D.L. Gardner: Mandate Wars

 At this point the war could go either way. For the past two-plus years authorities from the federal level to state and local levels as well as corporate and institutional levels have been winning the mandate war. Why do we have to sit six feet apart, wear masks, and take shots with experimental ingredients? The “science” no longer supports wholesale one-size-fits-all mandates on everyone. Cue the lawyers.

In the past two weeks President Biden has had Covid twice in spite of having two shots and two boosters. Seems like only last year Biden said in a CNN town hall, “You're not going to get COVID if you have these vaccinations.” Oops! We shouldn’t pick on Biden. After all, Dr. Fauci is the world’s leading money-making expert on making and preventing viruses had his own bouts of COVID. It happens. 


So, the mandate war has moved from the laboratory to the courtroom. District Court Judge Matthew McFarland extended a temporary exemption to a Department of Defense COVID-19 vaccine mandate for Air Force and Space Force service members. These service branches had allowed religious exemptions for members, but granted only a few exemptions. Only 135 religious accommodations had been granted while nearly 3,000 were still pending.  Disciplinary actions against those who refused the mandated vaccines included demotions, discharges and courts-martial for refusing to comply.


Here’s the legal rub. By law employers cannot treat employees as if they were disabled simply because they were not vaccinated. That’s discrimination. Jeff Childers explains in his daily ‘Coffee & Covid,’ “Consider the case of an employer treating a healthy gay person as having AIDS and requiring them to work from home or something. That’s not fair. It turns out that kind of differential treatment violates the Americans with Disabilities Act.”


Apparently, we’re already in another COVID-19 pandemic. The number of cases is rising again, though the number of COVID deaths is remaining relatively low. This year’s “Flu Season” will include COVID along with all the other usual viruses. Look for class action lawsuits to begin popping up against employers, including federal, state and local governments who discriminated against workers who refused mandates. 


Some have always seen the “emergency” mandates as intrusions against our guaranteed rights as citizens. The war of government emergency authority against personal liberty and freedom is now overshadowing the largely imaginary war of “science” against the masses. How much damage did we do to school children the past two years? Who said masks were safe or that lockdowns were necessary? How many two-week periods have we spent “bending the curve?” 


Nevertheless, the war of emergency government authority against the Bill of Rights and the Constitution will continue this fall as students return to school. America has fought wars of discrimination throughout her existence. In fact, we were founded on documents enumerating all kinds of discrimination and abuses by overbearing governments. The Bill of Rights itself lists prohibitions against the federal government with regard to speech, religion, and bearing arms. 


On the other hand, woke bands of pro-choice supporters and their allies in LGBTQ and Black Lives Matter are hearing that MAGA Extremists are going to do away with all of their rights if they capture the Congress in November. Lucky for them conservatives believe in the Constitution.

But how are the politicians supposed to control the poor people without something to scare them? Many are now not afraid of the devil. Can't continue to use him. Disease has worked great for the last few years. Looks like they are going to try it again for this election. Will it work again?

The "six feet" is an arbitrary number and has no basis in science. It's just easy to remember.

Remember, if you can't question the science, it isn't science, it's propaganda.

At this point, the vaccine mandates only affect workers in healthcare and some sectors of the military. Aside from local orders and a few federal government buildings, I'm not aware of any mask mandates. What is this Gardner guy going on about? Also, the whole discussion of the ADA is a gross misstatement of the law. A protected disability under ADA is a condition that impairs a major life activity. Being gay or refusing a vaccine isn't such a condition.

@11:53 NYC still has mask mandates, on the subways as one example. California has mask mandates in many venues around the state, as it varies by county.

You apparently have kept up with science or you'd know you can measure breath and how far virus droplet carry in a cough or sneeze and whether the virus can be communicated by surface.
You tare criticizing adding and rounding off numbers for safety implementation.
It's sorta like the speed limit doofus!Those are increments of 5 for facility( as in ease). You have so little common sense, I can't take for granted you'd know that!

And, our resident Krusaytyr is in his basement over seas supporting our crazies!
At least I learned today where the person in the most stolen auto choice and with a Q Anon license plate lives so I can avoid EVER being their neighbor!

Never got the You're guaranteed to get The Covid vaccine, but my entire family did. They have, almost to a single person had Covid. Now I'm worried about them ending up with long-term sequelae. I am convinced more than before that this was perpetrated by ignorant money and power hungry people of both parties. They should all rot in hell. Next is the Monkeypox which is targeting a specific group of our society, but we will have to bend to that noise soon enough.

DL loves mentioning The Constitution but doesn't know that George Washington required his troops to be vaccinated against smallpox with what was then, being cut and the live virus being rubbed on the site.
Indeed,those who wrote The Constitution were pro-small pox vaccine. In their letters they write about the need for "public health" to be a government function.
Thomas Jefferson and Benjamin Franklin were certainly believed in science and made contributions to science.
Sadly, they didn't know that we'd award degrees to those who could memorize words but not comprehend them or be able to recognize the importance of context.
They also didn't imagine that we'd listen to simpletons and be too lazy to actually research their intentions and thinking and arguments about language used in The Constitution.
They thought we'd value our freedom and that our founding and the principles it described would matter more and be of greater influence than our Civil War and Wild West days.
They also knew they weren't psychic who be able to account for the challenges of the future.
One thing for certain is there were NO religious extremists among our Founders. The majority of signers of our Constitution were Episcopalian ( over 30). There
was only one Catholic. There were 2 Quakers. The next second largest group were Congregationalist with 12(each church was independent and it was closer to Unitarism, Deism and few of those to Calvinism then...indeed Adams did quickly become Unitarian) at 12. And, Ben Franklin was not a church goer.
They were very aware that Individual religion was essential but that Government favortism of A religion led to the persecution of non-adherents and to devastating wars between Prostestants and Catholics. They could NOT envision a politically united evangelic group as such groups were so fiercely individual by church with no organizational unity.
Besides, they thought we'd always be taught about the horrors of burnings at the Stake and witch burnings and The Inquisition and Days of Cromwell and surely the Divine Right notion of Kings that empowered the Catholic Church. And, why we'd know why a sinner like Henry VII demanding the Bible be available in English mattered ( other countries followed over time. The Bible once was only able to be read by those who knew Latin...not the followers who had to be "told" what it said.
Organized religions that seek power and money and special privileges from the State were a danger they understood. Now churches can literally have independent businesses and be tax exempt.
Our Founders would be appalled at that and that a Catholic judge is injecting his religious beliefs into federal law!
Might ought to elect and appoint more Episcopalians...our church doctrine hasn't changed all that much and still tolerant of other religions.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
