Fourth DUI not a Charm

 Former DHS Communications Director Danny Blanton pleaded guilty to felony DUI in Madison County Circuit Court yesterday.  It is his fourth DUI conviction. 


The indictment states he was arrested on July 10, 2021 for a DUI.  He was convicted of DUIs in June 2021, May 2014, and July 2004.  He previously served as the Public Relations Director at Ole Miss but resigned the position in November 2015. He is 58 years old.  

Blanton faces a prison sentence of two to ten years and a fine of $3,000 to $10,000.  The District Attorney made no sentencing recommendation.  

Blanton will be sentenced in two weeks.  Circuit Judge Steve Ratcliff presided over the case.

Consider the 100s of times that he has driven drunk but not caught, and all of the times that he was likely intoxicated at work.

We will never know how many accidents that he caused and drove off.

He will get more time for this in Madison County than someone gets for murder in Hinds County.

Drunk drivers should be executed after the 3rd strike. I say this as someone who has two relatives who are multiple DUI offenders. The liquor killed one of them by age 50. And the other one doesn’t give a shit about anything except for having sex and getting drunk. She is 40.

Once upon a time, we could involuntarily commit addicts at least until they were sober for the time it takes for the physical addiction to end.
If you can't do that, there's zero chance you'll stop the habitual behavior unless the family can managed 24/7 supervision until new habits are formed.

I understood the three strikes statute to require 3 duis within a 5 year period for it to be considered a felony and subject to mandatory jail time. What changed?

I talked to an inmate at Parchman over twenty years ago. He was mopping the floor in the administration building. He was doing five years on his third DUI.
WE need more of this kind of sentencing

Someone mentioned 3 or 4 felony convictions. I don't see any of the priors being felonies and guess this one is only because it's No.4.

Just look at what alcohol does to a person. As stated above he looks 75. Alcohol is just highly calibrated poison. No doubt those around him have suffered due to his drinking. He’s a liquid junkie. His bad judgement is extreme, social drinkers bad judgement is hidden better but rest assured it has negatively affected their lives and those around them. Put him in the pokey.

Several years ago this was changed in legislature due to people receiving multiple DUI's just over time limits.

(8) Charging of subsequent offenses.
(a) For the purposes of determining how to impose the sentence for a second, third, fourth or subsequent conviction under this section, the affidavit or indictment shall not be required to enumerate previous convictions. It shall only be necessary that the affidavit or indictment states the number of times that the defendant has been convicted and sentenced within the past five (5) years for a second or third offense, or without a time limitation for a fourth or subsequent offense, under this section to determine if an enhanced penalty shall be imposed. The amount of fine and imprisonment imposed in previous convictions shall not be considered in calculating offenses to determine a second, third, fourth or subsequent offense of this section.
(b) Before a defendant enters a plea of guilty to an offense under this section, law enforcement must submit certification to the prosecutor that the defendant’s driving record, the confidential registry and National Crime Information Center record have been searched for all prior convictions, nonadjudications, pretrial diversions and arrests for driving or operating a vehicle while under the influence of an intoxicating liquor or while under the influence of any other substance that has impaired the person’s ability to operate a motor vehicle. The results of the search must be included in the certification.

I hope he gets help, but I have not desire in leaving that decision up to him any longer and allowing him to kill innocent people.

He clearly has the means to seek treatment for his dopamine addiction. He has chosen to selfishly indulge and in the most reckless of manners.

Lock him up and he will be forced to heal. Win-Win.

I have been fortunate to know Danny for over a year and I'm proud to call him my friend. He's a dedicated and decorated American who fought for our country earning The Bronze Star while serving in multiple wars. Like many of us, Danny has been afflicted with the disease of alcoholism along with suffering from PTSD. The good news is we serve a forgiving, loving and gracious God. May that same God have mercy on all of us who inappropriately judge.

It takes a financial toll on a family to pay expensive fees for 6 months for a successful detox and live-in rehab once an alcoholic reaches two fifths of cheap vodka a day.

The person I know was addicted to drinking after one year in an Ole Miss fraternity. His family made big financial sacrifices for best help available and it worked. He's been sober for about five years now, has a good job and a steady girlfriend, just got a promotion.

Wow. I truly hope that each of you judgmental cowards hiding behind your screen is judged just as harshly as you have judged and berated this man.
Yes, he made terrible mistakes while under the influence. He knows that, and has to live with that fact. He doesn’t condone drinking and driving nor does he think it’s right. In active addiction you do and say things that aren’t you. Things that you would normally balk at…
He is a decorated veteran. A war hero. He has fought in multiple wars for our country. He has fought for our freedom. He’s seen things that no one should ever have to, but he did it to serve our country. I cannot imagine how much that must screw with your head. He does have PTSD. I’m sure that you would too if you had to see and do the things that he had to. Danny has a huge heart and yes, he has feelings just like you and I do. I cannot imagine reading these hateful and cruel comments about myself, can you? As for the people who made cheep shots about his looks, I’m sure you would all look beautiful in your mug shots on one of the worst days of you life. It’s inhumane and demoralizing what you do. PTSD does not cause or lead to drunk driving or the conscious decision to do that, so stop with the pity card.

We know we aren't perfect, just as this criminal is not.

And if you love this man, you should have gotten him the help he needs after one of the first 3 DUIs.

Stop making excuses and attempting to enable this behavior. You should be ashamed of yourself. You clearly know him well, but you did nothing to protect society from the disease that he has no control over?

He got a fourth DUI. How many jobs has he lost because of this problem? He was already convicted of a third offense DUI. What are you going to say if he kills someone driving drunk? Sometimes jail is used to protect you from yourself. This may be one of those times.

It won't be surprising to learn if well-meaning friends urge the court and DA show leniency towards him.

What would the headline be if instead of a fourth arrest he killed someone (or more) as that woman did on Highway 18? Look at all the hell being raised over that one because her previous arrests were not prosecuted. Is that where you want your friend to be?

If he hasn’t already faced enough consequences to get his life in order, then I pray that the justice system is able to slap some sense into him. Making the same selfish decision to put other peoples families at risk so he could drive drunkenly to his destination is an asshole move. He probably doesn’t think he is hurting anyone except for himself, but hopefully he can learn something while in the custody of the state. My bet is Tate will set him free and mention something about cancel culture and his status as a war vet.

After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.
