JSU's grievance against JXN Water is sputtering along in federal court. The word "sputtering" is used because U.S. District Judge Henry Wingate ordered JSU on September 23 to correct the memo it filed in support of the project. The docket states:
DOCKET ANNOTATION as to # [230]. Incorrect event chosen to file this document. This document should be filed using the Memorandum in Support event located under the Responses and Replies category and should be linked to the document it supports. Also, the Exhibits and the Memorandum are filed together as one document. Exhibits should be scanned separately and docketed as properly identified attachments to the main document within the same docket entry per L.U.Civ.R. 7.(b)(2). Attorney is directed to refile this document using the correct event, linking it to proper document, and attaching the exhibits in accordance with the rule noted. (ND)The corrected memorandum still has not been filed. JXN Water will submit its reponse after JSU files the corrected memorandum.
