Warnock & Madison County settle for half a mill

Rudy Warnock issued the following press release:


SETTLEMENT OF LITIGATION

CANTON, MS, DECEMBER 20, 2016 – Rudy Warnock, P.E., Warnock & Associates, LLC, the Board of
Supervisors of Madison County, and County Engineer Dan Gaillet, P.E. have reached a $550,000 settlement in a breach of contract and copyright infringement lawsuit pending in federal district court in Jackson, Mississippi, over invoices that were due from Warnock’s time as County Engineer for Madison County.

In commenting on the settlement agreement, Warnock’s attorney Dorsey Carson said, "During the last decade, Warnock & Associates has engineered and constructed the best roads that Madison County has ever built, and did so with the lowest rates on the market. The settlement allows Mr. Warnock and Warnock & Associates to put behind the expense and distraction associated with this case, and continue providing excellent engineering services for other clients in the Jackson metropolitan area and throughout Mississippi."

Rudy Warnock said, “We consider this a hard-fought case and are pleased to reach a mutually-agreeable resolution.”

In settling the case, neither Madison County nor Warnock admitted any allegations of wrongdoing.

Am I mistaken, orison's he still doing the lions share of the work for the county? If so, when is the thievery going to end.

Rudy has been audited by Pickering...the County...and Rudy under billed for his work.

11:53 is correct. It's not illegal if the client agrees to it. Kinda like NASA and $500 toilet lids. So nothing to see here.

So while it wasn't illegal for the County to sign a CEI contract on Phase 2 of Reunion Parkway for 20% fees, plus charges for pickups, cell phones, and every other "add on" that one can imagine, it was irresponsible.

The only consolation for the taxpayers is that Rudy was sent packing with that group of irresponsible Supervisors.

If you do not like the way a law is written or what a law provides...then attack the law.

To attack the person who complies with the law as a "thief" is legally actionable and I am tired of hearing folks say spew this type of rhetoric.

The next person who says a law abiding citizen is a "thief" should be sued and made to be miserable for a very long time.

I've always been curious why people get pissed about Rudy? He sends a bill and the county paid it. If you don't like all the money spent then get mad at the board of supervisors. They could have used any engineer to do the work and the money paid out would have been the same. The board set the agenda.

3:10, I agree! Too often, people want something done, they sign a contract to get it done, and when it comes time to pay the AGREED amount, they either (a) feign amnesia or (b) try to renege on what they agreed to pay! You can decide someone's fees are too high BEFORE you contract with them, but not AFTER they've performed the work you've asked them to do. Now, if they don't actually do the work they agreed to do, that's a different matter; however, if you just have a change of heart after they've performed the agreed-to work, you can just go pound sand.

In the end, some people decided they no longer wanted Rudy as the County engineer. That's fine. That's their right to select someone else........but don't think for a minute it's alright to deny payment for work already performed. This was a sound judgement.

(By the way, I've never met Rudy. I've just experienced this same "change of heart" from people with whom I've contracted in my business. I, too, have had to sue people over it, and I, too, have prevailed. People should be made to honor their obligations.)

The difference between Rudy's posts above and reality is that to be legal, he would have needed to perform the work for which he billed the county. Take the ridiculous 'airport study' for which he billed millions. There was little work actually performed by W&A, and everyone (including the crooks on the Board of Supervisors) knew that there was not going to be an airport. Same with many of Rudy's other projects. Just like the crap he is pulling at CMU now, claiming an emergency of sewer overflows needing his million dollar study.

4:55 Do you even realize you supported the point I was making in 4:05? Example: If "the crooks on the Board of Supervisors" (your characterization of them, not mine) (a) knew there wasn't going to be an airport, (b) hired Rudy to do a study for an airport they knew wasn't going to materialize, and (c) Rudy did the "ridiculous 'airport study' for which he billed millions and for which little work was done" (again, your words), why shouldn't Rudy have been entitled to be paid for that work? The BoS and Rudy agreed to the terms, and it wasn't up to Rudy to tell the BoS that "No way am I going to do the work on what I see as a boondoggle!" Hell no! He's going to do the work and expect to be paid.....and rightfully so!

If you have a car that you would take $10,000 for, and someone comes by out of the blue and offers you $15,000 for it, are you "likely" going to tell them "you know, I would have taken $10,000 for it, so that's all you've got to pay me for it." I didn't think so!

I blame this squarely on the BoS for making bad financial decisions. No one held a gun to their heads and made them authorize the expenditure of that money. However, once they DID make that authorization, Rudy was entitled to be paid for it......just like either you or I would have been had we been in that same situation.

That's the only point I was trying to make. Now, had fraud been discovered, my position would be TOTALLY different, but barring fraud, the man was entitled to be paid. ALL of it! (Disclaimer: my position is based solely on what information has been made known to the public. There certainly could be other factors of which I am unaware)

Legal/Illegal. Forget that, what matters is this the behavior of a professional bound by ethics and honor. Was what he did in the best interest of the public? Rudy stands on the very edge of the law and fails when it comes to professionalism. And while he might have designed some good roads, he certainly didn't build them. He was extremely well compensated for his work. Personally, I would not want to know him any better nor any longer. He is just too greedy and considers that smart. He is an engineer whose parallel is the ambulance chaser in the legal profession.

It's all rather simple and most everybody whose breath can fog up a mirror knows it. The unscrupulous board members approved all this mythical work knowing it would bring them personal returns in the form of Christmas envelopes and campaign sponsorships. How damned complicated can this be?

Well, it's Christmas week and there won't be any envelopes under most trees. A few....but not most. If you people really want to spend your time productively, going forward, figure out which trees will still have envelopes on the lower branches.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
