No Gun Rights for Baby-Killer

Rankin County Circuit Judge John Emfinger denied a convicted baby-killer's petition to restore his gun rights last month.

Joshua Poling was indicted for capital murder  in Rankin County for the 2005 death of his son, 8-month old James Poling. (The obituary for little James is posted below.)  He pleaded guilty to manslaughter due to culpable negligence in December, 2007.  Circuit Judge Samac Richardson sentenced Poling to a prison term of twenty years, but gave him credit for time served.  Poling served over two years in the Rankin County jail since he could not post bond of $500,000.  The Mississippi Department of Corrections granted Earned Supervised Release to Poling on September 20, 2014.  He did not have to apply for parole.

 Poling filed a petition for certificate of rehabilitation in Rankin County Circuit Court on July 13, 2017.    Judge Emfinger was a Rankin County Assistant District Attorney when the case was prosecuted. Oddly enough, the Clarion-Ledger reported Poling's arrest but did not report his indictment nor conviction.

Judge Emfinger said that  although the law does not require a "waiting period" before the certificate can be issued, he would not consider doing so unless Poling was eligible for expungement.  Poling can't apply for expungement until five years after his release (in two years).

This piece of shit picked up his infant son and threw him across the room, smashing his head open on a counter. Because he was crying to much. He should never hold a gun again. In fact, he should never walk free again.

Everyone on this site is crying too much. Choose one of us and throw us across the room. (me first) After you accomplish that task, then your gun rights will be a moot point.

Not only did the criminal justice system fail us, the "inmate " justice system failed us as well.

I guess he'll get his punishment from the Almighty.

I support castration as part of the sentencing of any man who murders his child. Too bad that wasn't an option.
I also find the light sentence to be inexplicable.
This was homicide and even more egregious than if he'd killed an adult in anger or frustration.
That he may someday qualify to own a gun should be unthinkable.
We once understood that rights come with responsibilities and can be lost by one's egregious actions.
But, we are in an insane political climate controlled by extremists. They appeal to our fears.
The extremists misquote Paul by taking one part out of context so as to justify separating 2000 children, including toddlers from mothers.
The United Methodist Church (other churches plan to do the same at their conventions) had to officially take a stand against something that they thought to be obviously immoral to all religions.
But, the extremists saw a loophole in the law and a loophole in religious doctrine and claim they are not responsible or to blame for their actions.
At best, a " loophole" just means lawmakers nor religious leaders couldn't predict or imagine that any human would go to such extremes as to make specific language preventing such an extreme necessary.
So, we shouldn't be surprised at how this case has been adjudicated nor surprised should this man be allowed to carry a weapon in the future.
We no longer judge by behavior, we judge by looking in the mirror and if the person seems to be like the reflection, we can find excuses and compassion for that person's bad behavior.

I have a hard time understanding some people.
On one hand they want more punishment for a citizen of the U.S. for a crime but want less punishment for a person who is not a citizen of the U.S. who commits a crime.
Can anyone explain that to me?

12:32 pm Yeah, we punish the criminal, not their children whether they are citizens or not. We have morals and values, unlike our enemies or we did.

And, for some of us, there's that " Suffer the little children to come unto me". We don't interpret that as making little children suffer.

Hate to burst your bubble but I'm not a Democrat or a liberal.
I don't march in partisan lock step nor do I think any politician walks on water.

Would you care to explain why frightening children who don't even understand the nature of their parent's crime is of value?

And, 12:32 pm can explain why castration doesn't fit the crime but incarceration the child of a criminal is rational punishment?

Can I share with you how much I actually DESPISE this guy? It's gut wrenching to even have to see the article again. Little James would be 13 right now. This SOB robbed a family of a beautiful child.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
