MAC suing Siemens (Updated)

MAC Construction issued the following press release:

MAC Press Conference Announcing a Multi Million-Dollar Lawsuit Against Siemens Industry, Inc.

Who: MAC and Associates, LLC

What: Press Conference

Where: Hinds County Court House

When: Tuesday, May 31, 2016 at 3:30 p.m.

Why: To announce MAC’s $37 Million Dollars Lawsuit against Siemens Industry, Inc. for Fraudulent Misrepresentation, Breach of Contract, Gross Negligence, and Interference with Business Relations, in regards to the $90 million dollars City of Jackson Contract for upgrades to its Water and Sewer System.

UPDATE: MAC sent out a second press release this afternoon:

 Jackson, MS (May 31, 2016) — MAC and Associates, LLC , a division of MAC Construction Company of Mississippi, LLC, will have a press conference today at 3:30 in front of the Hinds County Court house to announce that we have filed a $37 million dollars lawsuit against Siemens Industry, Inc., for fraudulent misrepresentation, breach of contract, gross negligence, and interference with business relations. The suit was filed this morning in the Circuit Court of Hinds County. “It is unfortunate that we had to take legal actions against Siemens, Inc., however, this is the only recourse we have to force Siemens to honor their commitment to
the City of Jackson and its contracts with MAC & Associates regarding the $90 million dollars City of Jackson water and sewer system upgrade”, said Marcus Wallace, President of MAC and Associates.

Siemens’ contract with the City of Jackson Equal Business Opportunity Plan (EBO) stated that 58% of the construction on the project would be African-American and 32% would be female. To help reach these goals, Siemens selected MAC and Associates, LLC to perform construction, sewer repair work, and water meter installation work, a dollar value of $20,328,920.00. In addition to the aforementioned reasons, prior to the City accepting Siemens’ proposal, Siemens committed to the City that it would mentor, train, and manage
local minority businesses involved in the project, which included MAC and Associates. Siemens did not honored this commitment. Therefore, due to Siemens’s negligence, MAC has filed a suit against Siemens for $12,000,000.00 for actual damages and $25,000,000.00 in punitive damages.

You might think a construction company may test the water meters before installing them? Not saying the Seimens meters reading gallons over cubic feet is their fault. But, a whole bunch were installed before anyone noticed. Wonder who the construction inspector was and their qualifications?

Just viewed their website. Clearly a product of Jackson set-aside contracts.

Sec of States website comes back to a Marcus Wallace. I wonder if this is the same Marcus Wallace that is the Mayor of Edwards? Is there any foul play being the contractor on a job like this and also being a political figure of a municipality in the same county?

More explanation of how the residents of Jackson got ripped off by Mayor Harvey (and of course, Councilman Tony Yarber) with their pushing the $90 million deal now known as "Seimens". Instead of contracting with Seimens to install the new system and repair the sewer lines, the city required that over half of the money be spent with an AA firm that needed to be "mentored", "trained" and "managed" to do the work.

Most businesses don't get paid for learning how to do the job, but as long as Harvey and company were spending the tax dollars of the few citizens of Jackson that still pay their water bills and property taxes why not? Made it easier for them to get "their share" along with ofcourse the pass thru dollars from Malichi and Porter Bingham.

If Jackson would start paying what it took to get the actual work to be done rather than insuring that the favored few that 'share the benefits' got a part, some of the potholes, drainage systems, and water lines might actually get fixed. But as long as Mayor Tony 'Forgiveness' Yarber is in charge guess we will never see that day.

Don't know if this is the same Marcus Wallace, but as long as the Mayor's job is not considered to be a full time position (which in Edwards, it would not be) there is nothing wrong with such a contract. You pose the question as if being in the same county makes any difference. Why should being Mayor of Edwards or Bolton be any different than being the mayor of Pelahatchie, or Star? Most small town Mayors have real jobs anyway (although I am sure there are plenty of examples to the contrary and Edwards or Bolton would be perfect candidates for such a case.)

According to the news Siemens was told they would need to give a contract to a person with no business and no experience to gain the contract with the city. The person who had nothing and received a several million$ contract was only going to observe so he could start a company that could bid on contracts. Oh yes, he had to be black. Didn't say if he had to be friends with or related to an elected official.

I am hurting from paying almost 20 grand in Jackson property taxes this year yet I can not bid on work for Jackson. Racist as hell.

@6:56 - think this shows why 'any company' would want to do any business at all in Hinds County. If you are the right company, here's the proof.

You don't have to do any work. All you have to do is have the proper connections - and, I assume, be willing to share in your windfall with all the right people.

Now, if you are talking about Seimens and why they would want to do business, the answer is a little more difficult. They have to pad their bid with enough extra to cover not just the cost of the do-nothing contracts, and the proper 'contributions' to certain individuals, and enough to cover a bunch of legal fees. Once you add all that in, then you take the job. Leads to - a $90 million contract for a $40 million project.

MAC gets a contract for which they have to be 'trained and monitored'. And, while sharing in the benefits hoping there is nobody from agencies with a few capital letters in their name 'listening in' on the deal. When Seimens gets screwed by the new administration then they don't pay for the work not done by the sub. Final result: Everybody gets screwed, except probably the former Mayor who covered himself on his way out of office - but the main group that got screwed were the Jackson citizens.

Why was it necessary for MAC to hold a press conference to announce they had filed a lawsuit? Many lawsuits are filed every day and other people and companies don't hold press conferences on the steps of City Hall to announce their action. Just wondering.

My question is this. Certainly this job had to be bonded. When a job is bonded, the job owner(City of Jackson and their respective parties) have to sign off on this job and their has to be a certificate of substantial completion signed off on by all parties and then forwarded to the bonding company to release a consent of surety. Now, correct me if I am wrong, but weren't their obvious problems with this BEFORE the whole job was completed? Also, while I don't know if MAC's bonding capacity, it takes some financial stroke to pull off a $20+million job without being "in the game" a while. Just assuming here but if MAC couldn't bond 100%, then Siemens would have to bond back to MAC their portion of the job. Someone had to sign off on this and knew there were problems before it was 100% completed.

That said, if there was a bond, why aren't they calling the bond company to make claim. If City of Jackson Equal Business Opportunity Plan (EBO) and the City of Jackson awarded this large of a contract to MAC without requiring a bond due to some EEOC/Affirmative Action Bullschit, then they deserve exactly what they are getting. You hire a contractor that doesn't have the financial strength or the mental capacity for this job all for the sake of keeping it "in the game(per a phrase on Mr. Marcus' facebook page)" then piss on you. Had a Yates, Hemphill, UCI, or any other big name white owned business been awarded the contract, then the project would have been insured, reinsured, and bonded to the Nth degree with no chance of this happening and not being handled; and not in the situation they are in now. Equal Opportunity my ass.

1:14, I don't think you understand what happened. MAC is a friend of a person making the contract. He has no experience. He has no company. He has no one working for him. For Siemens to get the contract they had to give MAC a sub contract. He didn't do any work. He only observed. The idea was for MAC to learn the business so he could then bid on other contracts. He was paid millions of $ for observing.
There wasn't any insurance, any bond.
To put this in the most simple of terms. Siemens had to kick back part of the contract. They did this by giving millions to MAC who distributed it to those who awarded the contract to them.

This is so typical of the "leadership" in Jackson. This has been going on for years. That jail in Raymond Stokes wants to yell about is screwed up at his hands. Years ago he stopped the SILENT bid process another company won and screamed that he wanted a minority co. to build that jail (clearly any minority co--ability to do the work has not even close to necessary) and we, the citizens, paid for a jail with no locks, no working plumbing, etc. . There have been a number of businesses that have not located in Jackson because of stokes and company trying to make these businesses sign agreements that they would hire a certain percentage of their workforce to be black. NO ONE stopped it over the past years NO ONE will now.
Apparently Kenneth has to much dirt on to many and/or (my belief) to many are scared of him.
I firmly belief stokes would not stop at anything to get his way and to keep as many white people out as he can regardless of the shitty work that gets done to this city. It was stokes that said "he did not want any more white people in his district" when Byrum was being annexed. The bidding "system" in Jackson needs to be investigated YET not one official will call for that out of fear of being called a racist.
This is NOT racist it is CORRUPT VERY CORRUPT business. It will continue because there is NO leadership in Jackson. NOT ONE has the BALLS or backbone to take on stokes, Hood and countless others to turn Jackson around.

I believe you are confusing two different crooks. The jail fiasco wasn't Kennuf, it was Bennie back when he was a supervisor. Same story, just change the names. Once Bennie made enough as a supervisor (at $29k/year) to become a millionaire*, along came Kennuf and continued the process.

(* Bennie's report when he entered Congress, where he went straight from being a supervisor, indicated a net worth of over $1 million. Not bad on his public salary.)

8:21 Thanks you I stand corrected. There is so much on all of them it is hard to keep the score board straight.
What I really have so much trouble understanding is stokes used to (may still) have rental houses/apartments that were so bad (no running water or flushing toilets etc)they were condemned. The pictures were worst than third world. He treats "his" people worst than we would allow the zoo to treat the animals; YET, they keep electing him.

WHY??Could someone shed some light on this for me? I truly can not grasp this.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear.
