and screaming "my body, my choice."
Matters very little what this man says or does. He is allowing VACCINE MANDATES in his own state and voters will not forget. Meh, I doubt he wants to be a two term guy at this point . Kinda shows.
7:43 : Don't lump in ALL PERS folks with this scared little man. Gov Reeves is playing two ends against the middle and he is failing. All he has to do is man up and BAN vaccine mandates in "his" state. Then he can be free.

There are numerous Supreme Court opinions that deal with the constitutionality of vaccine mandates. Anyone interested in this aspect of mandates needs to read more opinions than just Jacobson v Mass. I would suggest keeping a matrix of binding and persuasive authority at hand if you aren't absolutely certain of it. Also pay attention to what is held and what is (or might be) dicta. If the Supreme Court does not completely overturn all of it, and it is a near-certainty that it will not do that, then - at least in general terms - a Federal vaccine mandate would be just as Constitutionally-permissible as state mandates. When the Supreme Court rules upon a particular state statute, it is ruling on that specific law. However, when it speaks upon the constitutionality of a thing, it is binding on all short of the Court reversing (or amending) itself or a Constitutional amendment. For example, if it holds a state law making blue underwear illegal as improper because it decides that a person's choice of underwear color is protected by the Constitution, it applies to all law and any state or federal statute prohibiting a person's choice of underwear color would run afoul of that precedent.
The bottom line is that given the current precedent a properly-drafted vaccine mandate would almost certainly withstand challenge at the Supreme Court and it might well speak through its silence by declining cert (see the current Indiana vaccination case where Barrett declined the injunction sought and nothing more has been said).
If Biden mandated that no one jump off a 10-story building, the country’s problems would be solved in 48 hours.
So, can one of the vax koolaiders tell me again the reason for the forced vaccine on citizens? I'll hang up and wait for the answer.
"The White House conceded Monday they were not requiring border crossers to show proof of vaccination, even though the government requires proof of a vaccine or a negative coronavirus test for other travelers into the United States.
When reporters asked about the apparent double standard on vaccination requirements, White House press secretary Jen Psaki argued that illegal immigrants and migrants crossing the border were not intending to stay in the United States.
“They’re not intending to stay here for a lengthy period of time,” she said, referring to migrants. “I don’t think it’s the same thing. It’s not the same thing.”
So, can one of the vax koolaiders tell me again the reason for the forced vaccine on citizens? I'll hang up and wait for the answer.
I don't know if you heard, but Biden just mandated that no one in Mississippi is allowed to jump off a 10-story building.
"I don't know if you heard, but Biden just mandated that no one in Mississippi is allowed to jump off a 10-story building."
Nice response! I am so impressed with your knowledge of the flavor koolaid you prefer!
As for me, my choice to jump or not jump is mine, while your's is, well "Follow the Science!!!!" (said while screaming at the top or your precious little voice) could be heard as you start falling....splatttt!
But could you actually tell anyone why you worship the 'science' even when they tell you it is BS over and over again, one more example for you;
""Scott Gottlieb, the former commissioner of the Food and Drug Administration (FDA), admitted during an interview on Face the Nation that the six foot social distancing rule recommended by public health officials for months on end was actually “arbitrary in and of itself,” and he noted that “nobody knows where it came from.”"
Damn,
what 10 story building will you be going off of?
You know the old Ronco commericials? You just knew the cheesy line was coming,

Don’t forget, “follow the science” mantra…do scientist looking for truth usually “suppress” science?
Mississippi Judges violate the Constitution every day to keep Mississippi prisons full an Mr Reeves says nothing about it
