DA drops prosecution on another high-profile drug bust.... after indictment.

The Hinds County District Attorney  dropped several charges against Marlon Williams after it claimed the state could not meet its burden of proof for conviction.  Hind County Deputies arrested him on March 19 for possession of 25 lbs of marijuana and possession of a handgun during the commission of a felony.  A grand jury indicted him on August 20 on the two charges.  However, the District Attorney filed an order of Nolle Prosequi on September 15 to dismiss the case.  The order stated:


The State is unable to meet its burdern of proof in proving the required elements for possession of marijuana and possession of a weapon by  a convicted felon, as in this case there is insufficient evidence as to this defendant because the co-defendants have assumed liability for possession of the aforesaid items.  Therefore, in the internest of judicial economy and prosecutorial liability, the State moves for Nolle Prosequi in this matter.

No one else was indicted in the case.  Thus there are no co-defendants.  You read that correctly: the District Attorney dropped the charges on this guy without securing the indictment or conviction of the "co-defendants" who "assumed liability" for the weed and handgun.  Law enforcement sources also told this correspondent that no one from the district attorney's office contacted the Sheriff's office about "fixing" any defects in the case.  JJ readers may remember this story as this correspondent was present when the arrests were made.  JJ reported on March 19

 The Hinds County Sheriff's office busted a drug operation at Williams Complete Car Care on 1555 W. Northside Drive tonight.  Deputies seized 25 lbs. of marijuana (street value is $6,200), a handgun, cash, scales, and other paraphernalia. This was the third drug bust made by Hinds County deputies today and the fifth one this week.  Deputies arrested Marlon Williams (35), Joshua Holly (29), Curtis Bozeman (33), and Odarron Washington (22).  The charges are possession of marijuana with intent to distribute while in possession of a firearm.

 Kingfish note: So yet again, law enforcement conducts a drug bust in the presence of the media.  The cops find over 25 lbs of marijuana and a handgun.  The guy in charge is apparently a convicted felon and had the handgun.  The case goes to a grand jury, indictment, then charges dropped. The scorecard for this bust is 1 dropped indictment, three non- indictments, and the cops get zero.  The question is why Judge Bill Gowan did not review this order more closely when it was submitted.

I'm not sure if its the DA is a pansy, or if its Marlon has more power. Would you pursue a case if it were likely that the criminal would make a phone call and seek vengeance on you and your family? Marlon could have a van full of Thad Cochran voters outside of your childs window in no time.

It is at least possible that this defendant provided information about other issues which are still pending which allowed this to dismissal to occur.

Arm chair prosecuting is real fun ain't it?

If someone doesn't like the result, run for DA.

I will note that the Feds can get the guy on the handgun violation, so any of you Federales sitting out there drinking coffee reading this here post....go fetch him.

And as one former prosecutor told me, you don't dismiss charges until you take care of the other defendants so as to ensure cooperation. But you know that, don't you? Of course you do. You're just trying to stir it up.

10:13 - its time for you to get a life. And a dose of reality. I was a Cochran voter, along with several hundred thousand other folks in Mississippi (and a hundred thousand metro area voters). Don't think any of us are hanging around outside of anybody's window.

This matter is about a thug. You and your other McD's need to realize that you lost. The election is over. It was fair and square whether you like it or not. Candidates lose all the time and move on - too bad you can't.

In the meantime - let's find a candidate for DA that has some balls, that is not in the pocket of the thugs, and that will prosecute this DA and his compatriot Graham and send them off to the jail along with the thugs that Shuler-Smith is not willing to put where they belong.

Respectfully, you have never been the DA of a county. You have no idea what OTHER information this guy may have provided in another case possibly in another jurisdiction.

He could not very well write down and tell Judge Gowan "defendant is currently helping secure the arrest of other drug kingpins in a 6 state area."

Think for a second.

And for God's sake, please assume the best for a minute. I know its hard to do in this jaded Drudge world...but come on man!

And, yes, I realize the worst is possible too....I am just hoping its not the case.

Are Marlon and Joe Williams brothers, or one and the same? Joe ran the shop and has always provided great service and more than fair prices. Would not suspect him of operating a drug market or being a part of it.

This whole matter is fishy including the bust itself.

Marlon must be grinning all the way to the bank. Can I assume the marijuana was returned from whence it came since the DA did not indict even though the GJ recommended it?
Robert Shuler-Smith should be given a random drug test.

Whatever happened to that big Utica pot bust a while back? The one with the white guy who looked so stoned in his booking photo. Never heard what happened to him. Wonder if the DA punted on that one, too. The arrested was named Brendan Craig Hammond.

Where not talking about Mexico... and that is not their #1 anyway, try cocaine maybe... anyway, 23 states have legalized it in some way shape or form.. DC just made it legal for recreational use, Oregon, Colorado... same thing... With Mississippi's very fertile ground, we would be dumb asses not to legalize hemp and medical marijuana.. of course that means we wont do it thanks to the uninformed bible thumpers in the state and they will choose to keep on popping their narcotic pills and taking more meds to treat the side affects caused by their meds.. all the while they could just smoke some weed to treat their ailments and get rid of their 15 other prescription drugs their taking to treat all the side affects caused by the pills they pop.. So to 718 I say instead of focusing on a poor country such as mexico to prove a point, delve into one of the 23 states that have legalized it and see just how much tax money is being generated... without doubt.. Mississippi's #1 cash crop would easily be hemp. Pharmaceutical company's have brain washed the masses to make u think you need 15 meds to treat what 1 single plant could do, without all the side affects and without the risk of killing oneself or others (alcohol)..
Do your research people!! This is an opportunity to move MS forward and generate money for our schools etc... Research and get out and vote in 2016!! And before anyone says "that's what we need is more dope heads on the street".. we average 88,000 alcohol related deaths per year in this country.. 88,000?? deaths related to marijuana consumption....0 (zero).. think about it..........

9:09 is spot on. I might add that marijuana was never made illegal with the health of Americans in mind. It was made illegal with the pocket books of big pharmaceutical companies, big timber companies, and big chemical companies in mind.

But keep screaming its bad because your government tells you it is and go take your pills.

He seems to be "slick as goose grease" LOL N you certainly never hear of any punishment. The one he shot (his roommate)in that pot escapade is now deceased. So no one to dispute anything this dude says.

1230 Mr Hammond is really pushing to legalize marijuana, contacting AG Hood etc. Wants to see the fields in the delta growing pot rather than cotton. Using what legal knowledge he halfway has to put this on the ballot for next election. Boy Boy Boy

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.
