Police punch man at LSU-Ole Miss game (Updated)

Updated with witness statement  posted below.

A security officer punched an Ole Miss fan in the face at Vaught-Hemingway stadium yesterday during the LSU-Ole Miss game.  Holly Barnes, the wife of the victim, posted this message and video on Facebook:

My husband, a two time Veteran of the US Army National Guard, was wrongfully assaulted on campus during the Ole Miss vs LSU game by a POLICE OFFICER. He was hit twice in the face and then arrested. THEY DID NOT GIVE HIM MEDICAL ATTENTION. Four hours later once he posted bail, he asked his friends to take him to the ER. He was diagnosed with a concussion, fractures to his orbital wall and maxillary sinus and contusions to the tissues of his eyes. This all stemmed because the officers thought he did something that someone a few rows up did and blamed him and his friends. I’m disappointed in the University police department and the Oxford police department for letting this happen. YOU ARE NOT ABOVE THE LAW. THIS IS NOT OK. Please help us get justice by calling out this police officer! I want his NAME AND BADGE! Please help me get this to the media by sharing. Thank you. Pictures posted in comments.

She posted a picture that shows his injuries:

He is a soldier as well.

The Ole Miss police department issued this statement:

The University of Mississippi Police Department is aware of the video of an incident taking place at the Ole Miss-LSU football game. The officers involved are not officers with the University Police Department, but are certified officers from other jurisdictions hired to work security at home football games. The University of Mississippi Police Department takes this situation seriously, and is currently investigating the incident. We encourage anyone that witnessed the event to contact the department at 662-915-7234 or email us at upd@olemiss.edu.”

Kingfish, please keep us posted with details. Hard to tell any thing from the video except there were 3 or 4 security types there. Does anyone have a video of what supposedly was going on behind this fan? Or, lacking a video, what was alledged to be happening?

Trying to find out.

Typical for a Black Bears home game.

Looks like he was resisting to me.. It looks as though the cops were trying to take him out of area (somewhere) and he was tugging back.. So the police gave him a couple of "taps" to remind him who was in charge. Fan was probably drunk too.. Last but not least.. Army hand to hand combat training needs to include "bobbing and weaving" into their regimen...

There's two sides to every story, and the truth is somewhere in the middle. It's hard to believe that the man was just minding his own business, and then police officers picked him out of everybody there and just decided to whip his butt. But on the other hand, Ole Miss beat LSU. Go Rebels!!!!

Anonymous said...

Umm uhhhh no matter what he did, it's what the police didn't do that may see the light of a fat payday. You're supposed to get people medical attention when it's obvious that they need it. According to her, they didn't do that.

Come on Oxford, you DO have a peddley little law school up there. Time to use some common sense. Call an ambulance or transport people to the hospital if they need it.

Ok dumb a$$ above, no where in professional law enforcement training does it teach to punch someone in the face (which can clearly be seen in the video). Was he drunk and obnoxious and cussing (probably so...it's a college football game...no excuse...just a fact). Should he have been removed from the game? Possibly. But, again, the law is supposed to be setting the example, not getting a big head & punching someone in the face. Do people get hurt in legitimate takedowns? Absolutely. However, that's not the case here. He was clearly punched by a person representing "law enforcement." I agree, lawyer up, get as many videos as you can, get some sworn affidavits from your friends, contact Ole Miss' lawyers and you'll get a pretty payout. And honestly-you deserve it. This video can be used in a "How not to..." Training video.

Off duty cops follow stadium and athletic department rules, one of which is to not punch with fists or hit with sticks. Handcuffs and restraint, ok. Sucker punch, not ok. Home team athletic budget pays for cops to work the games. Stadium rules apply.

On a related note, cops are not used to working venues where public drunkenness, open drinking and related misbehavior rules the roost prior to game time.....and then expect everybody to act all proper and shit after the kickoff. Cops be like "WTF?"

Anonymous said...

His buddies appear to be helping him resist arrest. But all the other fans are telling the guy to get gone. I must admit I have sat near people that I wish would get an ass beating.

If the cops want to fight drunk fans they should have to get drunk first. Drunk vs. drunk is a fair fight and almost always no one gets hit, much less hurt. Drunk vs. sober is a dangerous mismatch.

The truth is starting to come out. I knew there was much more to the story. The wife wants to make it sound like the officers just walked up to him and punched him. I don't think so! The local news reported that mama-in-law has hired an lawyer. By the way, what is a two time veteran? Got kicked out once for stupid s*#t such as this then rejoined?

Anonymous said...

News reported that the mother in law hired a lawyer? What grown ass man provokes and then gets his ass whipped and has to have his mama in law step in. This guy is a loser on about 19 levels. I'm a lawyer and generally don't like morons wearing badges, but this tool needs to grow up, he doesn't need a lawyer.

Anonymous said...

I'm 7:51, this is not an example of the real-world for how cops should be allowed to operate. The man showed no signs of aggression or violence. If you don't wanna hear someone drunk and cussing at a football game, then stay home. Mr. Witness, I'm sorry but this doesn't justify strong-arming any individual just because he doesn't abide by your version of the 1st Amendment.

Anonymous said...

I HATE cops. But a cop in a football stadium is not going to punch someone who knows how to treat the cops the way you have to treat them. You don't get to argue with cops. Especially when you are drunk. Just say yes sir, and keep your mouth shut. NO exceptions. In the video I saw a very drunk guy talking at the cops. Big mistake. Drunk guy should have sat down and shut up. Drunk guy needs to find anotbher drunk guy to fight like the Misshippi St fans at Ark.

Anonymous said...

The vast majority of cops are nothing more than hotheads that love the power a badge and gun gives them, and they're too stupid to get a real job. As long as we pay our officers a salary at the bottom of the barrel, then we will continue to have officers from the bottom of the barrel.

I was in the Walmart parking lot in the City of Madison. Saw a Cline Tour Bus and lots of men and some women standing outside wearing black. I asked one of them where they are going. One of the guys said they are all in law enforcement and have been hired to work security at the Ole Miss game. He went on to say many work for JPD, Hinds County and from other law enforcement branches. Those working security at Ole Miss ARE law enforcement officers and just not a security guy and/or mall cop.

Anonymous said...

I ashamed the wife is playing the veteran card, and believe he got what he deserved.

Anonymous said...

I love how so many of this douchebag's defenders believe that excessive drunkenness and liberal profanity are actually the norm at football games. They're not. I suppose this is a teachable moment, though: the rest of the state (and most of the conference) is embarrassed by UMiss precisely because of these spectacles and the knee-jerk defenses of them. Again, it's embarrassment; not jealousy or envy. For a fanbase that regularly crows about class and sophistication, y'all sure do seem to get caught showing your asses a lot.

Anonymous said...

1130pm. Sure does. Of the two accounts the wife and the witness, I think I will go with the withess. The video shows really nothing, but why would the security even have been there if he was behaving properly? Also, him being in the National Guard and a veteran has nothing to do with him making an ass out of himself at an Ole Miss football game.

Anonymous said...

7:20, you still don't get it. Being an ass does not justify getting beaten to a pulp. This is not North Korea. I don't have to act like a trained dog when a cop walks by. He should have been escorted out, if anything at all, not punched whatsoever.

However, he was suckerpunched twice while they held him down. How brave of them.

Anonymous said...

I'm certainly against cops punching citizens for no reason. But I'm more against drunk jerks using really strong profanity at a game around my wife and children. He's got a fat lip not a severe concussion. Go home sober up and be grateful you didn't really get your ass kicked. The fact that "mama" is stepping in for a grown man tells you a lot.

I'm not sure I believe the story about the Kline bus. I have a relative who is a policeman who works all the Ole Miss home games, as do many other off duty policemen from an area within a seventy mile radius of Oxford. The same is true of other college football games.

I doubt they bus them in from Jackson though. These are men and women who are trying to make extra money on days off. They provide their own transportation, uniform, and, if armed, weapon.

They are under the jurisdiction of the school on these occasions, regardless of the uniform. Their day starts at 6:00 a.m. (earlier for a morning or noon game) and doesn't end until way after dark. They're not their to cheer or watch the game or tolerate shit heads.

That said, the officer should never have punched the man and he'll be called to task for that. At minimum, he won't work another game.

Keeping order in a 65,000 seat stadium must be just a little stressful. Police work in general is stressful. He was asked to leave, he didnt--all bets are off when you are yelling at stressed out cops. He's lucky he wasn't tazed or shot.

8:23, A cop doing something like this on the street in a 1-1 or 2-1 encounter is a world away from a cop encountering a drunk/belligerent man in a 65k seat stadium who is openly defiant and disrupting everyone around him. The potential for harm to others is escalated. That's how melees are created. You're asked to leave, and you don't, well you deserve a tap and if one doesn't work, a double tap will do. I would have done the same thing. Completely justified.

The wife here is the worst. How sad it must be to have to cover up your idiot husband's drunkeness.

If you have any experience on the bottom of the American economic system, you know things are different, and clearly you lack a full education on how America handles its different classes, and this guy just a got a taste of how it's done. (Actually this is a bad analogy as it reads like this guy earned his fair and square and you are just a little miffed "a guy who wasn't supposed to be treated like this" was on the receiving end.)

as a former ole miss student, and fan. Ole miss is quite honestly the worst place for obnoxious loud mouth drunks. I know every school has them, but ole miss definitely has more than any place in the SEC. I have taken my son, who 11 years old,to just about every SEC venue in the last 2 years,Oxford was the only place, between Baton Rouge, Auburn, Starkville, Tuscaloosa, Fayetteville, Gainesville, Columbia, Athens, and Nashville that we ever had to call security because every other word coming out of this aholes mouth was the f bomb. We heard stuff at other stadiums, but not to the extent in Oxford, which is terrible, because Oxford is an awesome place. Not knocking Ole Miss, just my honest perspective. Like I said every school has them, maybe went just caught them on a bad day.

As for the jerk above, when the police/ security tell you to do something you either do it or face the music, I doubt the officer woke up that morning saying hey I feel like punching some drunk asshole.

Never heard anyone complain when this happened in Oxford... Look like too much force to me for just tossing a little popcorn ..link below

A few brief observations:
First, it appears (from witness account)the spectator was clearly causing a problem...he was IN THE WRONG.
Second, the LEO reacted (notice: not "responded") inappropriately to the spectator's behavior.
Third, wife and mother-in-law are not helping matters.
Fourth, regardless of the LEO's inappropriate reaction, the spectator/family probably will get a sizable settlement out of UM due to the LEO's actions. THAT is the worst part of this whole mess.

Why is everyone shaming the victim here? The man was ASSAULTED for what? Talking back to a police officer, and not even a real police officer on duty...a pretend mall cop that volunteered to look cool at a game and possibly score with a drunken Ole Miss chick. This was his way of asserting his authority.

His name WILL be revealed and he WILL face the proper charges. The officers made no attempt at restraining him peacefully. They are supposed to be officers of the peace.

I sense that there is some sort of 'bot' interpreting speech, here. I see the same sort of error in your post, that I see in the closed captions for foreign films. Is Ole Miss paying a (really cheap, overseas) firm to "monitor conversations" on the Internet? Are you a real officer? Do you let a 'bot' type your reports for you? That could be really dangerous. "Those guys wear year best..." Something here is VERY WRONG.

Did you not read the WITNESS account of this incident? It hardly appears the spectator was a completely innocent victim in this mess. Granted, the officer appears to have exceeded proper procedure, and there is very little if any excuse for that.
However, you have access to a very limited video clip, without benefit of audio and/or what behaviors (on BOTH sides) led up to the "punch."
Also, you must have access to a world of information regarding game security officers, who they are, what training they have, etc., or you would not be making comments that seem to be totally baseless. Must have fresh batteries in your crystal ball, Bubba.
Someone with your take on this matter is most often a person who despises law enforcement (read: authority) in general.
Or...maybe it's the rest of us who are clueless, but I think not.

Anonymous said...

The FBI has been calls in to investigate by ole missy

And The Bottom Line Is... said...

Nothing here is relevant other than the fact that NO police department protocol calls for or allows a police officer to punch somebody in the face. None. Period.

It's totally irrelevant whether you love or hate police, what you think about drunks, who insulted your wife at a game, how you feel about unruly people or what you think about the stress officers are under.

At the end of the day and at the end of the game, the officer who decided to punch this man in the face will face the music. As has been noted, he was not on duty in his official municipal capacity so he won't be demoted or otherwise sanctioned; but you can bet sweet Luther's mule's left nut he will never work another game in Oxford.

PS: Each officer working a game has his designation on his clothing. Either campus police, highway patrol, a municipal police department or guard service. Identifying these people is not rocket science. If they are not armed, they are more than likely guard service employees (renta cops). All should be obeyed. None have the authority to punch somebody. Period. This cop is exactly the kind of thug who throws somebody into a paddy wagon and gives him a concussion.

One thing for sure, since Ole Miss threw the officer under the bus and called in the FBI, they will probably have a hard time getting off duty officers to work security from now on.

The requirements for being a police officer in MS are pretty low. The age has already been lowered from 21 to 18 . And now a past history of drug use is not necessarily a barrier. The physical and agility tests are minimum as are the psychological tests. The educational requirements are a GED, ACT score of 15, or high school diploma or military service. You need a driver's license.

You can be " on the job" in small towns while awaiting an opening in the police academy class.

There are lots of job openings. It doesn't pay well.

This is like teaching. You will have some great people who simply are dedicated to the job and care more about what they do than what they get paid for doing it. And, then, you'll be filling the shortage with warm bodies.

So those of you who expect great training and a person with good judgment in a law enforcement uniform are likely to be disappointed.

As for this video, I can't tell. But, common sense tells me that 4 to 1 should be an advantage in taking down an unarmed drunk without having to punching him in the face.

I would remind everyone that we have had ISIS wannabees in MS. I would remind that large sporting events are a target.

The question isn't who's right or who's wrong in this dust up, but whether we are doing enough to recruit and train and pay those we expect to protect us? We need smart, well trained law enforcement with good judgment. How will we get enough on board?

Anonymous said...

"they will probably have a hard time getting off duty officers to work security from now on. "

They will definitely have a hard time recruiting off duty officers who think it is ok to punch an obnoxious drunk in the face because he is mouthing off.

How is that a bad thing?

Col. Reb Sez said...

It's funny how different people see the video and see different things. I don't see a massive amount of resistance on the part of Barnes. It's more like he's jerking back and saying, "Hold on a second."

A friend of mine pointed out that usually when the cops come to get a guy like this he has generally pissed everyone off so much that they will be cheering for the police. These people don't seem to be happy about the way the guy is being treated at all.

I've seen the Matthew Vincent post that you've put up as an update. I'd live to know how close "next to me" is. Also, there are some people out there who see any drinking or rowdiness at all as obscene drunken behavior. I don't know if Vincent falls into this category. I've also seen another post from someone in the general area which backs up Barnes' version, as well as a Twitter post made during the game which just says he say a fan get punched in the face by a cop. Vincent claims in his post that security spent a considerable time asking him to "cool it." That certainly doesn't show up in the video.

I might also add that I have seen some posts on Facebook that some of Barnes' injuries happened while he was locked up in jail when he was beaten up by another inmate. I don't know if this is true or not, but it certainly doesn't relieve the university and/or county of liability, as they should have immediately transported him to the hospital, as he was clearly in need of medical attention.

No matter what the facts are, three police officers are supposed to be able to remove an unarmed, belligerent fan from a stadium without punching him square in the face with a fist. There is an older couple who looks at all of this first with a bit of detachment and then with a look of dismay. I hope the FBI is able to find out who they are and interview them, because I suspect they will be able to give the most honest telling of events.

Even if Chris Barnes did something wrong, he still did not deserve to be punched in the face, and he still had a legal right to receive medical treatment which he was denied.

The wife's statement regarding her husband being a "two time veteran" is weird sounding to me in that veteran status is earned for Active Duty, for other than training, not less than 180 days or 30 days in a combat zone. You can't get the status twice. Guess she is referring to his having mobilized/deployed twice with the Guard. That being said, she embarrasses me as a Guardsman of 36 years flipping out the "veteran" card. What's her point?? Does it mean he should get a free pass when being drunk and disorderly in public or that he deserves a police beat down less than the next guy? It is not germane to the event and puts all other Service Members in a bad light.
Next point, I'm also a cop for 34 years. Concur with other comments about striking the head/face. We are basically taught not to do it unless there is a lethal threat presented and no better striking target. Also bad PR is generated when you open up the head which tends to cause a bleed like a stuck pig.
I can say this for the young officer, this ain't your local high school Friday night football event. Unless you are well trained for this sort of venue and the stress it brings, you could screw up quick as apparently happened in this instance.

Anonymous said...

Both sides should have handled themselves differently. I don't think that is in question. The wife's comments about his "innocence" because he was in the guard, stopped drinking because he "didn't like it anymore", etc.....just make him (and her) look foolish.

Why didn't the officer just use his tazer instead? Maybe they aren't carrying one? If they aren't....they should be. Seems like a good way to subdue an obviously drunk patron who is disobeying an officer rather than coldcock him like he did.

God forbid the chaos that this would have created if he were not white.

Col. Reb Sez said...

Anonymous 10:17, If they don't have Tazers, I suspect it is because the university doesn't want them to use them. On rare occasions they can be deadly. I don't think the university ever dreamed that some rent-a-copy would just punch a fan in the face like that.

Also agree with your comment that he stopped drinking "because he didn't like it any more." No guy his age quits drinking because he doesn't like it. He quits either because he joins a fundamentalist church, is drinking way too much, or more likely because he drinks occasionally but to excess and does really stupid stuff when he gets drunk.

This investigation is going to provide us with some more information, but no matter how bad a light it puts him in, the fist in the face and denial of medical aid are just inexcusable, and dear God the university has gotten so much bad press over this.

I sure wish we knew who shot the video. They had a pretty good view of the whole thing and saw fit to post it somewhere where Barnes' wife picked it up. I'd love to hear their version of events to go along with the video. It would have been helpful if they had narrated a little bit.

ALL of you have forgotten what is going on in the world and the feds asked all sporting venues to beef up security because of terrorists. The cops were surely on edge and if you will notice, there was an awful lot of talking going on before the action began. I am sure that the cops were trying to talk him down and he wasn't having any of it. I guess we're going to have to start calling it "football rage," kind of like the "road rage" phenomenon. Back in my day, the only fights were between fans. This incident just represents the further fall into barbarianism on both of the men's parts. Parents, take care how you raise your children, if you do, indeed, raise them.

- games are very loud.
- so seeing a guy shout when talking to police does not equate with resisting, in my mind
- can anyone tell what the guy is actually saying?
- did police do a alcohol level test on guy?
- if I was a fan at a game and wrongly accused of being the trouble maker, I too would protest before being escorted out
I am going to guess this will all hinge on alcohol level of the spectator, and the charge should be (if any) resisting being thrown out of the game, not resisting arrest.

Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

This is definitely a Beaver production.
