Bill Crawford: What's our Governor up to Now?

 “The President has no authority to require that Americans inject themselves because of their employment at a private business,” Gov. Tate Reeves said. “The vaccine itself is life-saving, but this unconstitutional move is terrifying. This is still America, and we still believe in freedom from tyrants.”

Take out the politics.

First, President Joe Biden did not use his authority to order anything regarding private businesses. 

What Biden said was, “So, tonight, I’m announcing that the Department of Labor is developing an emergency rule to require all employers with 100 or more employees, that together employ over 80 million workers, to ensure their workforces are fully vaccinated or show a negative test at least once a week.”

Established by the Occupational Safety and Health Administration Act of 1970, the Department of Labor’s OSHA has the authority to require businesses engaged in interstate commerce to adopt practices “reasonably necessary or appropriate to provide safe or healthful employment and places of employment.”

Contrary to what the Governor said, the legal authority exists. The debatable question is whether OSHA can justify that COVID is of sufficient hazard to workplace safety and health that its rule is reasonable.

Second, injections at businesses will not be required.

The OSHA rule will allow businesses to test employees weekly if the business chooses not to require vaccinations. That also would be subject to debate over its reasonableness.

Third, it is neither unconstitutional nor tyrannical.

In 1905, the U.S. Supreme Court addressed the authority of government to require (smallpox) vaccinations. In his majority opinion Justice John Marshall Harlan wrote, “There is, of course, a sphere within which the individual may assert the supremacy of his own will and rightfully dispute the authority of any human government….But it is equally true that, in every well ordered society charged with the duty of conserving the safety of its members the rights of the individual in respect of his liberty may at times, under the pressure of great dangers, be subjected to such restraint, to be enforced by reasonable regulations, as the safety of the general public may demand.”

Put the politics back in.

“What does the President of the United States not have the ability to do?” Reeves exclaimed. “What else can he unilaterally force you to do?”

Hmmm.

“I have the ultimate authority,” President Donald Trump said on April 14, 2020 about his power related to COVID. “The President of the United States calls the shots. If we weren’t here for the states we would have had a problem in this country like you’ve never seen before….When somebody is President of the United States the authority is total.”

The Governor didn’t make the rounds on Fox News lambasting Trump, but he has for Biden. He was also quiet when Trump issued nearly 200 executive orders, many usurping congressional authority. 

It is the flagrant political spin and self-promotion by the Governor in the face of nearly 10,000 COVID deaths that is disturbing, not his disagreement with the President’s policies. Perhaps rumors are true that he is seeking the national political stage for his own presidential aspirations.

I’m not putting the governor in the same boat as former president Trump yet. But the governor sure is moving in that direction by not thoroughly examining an issue before speaking. Similar to his stand on not allowing a broader acceptance of medicaid.

@1:41 PM - While I never watch CNN, I heard that Reeves was scheduled to be on that program this morning and I decided to watch it because he is our governor.

It was embarrassing to watch Reeves respond to Tapper's questions. Reeves came across poorly and unprepared. Especially, when Tapper mentioned that if Mississippi was a country that it would be No. 2 behind Peru in deaths per capita in the world.

Kinda like Bill here saying that Biden didn't require anything of private employers because he instructed an agency under his executive leadership to do so. Hell yes, Biden did require it despite Crawford's parsing of words to try to make his continued attack on Reeves. Thought he was no longer on the payroll of the hospitals as he was during the '19 campaign, but evidently the love lingers.

And it's just as much off the table of sanity as Joe's thought that he can require millions of 'government contract' employees to be 'shot'. Nobody even knows how many there are, where they are or anything about their demographics. If YOU are reading this, you doubtfully even know what a government contractor is under EO11246. Hell, it could be Wendy's in Flowood if they have a hamburger contract with the Federal Aviation people at Medgar Wiley for delivery of Dave's Doubles every third Wednesday. Gov. Reeves represented his political constituency well. He channelled all of the sanctioned and agreed upon talking points of his counterparts. He strategically did not disavow the efficacy of vaccines, but prioritized individual freedom. He denied his politicization of mask and vaccine mandates, while attributing this motive to President Biden. Most intriguing however, was his changing the narrative from one of the Biden administration's effort to save lives with mandates, to a slippery slope power grab by the President that is a threat to all Americans. Sounded like he attended the Trump School of Gas lighting, and was a pretty good student.

As for the vaccine, if we are vaccinating all of the workers, how about requiring those receiving government benefits to prove they’re vaccinated before they get another dollar. Biden is attacking the working people and corporations, yet says nothing about those receiving government benefits, including the thousands coming across the border.

None of what Biden does is logical,Unless you hate America.

I do not know why this is so hard for some of you.

1. None of the vaccines are 100%. That is why some vaccinated people still get sick.

2. The vaccines length of protection is not clear though it appears good protection remains at 8 months ( you have to get yearly flu shots, remember? And many other vaccines require boosters at varying points in time)

3. You can be contagious with NO SYMPTOMS. Ever hear of Typhoid Mary? She never got sick but was a walking spreader of Typhoid. That is why you need to wear a medical grade KN95 or N95 MASK over your NOSE and mouth.

4. A mask reduces the amount of droplets you can spread. The more droplets there are, the greater your chances of getting sick ( it's called viral load).

5. Some people are less immune than others. Some become " long haulers". Some, as with every plague ever in human history seem to have a natural resistance ( some call it the Longevity gene).

6. And, stem cells as a part of the development means never to take a long list of over the counter meds. Google the list. It's too long to put here and includes so many commonly used over the counter "feel betters" than you will have to live with common digestive problems and aches forever once you've confessed and had communion.


There really is no longer an excuse to be ignorant and continue to have unrealistic expectations or be moral hypocrits .

if it is so serious that every citizen is required to do their part;

Why is it harder to eat in New York City than to enter the United States at our border?

If the government believes it is serious, wouldn't they have the same 'mandates' at our border for the invaders who are flooding in and getting a ride on plane, train or automobile to a city near you?

There are numerous Supreme Court opinions that deal with the constitutionality of vaccine mandates. Anyone interested in this aspect of mandates needs to read more opinions than just Jacobson v Mass. I would suggest keeping a matrix of binding and persuasive authority at hand if you aren't absolutely certain of it. Also pay attention to what is held and what is (or might be) dicta. If the Supreme Court does not completely overturn all of it, and it is a near-certainty that it will not do that, then - at least in general terms - a Federal vaccine mandate would be just as Constitutionally-permissible as state mandates. When the Supreme Court rules upon a particular state statute, it is ruling on that specific law. However, when it speaks upon the constitutionality of a thing, it is binding on all short of the Court reversing (or amending) itself or a Constitutional amendment. For example, if it holds a state law making blue underwear illegal as improper because it decides that a person's choice of underwear color is protected by the Constitution, it applies to all law and any state or federal statute prohibiting a person's choice of underwear color would run afoul of that precedent.

The bottom line is that given the current precedent a properly-drafted vaccine mandate would almost certainly withstand challenge at the Supreme Court and it might well speak through its silence by declining cert (see the current Indiana vaccination case where Barrett declined the injunction sought and nothing more has been said).
