Court to Shack: Do not pass go.

Hinds County Chancery Judge Dewayne Thomas incarcerated Lakeland Place Cemetery owner Linus Shackelford after he failed to return $550,000 to the guardianship of De Mon McClinton. Judge Thomas ordered Mr. Shackelford to return the money or show cause why he should not be held in contempt of court at a February hearing.

De Mon McClinton is the grandson of Mississippi civil rights legend and former WLBT owner Aaron Henry. Mr. Henry's daughter died and 16 year-old De Mon inherited $3.5 million in 2001. Hinds County Chancery Court Judge Stuart Robinson approved Thomas McClinton as the guardian for De Mon. Thomas is the father of De Mon. The court ordered Mike Brown, the attorney for Thomas McClinton, to place the money in a FDIC-insured bank and further decreed no money could be spent without court approval. Unfortunately for De Mon, a great deal of money was spent without court approval.

Judge Thomas ruled at a February hearing Mr. Brown never deposited the money in an account nor was one ever established. Judge Thomas threw Mr. Brown in jail after he could not account for the money. A special master reported at a March hearing the money was deposited in several bank accounts, but the banks were never informed the accounts were restricted by the court. Special Master Paul Rogers reported Mike Brown, Thomas McClinton, and Linus Shackelford removed large sums of money which belonged to De Mon. Mr. Shackelford borrowed $550,000 from the estate in 2001 but never repaid any of the money. Judge Thomas ordered him to repay the money with interest at the hearing today.

The hearing started on time as Judge Thomas allowed Mr. Shackelford to make his case. Jeff Rimes, the attorney for Linus Shackelford, stated, "Mr. Shackelford does not dispute the amount in the Master's report. He disputes the interest." Mr. Rimes then said, "As of today, Mr. Shackelford has not been able to repay the money be we have the intention to. There is simply no ability on his part to pay the amount without the selling of assets which he has the intention of doing. " Judge Thomas replied, "Well, he has had twelve yeas and it hasn't gotten there yet."

Mr. Rimes said, "When he signed the promissory notes, he did not read them... He tried to work out payment with Thomas McClinton. He has suffered great challenges with his business that has also been a factor." Mr. Rimes asked for more time for his client to repay the money. Attorneys for DeMon McClinton, Brent Hazard and Precious Martin, did not make any statements, nor did Special Master Paul Rogers. The court recessed for ten minutes then Judge Thomas issued his verdict, a short statement dripping with contempt for Mr. Shackelford:

"Sometime in 2000, a guardianship was opened in this court. The child inherited $3.5 million. That money should have been deposited in an account. As we know from previous hearings, we know it was not. This court has been very upset with how this has been handled. Its something this court does not wish to do but has to do.

Mr. Shackelford, your actions in borrowing this money from a minor were wrong. The law is very clear. The statute is very clear. The court could not approve that loan even if it wanted to. We've asked you to show cause why you should not be in jail or paid the money back. As of 1:30 today, you have not paid the money back to the minor. What you and others have done to this minor is wrong. It's appallable and I wish I had never seen you." Judge Thomas then left the courtroom as bailiffs shackled Linus Shackelford.

Mr. Shackelford is imprisoned in the Hinds County Detention Center. Bail is set at $100,000 if he decides to appeal the order.

I've known Linus for several years and I would have a hard time believing he purposely used this money knowing it was an illegal loan. I hope my friend will be able to right this tragic misconception and the legal system will treat him as the mistaken user of unusable funds perpetrated by a misguided legal advisor.

This is not the biggest fraud he has committed. He has numerous situations just like this. Society is unsafe with him roaming free. He has hurt many people for years. You don't know the real Shackelford.

What about Thomas McClinton, what does the judge have in store for him? How long are these appeals going to take or is this going to give them te time to run with all the money? How did youngest these pictures?

Shackelford is a hurtful pig.  Treats those close to him like dirt. The pain he has put on others is not recoverable. No jail sentence can replace the damage.

Atty2, it is my understanding that the other sibling was 'of age' when mother died and his share of the estate went directly to him. Further understanding is that he has squandered a great deal, if not all, of his share. But - it appears he did as many others have done - he had a good time while squandering!

You say you have known Shackelford for several years and he would not do this intentionally.

Well, I have known Shackelford for decades and I am 100% certain that he would do this intentionally. He is every bit the low life crook that he seems to be in this case. Personally I am glad all of his scams have caught up with him and he is finally going to pay for it.

I hope DeMon gets at least some of his money back. But I doubt he will.

CL has it that Brown has a case in Holmes County and Rankin County they are investigating. KF, what is this about? Other posts imply this but how much more is there? Is Shackleford involved with these too?

I don't think Thomas McClinton is out of the woods by any means. The judge said they would deal with him on a "later day". Reading the list of checks and the special master's report makes clear he has some explaining to do. Yeah, he'll try to blame it on Brown- "he told me I could", but McClinton was in court that day when the judge issued his order. He can't claim ignorance. I think he will be in jail with Brown one day. Poor kid.

6:07 - the Holmes County case was filed by a man who paid Brown $200,000 to sue so his son's girlfriend could get money from a trust. Brown took the money but never filed the suit. From what I understand, that is a big part of the reason his law license is suspended, and could likely cause him to be disbarred.

Hey Shackelford! What if you died and left Millions to your kids and a developer did this to them. "Borrowed" the dough and didn't pay it back. Whatcha think should happen to him? I'm sure I know your answer.

They just made a stupid investment. Had they done any consulting beforehand they would have been warned it was a losing deal. There is a mobile home used for a funeral home. What were they thinking.

Ms Sutton, Please believe me. he was not framed. He knew what he was doing. He has a history of these types of choices. He has gotten away with it before so he and Brown were arrogant enough to think that no one could stop them. I am glad that he is at church and his church is a church that welcomes all, regardless of their character. However, attending church has never and will never make a person honorable. What makes them honorable is their character and integrity.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox.
