On August 27, 2025, Smiley was sentenced to 21 months in the custody of the Federal Bureau of Prisons, with 3 years of post-release supervision. Smiley was also ordered to pay $120,747.28 in restitution to both Ally Motors Insurance and Mac Haik Ford. This case was investigated by the Cyber Fraud Task Force, an initiative of the Mississippi Attorney General’s Office in partnership with the U.S. Secret Service. In 2024, the Cyber Fraud Task Force was instrumental in the financial recovery of more than $2.5 million for Mississippi victims. Note: The federal docket for the case stated on August 27:
JUDGMENT as to Mario Martinez Smiley (1), Count(s) 1, 21-month term of imprisonment, and a 3-year term of supervised release to follow, with the first 6 months to serve in a halfway house. Ordered to pay $120,747.28 in restitution, ($115,747.28 to Ally Motors Insurance and $5,000 to Mac Haik Ford) jointly and severally, with interest requirement waived; $100.00 special assessment fee; no fine ordered; Count(s) 2, 3, Government moved to dismiss.
The indictment states Smiley stole someone's identity and was able to obtain false identification documents with the victim's name but Smiley's picture. He used a bogus driver's license to purchase a 2023 Ford Shelby F-150 valued at $130,850. He made a $5,000 down payment on the truck at Mac Haik using an American Express number belonging to someone else. He used the stolen identity to obtain financing for the truck.

They are out there doing this every day-
Less than two years, for a $130,000.00 theft? For how long, will the Identity Theft victim deal with the fallout from this? Will his life EVER be normal, again?
Is there hope, for the Victim, of any monetary compensation?
wow ..... he made that look easy. and only 2 years in a club fed. to 5:04......to answer your question about restitution...........slim to none.
this is a real film- slammer professional.
god only know how many more times he did this and never got caught.
just like a stinking GD meth dealer ..........he may , and i stress may.........get caught on his 10,000th sale of the year.
Haven't priced pickups lately, but over $130,000? Wow.
Read it word for word. There is one word that should explain why it cost so much.
probably has to do with that 785 hp engine a Shelby hosts. Don't know for sure, but would certainly be my guess.
Anytime you see the word Shelby, it's never cheap.
