Mark Mayfield's widow and his family sued, take a deep breath, Lord Snow, Lord Snow CEO Don Clark, City of Madison, Madison Police Chief Gene Waldrop, The Queen, Madison Police Investigator Chuck Harrison, Madison Police Investigator Vickie Currie, Attorney Richard Wilbourn, III, and a bunch of Does. All government officials were sued individually as well. The lawsuit claims the defendants are guilty of kidnapping, false imprisonment, depriving the late Mr. Mayfield of his civil rights upon arrest, and other torts. The case is assigned to U.S. District Judge Carlton Reeves. Attorney Dorsey Carson represents the plaintiffs. The complaint is posted below.
Robin Mayfield filed a complaint for discovery against Richard Wilbourn in Madison County Chancery Court on January 18, 2017. Mr. Mayfield committed suicide after he was arrested for allegedly participating in a plot to use pictures of a vegetative Rose Cochran in a campaign video attacking Senator Thad Cochran. The case was dismissed although the Chancellor rejected a Mr. Wilbourn's request to seal the case. Earlier post.
Kingfish note: A lawsuit is filed. There will be a bunch of noise but it will be surprising if there is any recovery once everything is litigated. Here is a question to consider if one is pro-plaintiff: What exactly was the Madison Police Department supposed to do when it found out Mr. Kelly visited Ms. Cochran's room and took pictures? Trollfest '09
Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.
Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).
Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.
Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".
In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.
In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.
Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

That's the first time I've seen Roy Nicholson's name brought up in this as essentially an agent for dirty works for Chris McDaniel. He knew and I guess could approve what Chris would and wouldn't approve of? That's not a very good fact pattern for him or the MS Tea Party.
Steve Thornton used to be in with Mitch Tyner and tries to play himself as a Republican - a Republican Trial Lawyer.
I'd be curious to know how many lawyers the family had to go through to get down to Carson and that other guy.

This has nothing to do with Chris McDaniel or the Tea Party, Ass-Wipe.
I hope she collects at minimum from Queen Mary, The City of Madison and the chief. Hawkins has always assumed herself to be untouchable - All she has to do is glare at you and speak in a threatening voice (so she thinks).
Any word on whether Dorsey was drunk on Chablis when he filed this and if there's a video of the filing on YouTube and/or Facebook?

Cannot sue for common law suicide in Mississippi under these facts unless you plead and prove: intentional act by the third party which caused the suicide and that the deceased had an irresistible impulse to commit suicide. The lawsuit must be filed within one year because of the intentional act: see Irby v. Madakasira 2015-CA-01759 (March 28, 2017).
In other words, even if the Plaintiff could prove that the Defendants committed an intentional act they waited too long to file the suit.
I hope she cleans all their clocks!
Plain and simple, this is the City of Jackson's fault.
It has every thing to do with McDaniel if somebody rats him out and shows that he was behind the whole thing and it was covered up. Jan also. This was a borderline cult.
This is a junk lawsuit and a poor widow's anguish was preyed upon in the filing of this suit.
OH NO 5:53 - didn't you read this? McDaniel didn't have anything to do with this. Mark didn't have anything to do with this. The crime was only by those acting 'on behalf of' the McDaniel campaign - thus, there was no fault of McDaniel. But of course, all these bad guys -you know, the rich and famous - were persecuting Mark for something he was too good, and too innocent, to do.
Of course McDaniel was behind this; they want to claim that Wilborn escaped prosecution and have a butt hurt about it. McDaniel, though, got off lite because as the cult leader his job is to tell them when and where to drink the kool-aid. He's too important a savior to have to take the bullet for any such stupid activity as breaking into a nursing home.

In paragraphs 75-92, they admit he is guilty of conspiracy. So how are they able to claim that he did not commit a crime? I don't get it.
It looks like they missed the 3 year statute of limitation for wrongful death by 1 day. 3 years from June 27, 2014 ended at midnight on June 26, 2017. Suit filed on June 27, 3 years and 1 day after Mr. Mayfield's death. Mayfield's Need to sue the lawyers for malpractice. He who lives by the sword dies by the sword.
Robin Mayfield sons are lawyers & her brother is a lawyer.
She might be influenced by them?
These lawsuits aren't meant to go to trial. They want a financial settlement.That's all.
I didn't know Mark Mayfield, but I never heard anything but wonderful things said about him - even by Cochran folks in the aftermath of this sad fiasco. Sadly, this lawsuit isn't going to get Mrs. Mayfield what it is that she wants. I wish it would all go away and be resigned to a chapter in a MS history book someday.
Roy Nicholson was a down the street neighbor of mine at the time of the campaign and election. He knew me as a Cochran supporter that although I agreed with some of McDaniel's platform, overall I couldn't support McDaniel. The day after the primary election, I stopped by Roy's place when I saw him in the driveway. I made mention of a "tough night" and although he accepted the McDaniel defeat, he wasn't happy by any means. I didn't push the issue until he claimed Childers was going to absolutely whip Cochran. I extended my hand in a handshake. The day after the general, my door bell rings. It's Roy, and as he handed me what we shook over earlier I said Thank You. A while later Roy moved off to a place "where the politicians aren't crooked". I won't divulge that location, but the statement was met with a resounding "HA!" from me. I will say this: I am fully convinced that Mr. Roy Nicholson didn't have a malicious bone in his body. In no way I see him as any part of this whole "Rose Cochran Photogate" collaboration. As for McDaniel, I attended a function he spoke at about a year ago. And while I listened to his "what's wrong with this country pitch" for several minutes, it didn't take him long to start blasting Cochran. Vehemently blasting the man. I took all I could but finally had enough. I posed the question to him that if he (McDaniel) had won the general election, who (at the time was slated to take Cochran's position as Chairman of the Senate Appropriations Committee. Of course he answered Jeff Sessions of Alabama. I then asked him "don't you think that if Sessions becomes the Chairman of the committee, he is going to do his best for the State of Alabama?" Let's just say that put McDaniel into a tail spin. There you go, another Cochran supporter looking for the pork. I then turned to the attendees and posed the question "I want to see a show of hands. IF you have never received a red nickel as an indirect result of Thad Cochran bringing "pork barrel projects" to the State of Mississippi, raise your hand." Not one hand was raised. Now as far as Mark Mayfield, I have several friends that knew the man and claimed he was the nicest guy you could ever meet. I never met the man. But let me say this as a person whose elderly father is currently a resident of Siena 1 at St. Catherines Village: What Mayfield did by (admittedly) disclosing the location of Mrs. Cochran's living quarters, not only to someone he was politically connected to but anyone, was beyond reproach. There are things in the world you just don't do. He did, it apparently weighed heavy on his conscious and he met his end at his own hand. To someone like that, the only comment I have is "Dumbass."

Go look at Chris McDaniel's and Melanie Sojourner's facebook page from yesterday. They are super defensive about the article and the lawsuit. Too defensive in fact.
The Mayfield sons are not lawyers. One in medical school or residency, the other is a tax guy out of state.
On the 27th, Mississippi Conservative Daily posted a piece called #WickerWatch. The whole website exists as a shrine to McDaniel and 'conservative principles'.
What this lawsuit does, intentionally or not, is get everybody talking about what happened in 2014 to make "the establishment" look bad.
In short, this is a political attack ad in the form of a lawsuit. So, here we are again with another political sh*tstorm and I have a feeling this is just beginning. They never learn.
Maybe this will uncover the length of Lord Snow's tentacles into the State.

What about Richard Wilburn's role? He was clearly involved, maybe even directing the whole thing, but he stood back silently when his friend, Mr. Mayfield, and others took the fall. So obvious, yet he walks away without a scratch. Why would Kelly be so willing to protect Wilburn? And why did the investigators and prosecutors ignore his involvement?
Lord Snow and the Cochran crew will have to answer to God for this one.

Wilbourn, and McDaniel, were clearly the ones behind this stupid sh*t. But I don't necessarily buy Mark's innocence. To say that the 'voice' on the phone "Wasn't Mark" is based on what - Dorsey's fine reputation as an upstanding representation of his client? Obviously the LEOs felt differently, but since Dorsey says it 'wasn't Mark' therefore we are to believe that he was an innocent (well, almost innocent) bystander.
To put the blame of his untimely death on these others, though, is just stupid lawyering. Yes, its purpose is to try to expose others, at least Wilbourn. Mark was a fine and decent person and his realization that his stupid actions might have caused the crash and burn of his friend McDaniel's campaign (cause?) -- and of course therefore the loss of his planned COS job with him in DC -- played on his mind too much.
Time to depose McDaniel and his "professional assistant" Melanie. If you remember he had quite an interesting interview on Gallo right after this episode and it was very "awkward" to say the least. Melanie left a message on Kirk Sims voicemail acknowledging that they knew about it and was professing their innocence. I do not buy it.
Mark was a good man and was the exception not the rule to the nut cases that were/are in the Tea Party. he was reasonable and not a zealot like some of these crazies.
Go back and listen to the interview on Gallo. It is weird to say the least.
Lastly, Mark would roll over in his grave if he knew Dorsey was representing his family in this.

Chris & Melanie were brought in by Haley Barbour. Chris successfully sued for the State of MS in regard to Oabamcare (part of why it doesn't work). I imagine Barbour et al were completely fine with him as an up and coming star in the Republican Party until he/they realized that McD's platform directly conflicted with their corporate interests.
So, the protégé was spared for "the future of the party" in case anyone needed to be replaced for whatever reason in the future and Mark was the sacrificial lamb.

Oh Lord not this shit again. What next people are going to get locked up in the Hinds County Court house after dark. There is one other person involved with Photogate and he was a member of the Madison Republican Party and drop out soon after Photogate.
Can't wait to hear who tipped off Melanie that Kelly had been arrested. It would not surprise me if it was Mark. But anyway, he got caught and killed himself. Case closed.

This is so sad. Suicides are permanent solutions to short term problems and with rare exception ( terminal illness)a poor decision on the part of person who takes their own life. It's a moment of weakness and depression and inability to see that life can and often does change for the better after mistakes and failures.
Families have a hard time accepting that some one they loved would do such a thing. They blame themselves and others. And there are always the gossips and busybodies who add to the pain and drama so they can either profit or be the center of attention as the gossip monger in chief.
Any judge or lawyer going along with this is a sorry excuse for a human being and no friend to this family.
Richard Wilbourn was present during court proceedings when Clayton Kelly’s case was heard, on Monday 8 in June 2015. Wilbourn sat next to Clay Kelly’s wife. They conversed. As the prosecutor’s side went on to present their arguments and mentioned the Tea Party involvement, Wilbourn got very agitated, angry, started to shake his head, jerked his arms and his face turned red. Richard Wilbourn was saying something in angry manner and he looked angry. It was observed by various people. Why did he appear in court next to Mr. Kelly’s wife and why the indignant anger about the fact that he is active for the tea party? Again, why was Wilbourn in the courtroom, let alone motivated to assist Kelly? Why did Kelly’s counsel, Mr. Camp, get Kelly to take the fall so there is no disclosure process on record? The money trail alone may speak volumes as some bloggers have noted Wilbourn’s clear involvement in almost every part of the sad and sordid Kelly case. Mayfield suicide or not, the smear campaign was orchestrated, violated the US election laws, smeared an elderly invalid for political gain, and cost someone their very life.
If this trial even moves forward, it will take years. There will be scores of motions, depositions and conferences. It's hard to see how the smaller law firm can front these tremendous costs. Butler Snow's attorneys are the best and they can wait you out as well.
Obviously he was guilty of something in his mind. He was depressed. He was sick. His conscience ate him up and he couldn't take the social backlash. His solution instead of the humiliation was to kill himself. If you play politics you might have to pay. I'm very sorry for his family and what they have to go through because of his decision ... but it was his decision to do this. No one else's. No one's fault but his.
Suicides are rarely because someone is guilty.
Point out the location Rose's room is the dumbest mistake he ever made. It cost him his life.
