21 years if the question is asked in Hinds County. Hinds County Assistant District Attorney Greta Mack and Circuit Judge Winston Kidd approved a plea bargain that will allow Marcus Mallett to only serve 21 years in prison after he pleaded guilty to 2nd Degree Murder in the death of Shanitra Ramsey.
JPD charged him with allegedly killing 21 year-old Shanitra Ramsey on February 5. JPD also charged him for shooting Ramsey's friend several times as he fled the scene. Louisiana Wildlife and Fisheries agents arrested Mallett the killer a week later during a traffic stop. Earlier post.
A Hinds County grand jury indicted Mallett for first degree murder for the death of Ramsey. It also indicted him for aggravated assault, carjacking, and shooting into an occupied vehicle. Ramsey and Joshua Ledbetter were in the vehicle when Mallett began shooting. He shot Joshua Ledbetter as he fled. The indictment included a classification for Mallett as a habitual offender.
Mallett knew Ramsey. Media reports at the time stated the case was one of domestic violence.
Mallett had previous convictions for auto burglary, identity theft, and auto theft ( To crimjust reform advocates: The first convictions were for "non-violent" crimes. Now he killed someone and shot someone else. Think this guy shouldn't be classified as a habitual offender?) Earlier post on convictions and mistaken parole.
To make matters worse, Mallett was supposed to be in prison when he murdered Ramsey. He was paroled on November 21, 2014. He was convicted in Madison County on August 3, 2011 of several felonies and sentenced to serve 12 years in prison. He was later indicted in Hinds County for escape and several charges of auto burglary. Clinton PD issued a "detainer" on Mallett. Clinton PD withdrew the detainer on November 13, 2014 as he had served his short sentence. However, records show the Parole Board was not aware of the withdrawal nor that it was related to the expired sentence and released Mallett- thinking he was going to stay in the criminal justice system. Mallett instead returned to the streets where he was able to kill.
Mallett pleaded guilty on December 3 to second degree murder. The District Attorney accepted the plea. Judge Winston Kidd sentenced him to serve 40 years in prison but suspended 15 years of the sentence and gave him credit for time served. 25 years thus becomes 21 years. Mallett will be 51 years old when he is released from prison for killing Shanitra Ramsey. Judge Kidd also, get this, ordered him to undergo alcohol and drug treatment as well as anger management classes while in MDOC custody.
The charges of aggravated assault, carjacking, shooting into an occupied vehicle, and convicted felon with a firearm were all remanded to file. A clarification order stated
THIS CAUSE came on to be heard on Defendant Marcus Mallet's Motion to Clarify Sentencing Order. The Court, having reviewed the motion, and, after a hearing on this matter, finds that the Court's deviation from the maximum sentence for the crime of Second Degree Murder was based on the recommendation of the State along with the agreement of the victim's family.
IT IS, THEREFORE, ORDERED, and ADJUDGED, that Defendant's Sentencing Order is hereby clarified to reflect that the Court's deviation from the maximum sentence for the crime of Second Degree Murder was based on the recommendation of the State along with the agreement of the victim's family.
Attorney Derek Martin represented Mallett. Assistant District Attorney Greta Mack Harris prosecuted the case.
Kingfish note: MDOC records state he won't be released until 2046.

Not a fan of Judge Kidd’s rulings generally, but he followed the State’s recommendation, like basically every other judge would’ve. There’s nothing to see here.
I am a green law student, can someone educate me (preferably a lawyer, not an armchair jack of all trades) on how and why it is possible via public policy and the constitution that such sentences can occur.
I read stories of similar light punishments in the UK and hope that our capital punishment system is not weakening at a similar pace.

How does Judge Kidd sleep at night knowing he is enabling these killers to terrorize Jackson. This kinda of liberal/libertarian justice isn’t just here. Cop was killed last week in Texas and the perp got a 150k bond. Oklahoma has released so many prisoners that the crime rate is going up.

1 in most cases judges in district take the recommendation, which is what the judge did in this case
2. The case appears to be a recommendation that the DA office made with the agreement of the victims family
3. The law in the state of Mississippi is that everyone gets credit for pretrial detention, so that's not Judge rule but that of the Republican legislators
3. 2nd degree murder is a day for day crime no early release
4. Sentence of 25 years to serve day for day is not bad sentence when state doesnt have to bear cost of trial and an appeal
