State judicial election committee tells Shamsid-Deen to stop illegal campaigning.

The Special Committee on Judicial Election Campaign Intervention issued a cease and desist against Hinds County Circuit Judge candidate Ali Shamsid-Deen, as well as a cease and desist order yesterday.  The committee ordered Mr. Shamsid-Deen to stop using campaign materials that are "misleading" and imply that "he is the incumbent Circuit Court Judge."  The order and press release are posted below.  The committee states Mr. Shamsid-Deen ignored the order.   The committee also ordered Mr. Shamsid-Deen to stop using materials showing his picture along side that of Travis Childers.  Mr. Childers is the Democratic nominee for U.S. Senate.

The press release states:



Print material circulated by an organization calling itself South Forward IE
PAC in support of a candidate for Circuit Court Judge of Hinds County has
been brought to the attention of the Special Committee. Mississippi law
prohibits a candidate for Judge of the Supreme Court, Court of Appeals,
Circuit Court or Chancery Court Judge from aligning himself with any
candidate or candidates for any other office or with any political faction or any
political party at any time during any primary or general election campaign.
Mississippi law requires that campaigns for judicial office shall be nonpartisan
and without any connection to a political party, political parties and any
committee or political committee affiliated with a political party. The
Committee finds that the materials in question improperly align a candidate
for Circuit Court Judge with a candidate for another political office and violate
the intention that judicial campaigns for Circuit Court Judge shall be
nonpartisan.

The Mississippi Supreme Court created the committee in 2002.  The Associated Press reported:

Jay Parmley, the executive director of South Forward of Columbia, South Carolina, says the criticism is off base because his group is independent and can't coordinate with ShamsidDeen or Childers. He said that the First Amendment and U.S. Supreme Court decisions mean that his group has a right to say what it wants about candidates.
"The candidate did not link himself to the Democratic Party," Parmley said Saturday. "The candidate did not link himself to another candidate. We are not an entity of the Democratic Party."

If a candidate refused to comply, someone could file a complaint with the state Commission on Judicial Performance, or the commission could take the matter up itself. Proceedings are secret unless the commission recommends to the state Supreme Court that a judge be disciplined or retired.

Parmley said South Forward has spent $50,000 to $80,000 in Mississippi this year to help Childers, including door-to-door leafleting, phone banks and mailers. He said that South Forward looks for local candidates to support, saying ShamsidDeen is "the right kind of judge" to line up with the group's philosophy.

South Forward's leaders include former Mississippi state Senator Gloria Williamson, who is also a former chairman of the Mississippi Democratic Party.

Shamsiddeen has violated rule after rule in this campaign. It's about time he gets called out. I am sure he will just try to call the Special Committee a bunch of racists, or if the members are black, Jim Crows- it's his defense to anything. Ironically, he's the only racist on the circuit judge ballot. Jacksonians- GO VOTE for Weill, and if you live in Madison or Rankin Counties, get on your knees and pray that Weill gets elected!

What is exactly the difference between what he is doing and the GOP MAIL-OUT that endorsed the Miss. Supreme Court judges? The reality is that the choice is this: Judge Shampson-Deen is the most liberal judge in the metro area and JPD hates appearing in front of him. He is a very nice guy, but just does not convict anyone. Judge Weil is a very conservative judge that destroys the constitution in his court room. He actually made a jewish lawyer say a prayer to Jesus in his court room. (In his defense, I don't think he realized the man was jewish, but separation of church and state. What would happen if the Muslim Sampson-Deen did that?) You would think we would have a third candidate.

The "no party ass'n" part is unconstitutional. Seems to me that the ass'n with other candidates would fall under that.

I'm not sure what the state of the law is on misleading campaign speech - seems there was a recent Ohio case - but even that may be protected.

Pretending we can purify elections for judges just masks how bad an idea it is to elect judges, period. Maybe our GOP-led gov't can spearhead an appointment initiative.

Or, even better, everyone could just follow the rules. And we could hold Shamsiddeen to the same standards as Weill. Imagine if Weill had said some of the blatant racially motivated things that Shamsiddeen and his team have been spewing. Shamsiddeen would be the final nail in Jackson's coffin, at least as far as the courthouse is concerned.

And Weill hasn't done anything racially motivated? Am the only one who received his flier that had not only Shamsiddeen's picture on it but Judge Green's as well? I think we all know what that was code for.

But he goes on mission trips and helps feed poor black people (during the election season), so he is a good guy.

I got that flyer and it is clear that the only purpose for including Green was to give some context for Weill's results on the bench in his first term- which are incredible. Race has nothing to do with the fact that Green- the longest serving judge- barely does anything in the courtroom. She spends all her time declaring war with people like the sheriff (and Weill when she tried to take his criminal cases).
Attempting to label a good Christian man like Weill as a racist is such a red herring. Focus on his record on the bench which is better than any other Hinds County judge and leave race out of it.

All a person need do would be to read the Code of Judicial Conduct,which is located along with the rest of the Court Rlues in the Mississippi Rules of Court, along with the comments. These rules apply to judicial office seekers as well. It should be clear.

I can appreciate the above public defender's view, but they, as well as prosecutors, should be careful not to play fast and loose with facts of which they are not certain. Um'... I not sure if any of the other candidates have gone as far as, the Delta to help feed the poor, be they black or white.

10:29 - I think its "code" for "more incompetence", since Green was where Shamsiddeen trained as a law clerk. As to your comment "But he goes on mission trips and helps feed poor black people (during the election season), so he is a good guy" - Weill has been doing mission work (both working at shelters in Jackson and overseas) for years before he was ever on the bench -and I'm sure some he served were black, some were white and some were other ethnic groups. So, yes you are correct, he is a VERY GOOD GUY!

KF, your post is misleading. Maybe that was your intent? Shamsiddeen is not the creator of the push card going out nor did he or his committee approve the push card. The lit clearly reads "not approved by EITHER candidate."

It was canvassed in predominantly "urban areas, has black people on the front, and Childers and Shamsiddeen on the back.

Ask yourself why would Shamsiddeen feel the need to tie himself to a non-minority running for senator when canvassing a predominately black neighborhood?

Ali Shamsiddeen, as a judicial candidate, is prohibited from aligning himself with any other candidate, but any political action committee ("PAC") has a First Amendment right to endorse any judicial candidate or non-judicial candidate they choose. It is protected political speech.

It is inappropriate to claim a violation of judicial ethics by a judicial candidate because he/she is endorsed by an organization that also endorses another partisan candidate unless there is proof that the judicial candidate asked for the endorsement. A PAC's endorsement of a judicial candidate may be distasteful if you don't like the PAC's philosophy, but it is not unethical.

I would never vote for Ali Shamsiddeen for any judicial position, but the PAC's endorsement is improper criticism of Ali Shamsiddeen.

I don't like that the Supreme Court ruling now gives a green light to politicizing the judiciary, but it does.

And, let's face it, both parties had already made great progress in politicizing the judiciary. That is why we now have what I think , should our Nation survive, the worst Court in our history and there have been some bad Justices in the past.

10:29 and 11:35 - nice try at trying to divert attention from the fact that Supreme Court's committee found TWO separate violations by Ali S - 1. improperly being linked to the Democratic Party and Democratic U.S. Senate candidate Travis Childers (which you guys are addressing), and 2. misleading people into believing he’s the incumbent. Frankly, I don't care which one of the two you pick because it has apparently been decided by people with a lot more factual knowledge than me (or you) that Ali S has ignored the law. Also, 10:29, you need to also be equally critical of the Clarion Ledger, the Mississippi Business Journal and every other media outlet for daring to report on this.

The Special Committee on Judicial Election Campaign Intervention has no authority over what South Forward IE PAC does. Their criticism of ShamsidDeen for implying he is an incumbent; however, is within their scope.

But as of last week, South Forward IE PAC had not filed as a PAC in Mississippi to spend on behalf of ShamsidDeen and the Secretary of State and Attorney General should exercise their authority for that violation of law.

Perhaps if he loses, Judge Weill can move to a less fractious environment where his talent and character will be more valued.

I was scanning thru radio stations on the way home from work and came across Ali Mohammed Shamsideen on a "talk show". He was surrounded by his radical friends (the talk show host, young Lumumba and Martin). IT WAS SCARY WHAT THESE GUYS BELIEVE (or say they believe for political gain). Ali S is a complete racist, AND HAS NOT CHANGED AT ALL FROM HIS EARLIER RADICAL DAYS. GET OUT AND VOTE FOR WEILL TOMORROW, bring your friends and pray hard that others will do the same!

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear.
