It looks like Dr. Smith will escape prosecution via the insanity route. The Greenwood Commonwealth reported:
A judge has ordered proceedings to have Dr. Arnold Smith committed to a mental institution after ruling today that Smith is unfit to stand trial and needs mental health treatment.
The ruling likely ends the criminal prosecution of Smith, a 72-year-old Greenwood oncologist who had been charged with capital murder and conspiracy to commit murder for his alleged role in a murder-for-hire scheme to kill attorney Lee Abraham. For more details, go to gwcommonwealth.com

It's pretty easy to fake insanity after an arrest. It's pretty hard for an insane person to develop the intricate plot this guy set up over several months.
Hopefully this keeps him off the streets as a clear and present danger to the public unless he becomes "sane", at which point he faces prosecution again.

This is not true, at least for several definitions of insanity. Paranoids by their nature are all about intricate plots.
