REMANDED!

Just got word that the indictment against Wayne Parish was remanded to the file by Judge Winston Kidd. Parish is free.

Now, what is Carlos the Clown's next move in this fiasco?

Sanity in Jackson? Hell just froze over.

I picked a hell of a day to quit drinking...

I was hoping it would be over by 11:01, but I'll take 11:14!

I'm not an attorney, don't even play one on TV. What exactly does this mean? Does it mean it's over?

What bearing (if any) does this mean as far as the wrongful death lawsuit that has been filed? It is my hope that it goes away. I've seen the video....and realize that rational conclusions escape a lot of people (jurors in Jackson). I would hate for this man to be found liable for anything.

A remand technically means the case is put aside but could be revived, sometimes subject to certain conditions (such as future charges against defendant, violation of certain conditions, etc.). Realistically, this means the criminal case is done. The prosecutor would not remand the charge unless they had a strong reason to believe they cannot get a verdict or maybe at the request of the victim (which is doubtful in this case). What effect does this have on the wrongful death case? Technically, nothing. There are different standards in civil vs. criminal cases (though a conviction would have helped the civil case tremendously).

Why in hell would this wait until THE DAY OF? It's that laziness, ignorance or arrogance?

Anonymous said...

He should push for more.....

Move to dismiss the charges with prejudice.

Good thing it was before Kidd instead of Weill. Because Weill doesn’t let the prosecutors remand to files. And of course, y’all applaud

Thank you, Judge Kidd. You did the obviously correct thing in this case. I hope the judge in the civil trial does the same thing, or if he/she sends it to the jury, that the jurors will do the right thing, too. God bless and protect Mr. Parish and his family.

Correct 2:11. Weill might well not have let this be remanded but required it to be dismissed due to it being the crap that it is. Might have meant that it wouldn't be through in the first 15 minutes, but it would be removed from the record totally. I am sure RSS was more worried about getting his case across the river delayed and knew that there was no way to defend this deal, so 'remanding' was an easy out. Not saying that if I were Parrish I wouldn't accept and walk away, but if it had gone to trial there was a lot of dirty laundry that would have been aired, and none of it was Parrish's.

Or is it a fact that the judge cannot remand until the actual day of the trial?

I have no words. An unarmed black kid is gunned down and the white man that pulled the trigger gets to walk free. Feels like we’re living back in the 1960’s. This is so ****ing outrageous! What the hell is wrong with letting a jury look at the evidence and make a determination? Oh yeah that’s right, you racists on this blog probably wouldn’t have liked the verdict.

So has Mr. Parish been incarcerated this entire time or out on bond?

Anonymous said...

A black judge remanded it. The only reason the case stayed on life support was RSS pandering to the radical crowd looking for a payment.

Do you think Donna has watched the video yet?

It didn't take long for this to deteriorate into name-calling.

As a wise man once said, "Keep ****ing that chicken."

Dear Justice for Tyrion - If every charge in Jackson went to trial, your brothers would be in trouble. Hell, they are getting released on a daily basis.

Too little to late

Justice for Troll: the gig is up bud. Just say no to trolling and do something productive with the time you have left on this earth.

Glad to see that Second Amendment rights are upheld. Thugs can not be allowed to rule.

Messick; I have been up all night searching and cannot find any wise man ever saying "Keep ****ing that chicken".

JFT, stop typing when you have no words.

1/30 3:05 AM: I'm pretty sure it was Omar from The Wire.

So...Justice For Tyromes; If 'an unarmed black kid' who is quite agile and stronger and faster than I am who comes at me in an attempt to wrest my gun from me and I'm fairly certain this 'unarmed black kid' will kill me and continue on his mission of stealing my car....I have no right to blow his punk-ass away?

'You People' have an odd 'code of behavior' and an indefensible way of evaluating situations. But, all participants on the blog-site must remember that you see everything through the prism and filter of race. Nothing else much matters.

Do us all a favor and change your screen name from JFT to WTF.

I was being a bit sarcastic when I said "wise", but here ya go:

The man needs determination by a court that this was self defense so as to shield him from any wrongful death suits by the family of the "victim" (and I use that term loosely).

I heard DA. Smith say now he wants to look into the facts of the case in the best interest blah blah blah What the hell facts then did your apparently and admittedly uninformed ass present to the grand jury that indicted this man and ruined his life.

Anonymous said...

I’m not picking at old sores but I find it telling that Mr Smith filed a Motion to Remand with the court in this case but refused to file a similar motion to remand in Christopher Butler even after being requested to file it by Judge Weill .

Anonymous said...

So, does anyone know what Mr. Parish's legal bills amount to, by now? Is there a chance of his recovering those costs? Or is he RUINED?

Anonymous said...

My brothers you need to wake up and train, nourish and love your kids so this won't continue to happen! I cannot Imagine Mr Parish woke that morning thinking this is the day He was going to shoot and kill a human being.

I'm looking out over my back yard thinking if an individual tried to break in my back door! I would call WDAM, confront him with my arsenal of weapons, subdue him, let him call his mother to tell her good bye, pray together and then put his lights out.

If you don't tell your children the many dangers of breaking into a persons home i.e. Property, then you are wrong.

On the other hand, I would just scare him away so he could just break into another persons residence, rob, rape and kill their love ones.

No, I am not a judge, jury or God. But I'll have to think really fast to not end up like Mr Parish.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

This is definitely a Beaver production.
