It seems a State Representative got himself into a wee bit of trouble.
The DeSoto County Times-Tribune reported:
Hale said in a statement that he received an emergency phone call from his son and daughter-in-law informing him that his granddaughter was unconscious and not breathing and that they were en route to the hospital. Hale stated that in that moment "he reacted as the first responder I had been for more than 20 years. While driving to the hospital,, I was providing instructions through my wife over the phone in an effort to help my granddaughter." Hale publicly apologized to officers Hernando Police Department and the DeSoto County Sheriff's Office for his actions. "That night they encountered a terrified grandfather whose only concern was reaching the hospital as quickly as possible," Hale stated. Hale stated that he was arrested for refusing to submit to further testing and his distraught demeanor during the encounter, but denies being under the influence or drugs or alcohol. "I want to be absolutely clear that no alcohol or illegal substances was involved at any point during my day or evening," Hale stated.

So he was hauling ass and refused to obey the cops and got angry because he used to be a first responder and now he’s using a family members medical condition to excuse his putting the motoring public and police in harms way? Why not just say I made a mistake and acted improperly and plead guilty to the charges?
Defense tactic sounds reasonable unless weaving and jerking all over the road, which could have been caused by distraction of phone. In that case, should be ticketed for distracted driving or whatever texting drivers get ticketed for.
Distracted driving should be treated the same as DUI. At least the drunks are looking at the road.

If true, should be easy to prove. Sounds like a first responder who can’t maintain composure in a high stress situation. I wouldn’t want him working on my family. Was he a volunteer fireman with homemade flashing lights on his z-71 and now thinks he’s always been a first responder? Or, is he really a first responder? The more you know…
Question: My understanding is that field sobriety tests are not mandatory in Mississippi, only in-custody breathalizer testing. Is this correct? If yes, he could only be charged with failure to submit a test if he was in custody. Thanks.
I'm inclined to give him a little slack simply because he didn't use that "you don't know who I am?" routine.

I notice that the charge is DUI 1st offense, not DUI refusal or DUI no test, so that implies that he took the test and failed. This is a booking sheet and not the actual affidavit, so that may not be correct. But there could have been a family emergency at a time when he was in no shape to drive, which would erode his decision making skills even farther.
Tate will pardon him on the way out of the door.

In fact, he was probably arrested for suspicion of DUI.

He is a white man and a politician in Mississippi. He can go to rehab, say he is sorry and get up and do it again. It is the standard here. He is part of the club. It will be okay. Just another day in this state. Maybe if he gets off, yall can do a show on how great he is. Don’t yall usually rally around them when they accidentally mess up. Hmm. If I were cold-sober and trying to reach my granddaughter in an emergency, and a cop stopped me thinking I was DUI, I would have blown the sides out of the breathalyzer and then asked him for a ride, or at least to help make a hole for my wife and I to reach her. I cannot envision that getting into a roadside scrap with a cop would occur to me as being the best/fastest way to get to her. I also cannot envision a smallish town cop pulling over a cold-sober state senator, who tells them he and his wife are racing to the hospital, etc. and that cop deciding it would be an amusing little diversion to their evening (and career) to railroad him on completely false DUI, resisting, etc. charges. IOW, someone is lying like a worn-out rug. This ought to be career-ending for one of the "sides" in this thing. It almost certainly won't be, but ought to be.

DUI refusal is not a state crime. A refusal of a properly offered in-custody breath/blood/urine test is an administrative suspension of a Mississippi license for 90 days.
DUI is DUI, but refusal of the breath test is not a state crime.
Under the 5th Amendment, no person is required to participate in field sobriety testing conducted by the properly trained officer.
The refusal to comply charge better come with some other fact scenario.
Never, ever take a test from a cop when the results are subjective.
