Barbara Blackmon and the City of Canton's doubled down on their attempt to extort, oops, I mean cancel a thirty-year agreement not to annex Nissan plant area ten years ago. Canton's property tax rate is 57 mills. Ms. Blackmon amended her complaint and threw in some, ready for this, equal protection and due process claims. Seems that legislation singling out one city violates the equal protection clause in the law according to Barb. The amended complaint is posted below

Trollfest '09
Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.
Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).
Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.
Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".
In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.
In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.
Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Who would be the judge for this case?
For that matter we could abolish Obamacare. A previous congress implemented it. I am not a lawyer; but it seems on the surface that this is a paper-thin suit which should be easily beat. Also, I'd look into this deeper and ask if somehow Obama and his big union supporters were not somehow behind some of this. Maybe not directly; but indirectly, since we know that they hate non-union foreign competition.

Considering the crap that they are giving Boeing about South Carolina your query might possibly have some legs.
Blackmon & Co., are good at legalized extortion. There is no rational legal basis for their absurd claim.
Judge William Chapman will hear the case.
I suspect it wouldn't even survive a motion for judgment on the pleadings; certainly not a motion to dismiss or for summary judgment.
Let me break it down for you:
As a general principle, Blackmon is right; one board cannot bind its elected successor.
But see, in 2000, the MDA said to Canton (it's exhibit A to the freaking complaint) and said "We know you can't bind a future board of Alderrmen. But we'll get the Legislature to authorize you to do that. In an exchange for a 30-year moratorium on annexing the plant, Nissan will pay a set amount to your city school system. Deal?"
That's a paraphrase, but it's accurate.
Now, Canton is saying, "we gave our word, but we want the court to allow us to break it."
Nissan relied to its detriment on Canton's word, and built a billion-dollar plant. This case will be dismissed quickly. A second year law student could see that.
And Barbara should be sanctioned under Rule 11.
What a way to attract new business. Go to court to renege on your contract. This isn't going to fly.

EDITORIAL/Canton's pot o' gold in Nissan
Talk about shooting your foot off!
Canton is sending the absolute worst message it can to Nissan or any other major employer even considering moving to the city or Madison County.
What in the world are these folks thinking by suing to annex Nissan's $1.4 billion manufacturing facility?
The Canton Mayor and Board of Aldermen is challenging an agreement a previous board made with the company that forbids them from annexing Nissan until 2033 without the company's consent.
Again, this is the absolutely worst message to send to Nissan or anybody else.
Cash strapped and barely able to pay the bills because of decades of fiscal mismanagement, Canton Mayor William F. Truly is looking for a pot of gold - any money they can get their hands on immediately to spend, spend, spend.
It's the same old liberal Democrat tax and spend policies that are bankrupting the country and some states.
This in part explains 9 percent unemployment and the failed policies of a Democrat administration that wants to soak the rich with higher taxes and regulate businesses more.
To wit: "Nissan has all the public services, police and fire protection and the use of roads, and the board felt they should pay their fair share of taxes," city attorney Barbara Blackmon, a former Democrat state senator, told a reporter.
Nissan pays a fee in lieu of property taxes to the Canton Public School District and Madison County Schools.
Of course Democrats like Mrs. Blackmon know very little about creating jobs. Rather than increasing the tax base by creating jobs or growing businesses or making Canton a more desirable location, the Democrats just want more money by way of taxation.
"Nissan has lived up to the commitments it has made to the state, county and city," said Nissan spokesman Steve Parrett.
Nissan has more than lived up to its commitment to Canton, Madison County and to Mississippi. Mr. Truly and his money grubbing band need to back off and get busy creating jobs and improving the quality of life in Canton or else just resign.
Wal-Mart should tell Truly, Blackmon and the retards who put them in power to pound a big pile of sand up their asses.
My bet is the both Barbara and Ed voted for the deal when it came through the MS legislature in 2000. Would be interesting to find that out.

What I thought was interesting is that the file location on their server:
z:\\oldfiles\CITY OF CANTON\etc....
So what other files you think they have in there? Looks like they have been down this road in some manner in the past ("oldfiles").
Re: "oldfiles" - not necessarily. Every time I've gotten a new computer over the last ten years I copy everything in the "My Documents" folder before erasing the hard drive and giving it away. I then copy the files into a new folder called "oldfiles" or something similar. That may be all this involves.

Did she vote for this when she was still in the Senate?
Both Ed and Barbara were serving in the legislature in 2000 (he in the house and she in the senate). HB1 from 11/6/00 session has Ed Blackmon listed as "Additional Author" on the bill. They didn't post voting info on the internet back then.
KF-all legislative activity is kept in journals at the capitol (downstairs). Just ask for the House Journal and Senate Journal for 2000, 3rd extra session. Would be interesting to know if Barbara, while serving in the Senate, voted for HB 1. Since her husband was an additional author, assuming he voted for it too. They have a copy machine you can use and you just make a copy of the page from the Journal with the votes on that bill.

Have often wondered how the Blackmon's get away with what they do. I understand that they do not even live in the district that they were elected in.

The conservative spin machine never ceases to amaze me. The wage hour that is trying to own her own house for her children in a new Madison County Subdivision must pay more taxes when annexed into a city, no question. But when a mulit-million dollar company faces the same thing, it is just so bad and injustice for all Mississippians. Where the hell is the common sense? Since when is it bad for the rich, including corporations, to carry their load? They damn sure aren't lowering the prices of a new car, or a gallon of gas, or a light bulb.
