Will David L. Lane go to jail? The Bridgewater Homeowner's Association wants either its money or Lane's forced residency at the Rankin County Detention Center. A court ordered Lane to liquidate two accounts in March and surrender the funds but Lane apparently has yet to do so even though the deadline was nearly a month ago. Needless to say, Bridgewater is tired of playing games and wants to turn up the heat on David L. Lane.
Ridgway Lane manages homeowners associations. David L. Lane and David W. Lane were the President and Vice-President of the now-defunct company. Eleven homeowners associations sued Ridgway and the Lanes in Rankin County Circuit Court, alleging the defendants embezzled over two million dollars from accounts they managed for the HOA's. A list of the lawsuits and alleged embezzled amounts is posted below. The HOA's accuse the defendants of embezzling over $2.3 million from their accounts. The lawsuits charge the defendants with breach of contract, conversion, unjust enrichment, negligence, civil theft, and breach of fiduciary duty. Circuit Judge Dewey Arthur consolidated all of the lawsuits.
The HOA's obtained judgments against the defendants on March 4. The awards were:

Palisades: $107,701
Eastbrooke: $630,820
Timbers: $90,705

The Court ordered on March 23 that two Community Bank accounts would be liquidated. The accounts had balances of $9,798 and $931 on March 1. The order decreed the funds should be transferred to the Court within three business days later.
However, it appears Lane didn't comply with the order. Bridgewater filed a petition to show cause why he should not be held in contempt of court on April 24.
The petition states 26 days passed since the deadline for depositing the funds with the Court. David L. Lane told Bridgewater that the "Covid-19 situation" kept him from complying with the order. Bridgewater called the excuse "disingenuous."
Bridgwater points out the Court issued the order 11 days before Governor Tate Reeves issued his shutdown order on April 3. March 26 came and went with no Lane compliance taking place. The HOA says Lane could have written two checks or asked the Court for relief. He simply ignored it all.
The aggrieved HOA asked Judge Arthur to hold David L. Lane in contempt of court and throw him in jail for either 30 days or until he complies with the order.

The man embezzled millions and only has $10,000 in his accounts? Where is the rest? Timber schemes, up his nose, offshore accounts? Why he is not in jail is a total injustice.
Can someone explain what is so hard about 'managing' a HOA that these HOA boards thought they needed to pay this crook money to do it? Doesn't make it right for this clown to steal from them, but WTH?
@ 8:28 - I'm assuming you don't live in a HOA neighborhood. We live a small neighborhood - less than 30 houses and are self-managed, but I couldn't believe the petty things people bicker about. Not to count people who can't seem to pay their HOA fees. We rely on volunteers to mediate and attempt to collect money from delinquent homeowners. In some cases, this has meant putting a lien on someone's house. I can understand how large neighborhoods would rather pay for someone to do this for them.

Affluent people always receive special treatment from the courts. The preferential treatment even transcends race if you are rich enough. It is almost as if we have a tiered justice system and justice isn't truly blind.

Using an HOA management company keeps the upper class from having to deal with the nasty poors that manicure the lawns and patrol their gated community at night. The Lane's were the lowest level of pond scum they had to seal with. And they liked it that way.
to 8;28 management of a HOA can be difficult when homeowners dont pay their HOA dues. nothing happens without money , and hoa dues are usually the last thing on the list when it comes to paying bills.

The only rules my HOA enforce are the ones regarding the collection of dues.
We have the best justice money can buy at 9:17. The law of the land only applies to the poor and unconnected. Sad, but true.
Our HOA provides one very nice, professional courtesy notice when the annual is past due and then files a lien at the end of the notice period if the matter is not resolved. The process is applied consistently across the board. The liens get attention because our HOA doesn't bluff.
It is completely outrageous that this man is not already in jail. There has been no justification for it offered by the lawyers or the court. Bridgewater needs to fire its lawyers and get some who will actually move the ball forward instead of begging Mr. Lane to "pretty please" give some of the money back. And for a bunch of "law and order" and "swift justice" types, Rankin county turns downright bleeding heart liberal when you get a rich white guy in front of the judge. I can promise you I will be hosting a fundraiser for Dewey's opponent in the next election. The way this case is being handled undermines the foundation of our judicial system - to administer fair and impartial justice - and every time it happens, people lose a little more faith in the system. If you've spent time in places with sham courts, they are uniformly poor, violent and corrupt. People think it can't happen here, but can and will if we stop being vigilant and just shrug our shoulders when this kind of thing happens. People need to be furious about it.

Neighbors who don't pay their HOA dues STEAL from the neighborhood residents who faithfully pay their HOA dues. The non-paying residents are no better than the Lane family's theft. It's about integrity and living within your means, whether it is a small amount or large amount of money. The HOA funds help to keep the streets paved, street lights on, and common areas mowed. Stop living off of someone else's dime. No one made you purchase a lot or home. Those who do not pay their HOA dues should never get a vote or a voice regarding HOA/neighborhood matters.
The justice system really does stink. You steal minor BS and will stay in jail until you can post bail or go to court. Then when convicted you serve your time. You steal millions and you get a slap on the wrist. How judges and prosecutors can sleep at night is a mystery to me.

I think 1:10's point is that Judge Arthur is NOT soft. He's a hangin' judge in a conservative county. So, it's really strange that he's been so hands-off with the Lanes. Once Lane knew the jig was up, he tried to start transferring assets out of his name so the people he robbed couldn't get any of it back. He's shown no remorse. To the contrary, he's demonstrated an intent to keep defrauding all of the families he stole from. Typically, this kind of criminal gets swift justice in Judge Arthur's court. This delay doesn't look good.
As for the HOA lawyers, they only reason they are finally asking for jail is because the HOAs are tired of paying $400 an hour for no results, and the lawyers don't have a good explanation for why they didn't already get that money from Lane back in November. All Lane has to do is give the HOAs money that everyone ALREADY AGREES belongs to the HOAs and Lane gets to stay at home watching Netflix.

As a homeowner In the unfriendliest of these neighborhoods, I have a question. WHY the heck should we pay our dues to a homeowners association that was so irresponsible and disengaged they did not know we were getting ripped off? I’m disgusted With the crybaby board and concerned the innocent homeowners that have faithfully paid our dues are going to be the ones to get screwed over by our sanctimonious board. Our streets need work, who is going to pay for this now?
Why didn't the Court just impose a garnishment against the banks to collect what they can instead of ordering the Lanes to write a check?
