About that ethanol vote: The rest of the story.

I slammed Senators Wicker and Cochran yesterday for voting against Senator Coburn's bill to eliminate the subsidy and tariff for ethanol. It turned out there was more to the story, which should come as no surprise to anyone. Any discussion of this vote must start with the Internal Revenue Code. The IRS states on its website:

"Sections 6426(a) and (c) allow a blender of a biodiesel (including renewable diesel) mixture to claim a $1.00-per-gallon credit against its tax liability under § 4081 (relating to the tax imposed on taxable fuel). The blender may claim any excess as a payment under § 6427(e) or as a refundable income tax credit under § 34. Similar rules apply to blenders of alternative fuel mixtures (§ 6426(e)) and to persons that sell or use alternative fuel as a fuel in a motor vehicle or a motorboat and in aviation (§ 6426(d)), except that the credit amount is $0.50 per gallon and the credit for alternative fuel is taken against the claimant’s tax liability under § 4041 (relating to the tax imposed on diesel fuel and alternative fuel). As an alternative to the payments and credits allowed under §§ 6426, 6427, and 34, a blender of a biodiesel (including renewable diesel) mixture may claim a nonrefundable income tax credit under § 40A (see Section 3 of this notice for additional information).

The Code provisions that authorize these credits and payments expired for sales and uses after December 31, 2009, but were reinstated by the Act for sales and uses during 2010 and 2011."

Translation: the ethanol subsidy is slated to expire at the end of this year. Mr. Coburn's bill would have moved up the elimination date from the end of the year to July 1:

"(2) Section 6427(e)(6)(A) of such Code is amended by striking ‘‘December 31, 2011’’ and inserting ‘‘the later of June 30, 2011, or the date of the enactment the Ethanol Subsidy and Tariff Repeal Act’’.

Did I screw up? Yes, I did. I made the mistake of trusting what I read in the media. National Review reported "The Senate voted down an amendment today that would have done away with $6 billion in tax subsidies for ethanol producers." The Wall Street Journal did not mention the movement of the expiration date from December to July in the bill in its coverage of the vote but for a vague quote by one Senator about the subsidy expiring at the end of the year. The reader would not have known Senator Coburn's bill accelerated the expiration date. Only Bloomberg and CNBC mentioned these relevant facts. However, conservative columnists such as Debra Saunders at Town Hall and James Antle, III at the American Spectator failed to mention the acceleration clause.

Pete Perry, Chairman of the Central Committee of the Hinds County Republican Party, called me yesterday to say Senator Wicker did not vote for the bill as the subsidy was already slated to expire at the end of the year and several companies had informed him it would complicate their tax planning as the expiration date was already codified. Mr. Perry also said contrary to what some may believe, Senator Wicker gets more support from the chicken, beef, and similar producers than he does from the farmers. Those groups all hate the ethanol mandates and subsidies as it drives up their feed prices.


So yes, I dropped the ball a little yesterday. Normally I would have read the bill and the code but instead just reacted to what I read in a couple of news stories and op-ed pieces and wrote a blog post. I can understand why Senator Wicker voted against Coburn's amendment and also why conservative Senators voted for it: do you end it now or in six months is the question. There is a movement by Senator Grassley and other corn lobby allies to pass a bill that will not end the subsidies but instead reduce them. In other words, don't kill it, just let it live until it can be revived to its former state. It remains to be seen how our two Senators will vote on his alternative if it comes to the floor for a vote. Stay tuned.

One additional note: Grover Norquist and his Americans for Tax Reform want to keep the ethanol subsidy because, are you ready for this?, they consider removing the subsidy to be a tax hike!!! So ending corporate welfare, which the ethanol tariffs and subsidies are, is now called a tax hike? This reminds me of the Democrats calling increases in Medicare spending "cuts" during their Mediscare campaign. Unbelievable.

There are two amendments up for vote today, according to Politico and Reid. How do they relate to the subsidy expiration? Politico wasn't exactly clear either....

The news just hit that the Senate voted to kill the subsidy. How did our Senators vote this time?

Oh well, so much for giving Cochran and Wicker the benefit of the doubt.

They voted against repealing AGAIN today.

Senator Cochran usually does the right thing for his constituents, Mississippians. He doesn't defend himself, but is a true statesman. Legislation is often more complex than the media makes it.

On an unrelated note, did you know that the esteemed Mr. Norquist, one of the intellectual god fathers of the conservative movement, has been shilling for radical Muslims for a decade?

Seriously. I quit my membership in the NRA because he's still a board member. Google "Grover Norquist Islam" and see what you get.

It's been the source of a running feud between him and Frank Gaffney, one of the heavyweights in the national security arena.

10:14, they voted against it again today? No surprise. Probably for the same reason. If the subsidy sunsets at the end of 2011 day before yesterday, it probably still does today. Ergo, not changing the rules in the middle of the year 'reasoning' two days ago would still be the same reasoning today.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.
