True the Vote seeks TRO, claims destruction and alteration of records occurred

True the Vote et al filed a motion for a temporary restraining order and a preliminary injunction against the Secretary of State, Mississippi Republican Party, and the election commissions of several counties*.  The 501(c)(3) non-profit orgranization also charged on its website

The plaintiffs make the same arguments made in the previous post but with a little twist:

The potential harm in this case may be of particular significance. Mississippians are fiercely divided over the outcome of the election. Their division stems from allegations the election was tainted by fraud. As of this writing, the Republican Party in Mississippi has yet to certify a winner of the election. Reviewing voter records under the NVRA is critical to determining whether or not the forgoing suspicions are founded. And, given the fundamental nature of the right to vote, any other remedy short of equitable relief would be inadequate in this case.

Further, Plaintiffs may suffer immediate, irreparable if the voting records made the subject of this case are in any way redacted or destroyed prior to their disclosure to the public..... (#25)

It bears repeating, Plaintiffs assert no harm to Defendants by virtue of a positive order restraining Defendants from tampering with or otherwise destroying voter records. Defendants are required to maintain the voting records3, and should not redact the birthdates from them pursuant to the NVRA. Thus, the harm to Plaintiffs greatly outweighs any potential harm to Defendants (#31)

True the Vote also issued a statement on its website:

"Defendant county commissioners have continued to violate federal law by preventing access to election records.  Now, we think we know why,” said True the Vote founder, Catherine Engelbrecht. "If the affidavits we now have regarding the destruction of election documents and other similarly stunning findings are true, then no Mississippian, no American, can trust the results of this election."
True the Vote will be providing the Court with dozens of full detailed affidavit reports, containing stunning evidence of election subversion, including:
  • Destruction of  voters’ absentee ballot applications and mandatory envelopes;
  • Illegal alteration of poll books;
  • Cross-over and double voting;
  • Absentee ballots marked “Accepted” but unopened.
“Based on all we have seen -- and all we have not been allowed to see -- we now believe that unless the Court steps in, illegal voting will go unchallenged, voters’ rights will be diluted, voters’ trust will be violated - and an unlawful and inaccurate election may be certified by the State of Mississippi,” said Engelbrecht.

Joe Nosef's response to The CL after reading might be the best and most accurate quote of this campaign, "I thought I was reading The Onion."

Obviously there was fraud, because all the proof of fraud is MISSING!

I can already see how this will play out. Want to bet a McDanielite or Tea Bagger gets caught breaking in to a clerk’s office in an effort to destroy some poll books so they can say “See!! Records have been destroyed!” It is inevitable with this level of fanatic denial and circular reasoning

It sounds like they are just chasing headlines at this point. So if they get Wingate to say "don't destroy election records" they can jump up and down "yay! we won!"

Maybe they can get Wingate to issue an injunction against murdering or raping while they are at it.

Keep gloating, this will destroy the MS republican party before it's over. Good riddance to false conservatism, your gravy train is coming to an end.

>>They're coming to take me away Ha HA<<

Laughed so hard I spewed cheetos all over my keyboard and underwear!!!!

Also this comment Obviously there was fraud, because all the proof of fraud is MISSING! is inaccurate. That my friends (the missing proof of fraud) is what usually proves a CONSPIRACY!!!!!

So the story to the " true believers" is going to be, " yeah, we won the election but the proof was destroyed"?

OMG

This is either classic paranoia and these folks are dangerously insane or they are con artists!

" I found money left to you by a distant relative, but I'll need you to send me money to find it. I'm sorry but someone else pretending to be you got to the money first. But I tried to recover it for you."

Are you TPs really this crazy or naïve?

These people should be disbarred!

I voted for Thad but it was because he was running against McDaniels. I thought he was a nut and would not want a Bilbo type again in Washington. I have been proved right. I want change in Washington but not at ANY cost. The famaous tea baggers have been all in the media but Washington hasn't changed one bit. Really what has ted cruze do except a two day filibuster and be on Hannity. Mississippi has been last all my life and McDaniels has been in the Senate 10 years. What specifically was he responsible for in changing the direction of Mississippi.

These people are asking you to believe that something that never existed, did exist but was destroyed.
There are no documents, no eye witness, no mathematical indications... nothing to indicate what they are asking you to believe existed.
They know you WANT to believe it so they hope to get money under the false pretense of helping prove what you want to believe or to reward them for having tried to prove what you want to believe.

Even worse, they have played on your fears and offered you false prophets who will make all your fear go away . They don't tell you how they will do that but assure you they will stand between you and a bad fate and be your savior. They ask for unquestioning loyal and your money to make that happen and in return, they will give you this safer world.

They are playing you for fools.

Joe Nosef's response to The CL was not the kind of response I would expect from a GOP official who was certain that all has been above board and proper in this vote.

I would expect the GOP head to be saying...lets move this forward. Lets get these questions out of the way. Let us show you (foolish questioning types) that the results are correct, fair and legal.

Instead Nosef is mocking the folks that have the temerity to question an important vote in which there is a whole lot that DOES NOT look good form the outside.

Nosef sounds every bit the political hack(...skilled in the techniques of Alinsky).

First, this is akin to asking someone "have you stopped beating you children." Which I expect the Tea Party people to accuse Cochran of next.

Second, 6:48, have you actually read up on Reagan? 'Cause I really don't think most Tea Partiers have.

Last, 7:59, thanks for confirming what I've always suspected about Tea Partiers. Enjoy your next mock bunker raid.

Attack you accusers by screaming and ranting about what idiots they are. Call them names while declaring your innocence and while you are about it try to deny them access to any evidence that might prove their accusations. If all else fails, destroy any documents or records and deny any knowledge of their existence. If you tell a lie loud enough and long enough it will be accepted as the truth.

That might work sometime, but not this time!

I see that the case is assigned to Judge Wingate. He's a very thorough judge. He'll probably rule on the motion in September - of 2016. ;)

Let me tell you a little something about Henry T. Wingate....these folks better be ready to put on proof...tomorrow night at about 5:30 PM. Yes, he will call you to his courtroom on Friday at 5:30 and will hear evidence well into the night. I've been there.

Henry T. has changed his whole latitude and is moving things quickly.

He is not deaf to this issue and is meticulous. Truly a pleasure to have matters in his court these days.

I'm sure that a Yale Law grad and veteran of Virden Addition will be glad to hear the wails of a rich Texas white woman about voters rights and those "liberal Democrats" trying to vote. US District Judges love antics, hyperbole, and wild exaggeration. In Texas, maybe. Oh, boy. This will be great. Go right ahead. Bless your little "patriotic" heart. Read Judge Wingate the riot act, sister!!

I'm glad this is happening. Appreciate True the Vote helping down here.

Don't care if you voted Cochran or McDaniel. If the voting process has crap all over it, then it needs to be cleaned up.

11:42 PM, this appears to be a case of a few con artists manipulating some insane folks, so a little of both.

I think 9:03 (July 9) summarized True The Vote the best. And if they can take it a step farther, they will actually "find" stuff that wasn't there before they started, as in Ohio 2012, and extending Allen West's efforts in Florida last year. The only real favorable thing I can say about True The Vote is that Rep Elijah Cummings hates them A LOT, so they are not entirely useless. True the Vote President Catherine Engelbrecht, to me, is like "Orly Taitz-Lite". IMHO

I suspect you aren't a good parent so I want to file suit and protect your children and protect the integrit of parenthood.
I don't have any evidence or proof that you weren't a good parent other than the claim of a few folks who don't like you.

THAT'S what True to Vote is doing.

This isn't about the integrity of the voting process! This is about being troublemakers in hopes of making themselves seem important.

We aren't " protesting too much" we are trying to keep you from further embarrassing yourselves and all Mississippi!

You are feeding the bears!

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

This is definitely a Beaver production.
