Attorney Barry Gilmer was convicted of disturbing the peace and discharging a firearm towards a dwelling in Madison County Justice Court this morning. Deputies arrested Gilmer on April 16 after he fired a rifle in the direction of his neighbor's house. Justice Court Judge Lloyd Spivey, Jr., sentenced him to serve twelve days in jail for discharging the firearm.
Gilmer argued he was protecting his property from his neighbor's vicious dog. He said the hound-mix got out all the time and was on his property when the incident took place. He admitted in court he fired at the dog with his shotgun. The pellets shattered a kitchen window. Two small children were behind a window adjacent to the one that was shot. Gilmer claimed a tree blocked the view of the complainant.
Judge Spivey ruled Gilmer was guilty of the two charges. He fined Gilmer $500 and sentenced him to serve six months in jail for disturbing the peace, but suspended the jail sentence. He fined Gilmer $1,000 for the firearm charge and ordered him to serve twelve days in jail. Gilmer must pay court costs. Judge Spivey delayed the sentences for thirty days so Gilmer can appeal to County Court.

This is nuts. Gilmer is a fine man. We sometimes make a wrong decision when animals from adjacent properties are involved and are nothing but a menace and nuisance. I have three feral cats that have taken up residence on my property now and am considering shooting them.
We will all be dead before this is over. Gilmer going to sue everyone... if he hasn’t already.. disgrace to the Bar.
Gilmer probably thought that since he was an attorney going in to justice court and a non-attorney judge that he would skate away on the charges. Who knows, Gilmer may have popped off to Spivey and that's why he got the penalty he got.
I personally think shooting towards an occupied dwelling should carry more of a penalty than it does.
2:48, two or three feral cats will have 10 to 20+ cats on your property in short order if you don't do something about it now. A woman that lives down the road from us let feral cats virtually take over her place until she tried to sell it. Out of curiosity I started counting the number of cats at her place, I quit counting at 40 grown cats. She had to hire someone to come trap cats and clean up and deodorize the property.
Feral cats are just as bad as feral hogs just a different type problem.

Judge Spivey is an uneducated fool. I heard this all started because Gilmer would not allow the so called victim to park his tow truck out of sight of the neighborhood who was going to enforce covenants. The guy got fired. Either way the Gilmer father and son duo will retaliate and I'd hate to be on the end of their money and wrath.

I wouldn’t shoot towards a house but I can understand the frustration of being accosted by someone’s unrestrained dog constantly and getting fed up.
Understand what you are saying about dogs. However, there is one fundamental rule of shooting above all others save for assuming the gun is always loaded. Know what you are shooting at.
Judge Spivey is not the "undeducated fool", you buncha' gun totin' REDNECKS! You should stop marryin' your own kin and quit shooting innocent animals and children. There are responsible ways of handling pet overpopulation. I'd be wasting my typing by explaining it to you...

@2:37 First, Spivey does not have a legal education and is a fool. Second, everyone knows that Pammi Hancock and those idiot judges over there are in cahoots. Don"t forget about the joint victory bash they had together where they sold tickets. LMAO. Third, I highly doubt Gilmer would just ride over and randomly shoot up a house. I heard the same story, the guy got pissed at Gilmer because Gilmer would not let him park some kind of truck on the property. My friend lives in that neighborhood and confirmed the dog is a nuisance and the truck story is legit. He used to see the two truck parked on the street.
Its not the dog's fault. Bleeding heart irresponsible pet owners are squarely to blame. Gilmer was totally wrong to shoot in the direction of the dog owners home and deserves more than that what Spivey gave him. When you ask a pet owner numerous times to contain their animals and they don't, the owner should be fined as well. I feel Gilmers pain.
@ 10:14, your an Idiot! First Gilmer shot a gun in the direction of the house plan and simple! Second Pammi Hancock never had a Joint Victory Bash with the Judges. It may be best if you learn the truth before you open your mouth! Gilmer broke the law and was Prosecuted! He actually should have received more charges.
I’m afraid if someone fired 00 Buckshot at my house with my kids inside I would have to return fire. The punishment he received doesn’t seem sufficient for such a reckless action.
