Neurosurgeon (allegedly) smashes windows on doc's car.

The Hinds County Sheriff's office charged Dr. Michael Molleston with malicious mischief yesterday.  Dr. Molleston is a neurosurgeon.   The police report alleges that Dr. Molleston used an object to repeatedly strike an Audi belonging to fellow neurosurgeon Dr. John Davis in the parking lot of the Manship Restaurant.  The incident allegedly occurred on October 1 although it was not reported to police until October 31 (according to the reported posted below).


The report states that surveillance video recorded a "white Honda pilot" pulling up next to the Audi.  A gentleman than emerged from the car, and began swinging a "club" at the Audi.  Dr. Davis identified the gentleman as Dr. Molleston.  the windshield and two passenger windows were damaged.  A body shop estimated the damage to be $2,500.  Dr. Molleston posted a bond of $2,500.

Section 97-17-67 of the Mississippi Code states that the penalty for malicious mischief is:

 (3) If the value of the property destroyed, disfigured or injured is in excess of One Thousand Dollars ($ 1,000.00) but less than Five Thousand Dollars ($ 5,000.00), it shall be a felony punishable by a fine not exceeding Ten Thousand Dollars ($ 10,000.00) or imprisonment in the Penitentiary not exceeding five (5) years, or both.

Note: Readers might remember Dr. Molleston from this earlier story from the Wall Street Journal. He also sued St. Dominic's Hospital several years ago. The lawsuit was sealed last year.

So, you're a brain surgeon and this guy tried to ruin your career. And the best you could come up with was, "Beat the shit out of his car with a golf club"?

I understand that maybe you're not Walter White, but that's weak even by middle school standards of revenge.

Ya know 1:27, I've noticed the same thing! These specialists, who are, arguably, the most "learned" of physicians, are often the most bizarre members of that profession. I don't know what it is, but if you encounter a doctor who is bizarre or cheesy or sort of used car salesman-acting, more often than not, they're neurosurgeons.

Strange. It seems as though the specialty that is alleged to be the smartest would be the least likely to be that way.....but they're not.

Take, for example, that neurosurgeon in Brandon who had his license revoked a few years ago for, I believe, sexual advances on patients while they were under sedation......

I have a legal question regarding this quote from the WSJ article referenced above.
"Neurosurgeons nationwide are sued for medical malpractice, on average,
about once every two years. Dr. (Adam) Lewis has been sued for malpractice 18
times since 2002. He has won two cases at trial, lost one, and 10 have
been dismissed. Another five are pending, including one wrongful-death
suit."

Question: The ten cases that were "dismissed," is that legal-speak for settled? Or does it mean the cases were dismissed as frivolous?

It shows a complete lack of character, integrity and judgement on the part of Molleston. Of course this begs the question, is St. Dominics okay with having this on their hospital staff?

The Manship is a great restaurant. The restaurant and parking garage (where the round of golf was played upon Dr. Davis' car) is owned by Baptist Hospital. Surely there were video cameras which caught his round of Audi golf ? Looks like he "broke" par ?!?!

6:34 - It could be indicative of both. He could have "won" some or all of the cases and had them dismissed outright, or he could have settled, in which case both parties would agree to dismiss the case. So it's hard to tell.

Maybe things would be easier in central MS for Molleston if he hadn't spent those years in Hattiesburg alienating all of the Jackson neurosurgeons and testifying against them as plaintiff's expert in so many malpractice cases. Also, he went bankrupt. How someone can be smart enough to become a neurosurgeon and pull in over a million bucks a year and still somehow manage to screw that up is beyond me. I would not want a guy who exhibits such poor judgment operating on my brain.

The surgeon chooses the hardware and Doc's Molleston and Lewis, both mentioned in the WSJ article, continue to use hardware from Precision Spine, the successor of Spinal USA. Can't hang the hardware choice on St D - but the surgeon's choice. Doc Lewis' website boasts that he is on the Bd of Directors at Precision. The conflict of interests continues ...

Dr. Molleston performs surgery at a number of area hospitals (not just St Dominics), be curious to see if all of those hospitals are ok with him staying on staff.

Dr. Pat Barrett founded Spinal USA with Adam Lewis and Molleston.

Molleston and an Alabama surgeon/investor own the property in Pearl and lease it back to Spinal USA/Precision Spine (AL-MS). According to bankruptcy records, in some years Molleston was getting paid more from his Spinal USA distributions than Forrest General was paying him to be a surgeon.

So many of the spine surgeons get into financial trouble. Most are divorced. They aren't mentally stable people. This guy and Adam Lewis are perfect examples.

Who was driving the "white" car?? Hummm I think that needs to be addressed, like is that person being charged with anything. I am sure it is one of his girlfriends beings he is such a fine oustanding citizen of our community. His poor family .

Where is the Clarion-Ledger coverage of this incident? Wait...Molleston is on staff at St Dominic's, so I guess that St D has put pressure (direct or indirect) on the newspaper to keep it out. Like they did with the Adam Lewis debacle...the Wall Street Journal had to come to town to report on a story under their very noses.

However, the Clarion Ledger is "on top" of the story where Dr. Dulske and his wife had a party where high school seniors were drinking. They seem to have violated a "social host law". This is BIG NEWS, impacting the greater Jackson metro area.

But a neurosurgeon who rages to the degree that he (allegedly) commits a felony is not newsworthy. Taking a gold club to someone's vehicle in a fit of rage is less newsworthy than the "social host" law.

Really: what is up with this? One is a felony, one a misdemeanor.
