The family of the slain Vincent and Margaret Sherry vehemently oppose any compassionate release for Kirksey Nix from federal prison. Nix is serving a life sentence for ordering the 1987 murder of Circuit Judge Vincent Sherry and his wife, former Biloxi City Councilwoman Margaret Sherry.
Reputed to be a leader in the Dixie Mafia, Nix went to Angola for the 1972 murder of Frank Corso in New Orleans. Running a "lonely hearts" scam out of prison, Nix and his associated bilked hundreds of thousands of dollars out of gay men by placing bogus personal ads in homosexual magazines. Attorney Pete Halat operated Nix's trust account. $100,000 went missing in the account. Halat thought his law partner, Interim Circuit Judge Vincent Sherry, was responsible for the missing funds. Coincidentally, Sherry's wife, Margaret, was running for Mayor. The Sherry's were murdered execution-style in their home in 1987. A .22 caliber pistol was used and there was evidence a pillow was used as a silencer. The killings rocked Mississippi. The killer also submitted a "woe is me" letter to the Court that described his various health problems as well alleged remorse over how he had wasted his life. Earlier post with Nix letter.
However, the Sherry family is having none of it. The Sherry's daughter, Lynne Sherry Sposito, submitted a letter opposing Nix's release to the Court. The letter states:
As to Mr. Nix, my understanding is that he experiences difficulty with mobility necessitating at times wheelchair use due to left leg and knee problems as well as back issues. He also states to have a severe infection in his left leg and has no medical care, as he reports the on-site doctor retired with no replacement. Two thoughts on this: If he has a “severe infection” in his leg and no medical treatment, he should either be dead from sepsis by now or ready for an amputation (I am a 45+ year registered nurse.). This is just another of his manipulations. In addition, I believe he reports suffering from congestive heart failure, hypertension, diabetes, and sleep apnea. These are all maladies suffered by many 80 year olds, and many younger, as my husband has all of these. If he is as debilitated as he claims, perhaps he should be transferred from Oklahoma (where his relatives are, and that would care for him if he were released), to one of the federal prison hospitals. I do not wish to minimize his medical concerns, however, I do know there are numerous Federal BOP Hospital facilities i.e. Kansas and North Carolina off the top of my head. Has he asked for transfer to one of these facilities? I was informed years ago that there is evidence that my parents were the 6th or so people that this man has had (or tried to have) murdered from prison! Like my father, I was not in favor of capital punishment, as I mistakenly thought that when one was in jail for life, you were safe from them. There is even evidence that this man even turned himself in on a lesser charge to have an alibi that he was in jail when he had one of his co-conspirators, who was going “to roll on him” regarding another murder, murdered. This man is extremely bright, extremely dangerous, extremely manipulative and a true psychopath. He was already in prison serving a life sentence for murder when he was convicted and received a federal life sentence in the case regarding my parents. Please ask the Honorable Judge Charles Pickering if he feels this man should be given compassionate release. He wanted him in a maximum security facility where he could not bribe" "guards or use outside, crooked attorneys to do his criminal bidding, and where all his outside interactions were monitored closely. He was sent at one point to Fort Collins, Colorado, where my understanding was that he would be in his cell for 23.5 hours a day, and granted one-half hour a day for monitored outside exercise. He had a website up and running from there within a few months, professing his innocence and that of Peter Halat, who I wish to this day was not involved. However, with what was presented in court, I know it to be true! This man truly belongs in a Federal Supermax Facility! I have often wondered if my folks strong religious background saw them through that horrible night as they faced the evil, the power of Hell, their executioner, ordered by Kirksey Nix. Did they have a normal reaction of sheer terror? Did my father hope, as he lay dying in the family room, that somehow my mother might have heard the shots and gone out the bedroom window? Did he know when he heard the shots that my mother was dead? You see, my father sprayed arterial blood across the ceiling and down the walls in the family room in several directions. He did not die right away - as folks do not spray arterial blood 10-12 feet when they are dead as their heart stops pumping. He knew he was going to die, and he had to lie there unable to get help and listen to his wife of 37 years, his college sweetheart, be slaughtered. Was there any compassion for my parents? While I do feel it is a shame he was not executed for the Corso murder, which could have saved a lot of lives, I also feel strongly that this man should be released from prison when my parents can walk out of their graves.There are alternatives which would keep him in, and still afford him the medical care he purportedly needs. I respectfully request that this be your ruling. I can assure you that my entire family feels this way, and some even more strongly, as they have requested to know if he is released, when and where will this transpire. His actions were no those of anyone who even comprehends the meaning of the word compassion, and it would be a true miscarriage of justice for this man to leave prison anyway other than “toes up”. My ability to sleep through the night will only occur after these people are in their own graves You see, I hear everything, the air conditioner coming on, a floor creak, a family member coming in after his late shift. It is called hypervigilance. Despite 36 years of counseling – it has never gone away. It is likely to be a lifelong issue until these people are all deceased and explaining their actions to God who I doubt is so easily manipulated.

Anyone who hasn't read "Mississippi Mud" needs to read the book. It makes any John Grisham book look like "Run! Spot! Run!" I like Grisham's books. But "Mississippi Mud" is true and has more twists and turns than any maze.
Nix should never again breathe thin, pure, fresh, free air. His last breath should be that of the contents of the unflushed stainless-steel toilet in his cell.
Nix has already been transferred to MCFP SPRINGFIELD, which is an administrative security federal medical center. He should be able to get all of the help he "needs" there without him getting all of the help he "wants" on the outside. Leave him where he is until his sentence is completed with his death.

My chief memory of the grimy book, 'Mississippi Mud', is that everything in it - the town, the ragtag little "Dixie Mafia", the book's Author, and the Victims ("strong religious background" notwithstanding)- was nasty and disgusting.
As for Nix, a description of what he deserves, would not be fit to print.

Does anyone think there should be a way for the judge to sentence convicted murders to be buried in private in a prison cemetery? Behind the fence in life and death. Surely Nix has done everything needed to merit such treatment.
The prison supplied stone should be a cheap cast concrete stone with the lettering scratched in with a nail as the concrete cures. Made by his fellow prisoners. Stone should have his first initial and last name, the words "convicted murderer", his prisoner number, and the year of his birth and death.
Nothing else.

Cremation, with the cremains immediately placed in the dumpster at the last prison where he was in custody. His final resting place can be with the prison garbage in the landfill.

Halat was thrown a big release party in Biloxi when he got out. Sickening to see who showed up. Nix is a POS and being lenient on crime is why this country is so f’ed up.
