The courtroom scrum between Jackson and several companies accused of dumping highly acidic wastewater into its sewer system is postponed. Jackson withdrew its Hinds County lawsuit against Gold Coast Commodities, Walker Environmental Services, and Partidge-Sibley Trucking on June 16 after filing the lawsuit a week earlier.
Jackson's attorney, John Hawkins, submitted a notice of dismissal to Hinds County Circuit Judge Winston Kidd:
Under Mississippi Rule of Civil Procedure 41(a)(1)(i), Plaintiff, the City of Jackson, Mississippi (the “City” or “Plaintiff”), files this notice of dismissal and hereby dismisses its Complaint (Doc. 2) in its entirety without prejudice.
Kingfish note: Jackson probably discovered defendant Andrew Walker and his company, Walker Environmental Services dba Rebel High Velocity Sewer Services, filed a bankruptcy petition in 2019. The case is still active on Bankruptcy Judge Neil Olack's docket.
Jackson will probably refile the suit in Hinds County Circuit Court without defendant Walker or file it in bankruptcy court. Earlier post on lawsuit.

Is or ain't. So what. Bottom line is Jackson's attorney did not do his due diligence to discover bankruptcy petition filed almost three years ago. Jackson circle-jerk continues unabated.
The City and John Hawkins are going to light up the scoreboard in this case, like the City did in the Siemens case. Far from a “circle-jerk.”

I doubt the bankruptcy is the reason for the dismissal of the entire lawsuit. He could have dismissed only Walker and left the other defendants. Some other reason for entire lawsuit dismissal.

8:55, the only entity that lit up the scoreboard with Siemens was the Birmingham lawyers and their local facilitators. Siemens simply walked away via refund. No accountability for their contributions to a failed system, no interest on the bonds, no look at intentional (criminal ?) actions of anyone, Siemens included.
The City’s Siemens victory is equivalent to paying a high-priced football coach to win the obvious game 6-0. Think of Jim Harbaugh v. Northwestern, not Nick Sabin v. The Field. Scoreboard was not lit up.
$60 million net recovery is lighting up the scoreboard. In the history of the Hinds County Circuit Court, there cannot have been over a handful of settlements in the $90 million range.
Sure the City’s lawyers got paid their agreed upon contingency fee. So what? That always happens. News flash: John Hawkins will get his agreed upon contingency fee when the case settles.

When there are no "positive things" to acknowledge one can not be refusing to do so.
The law firms that represented the City in the Siemens lawsuit did a fantastic job securing a $90 million settlement. Nobody can credibly disagree with that fact. Everything else is just noise from the peanut gallery.
Perhaps the Siemens attorneys knew they didn’t stand a chance with a Hinds County jury. Just sayin. Not knockin’ the plaintiff’s lawyers.

You were correct, Kingfish. Suit was re-filed yesterday in Hinds County without Walker and his entities. Added a new defendant, Louie Garrett. Case # 21-398.
