Let the Cutoffs Begin

 JXN Water issued the following statement. 

Shut-offs have begun for multi-family apartment complexes with delinquent water bills. JXN Water has made major strides in improving the consistency and reliability of water throughout the Jackson community. To maintain our progress in improving the system, everyone must pay their fair share. We are thankful to the residents and businesses who have consistently paid their water bills. To protect our paying customers' contribution to the system, we must hold people accountable who have outstanding balances with JXN Water.

Regarding the recent and future apartment shut-offs, we want to provide clarity:

1. The property management companies are contacted multiple times by our office, and a notice of disconnection is issued in advance. This is in line with our policy to ensure that property owners have ample opportunity to address any payment issues.

2. If no action is taken to resolve the outstanding balance, the property enters the severance process. This process is necessary to maintain fairness and accountability across our customer base.

3. We understand the impact on residents who may not be directly responsible for the non-payment. We encourage residents in affected properties to engage with their property management company immediately to understand the steps being taken to restore service.

4. If you are a resident at an apartment complex that may be a customer of JXN Water, please confirm with your property management company that their water account is current.

We urge property owners and management companies to fulfill their obligations to their residents by paying their water bills promptly to prevent future disruptions. Property managers or owners can call 601-500-5200 for inquiries regarding outstanding balances or ways to pay.

Bet this is going to go over well with the residence, especially the elder and those with small children who have no control over management in the middle of summer.

This is completely reasonable, but I am one of those who pays their water bill. Unfortunately the majority of the inhabitants of the Bold New City will disagree.

Turning water off is the only way to get out of state owner/landlord to step up and pay up. Owner knows they owe and water is not free but took advantage of mismanaged City of Jackson. Sad part may be that most of the apartments are probably government subsidized so rent will keep being deposited each month in landlords bank account.

Start prosecuting the owners for embezzlement. You pay money for water service to landlord. Landlord pockets the money. You lose water service. Embezzlement.

If any of these properties receive section 8 vouchers there will be serious repurcussions.

110% this is on the owner/management. It sucks for the residents as they are most likely charged water by the complex, but the owner/management hasn't been paying the bill. They should be arrested and held behind bars until it's paid. The ones who will suffer in this case are the (most likely) low-income residents.

I am curious how many of the owners have spent the water money and don't have the funds to get it turned back on. This will be fun & not fun to watch at the same time.

A small example of the difference between 1st and 3rd World thinking, the idea that you have to pay for what you buy. . Chief Lumumba isn’t going to like this at all. Maybe the solution is to dig wells at various places and let people carry water home.

Start filing liens and then instituting foreclosures on those liens, and the payments would start rolling in. And why aren't ALL delinquent accounts being set for disconnection (I'm pretty sure of the answer but...)?

I am all for turning the landlords over to the feds to prosecute if they are embezzling rent subsidies. The sad part is how to determine what is the actual bill. I don't know of JXN WTR has been able to solidly identify usage for the time they were not in control. Either way, I would support prosecution and figure that part out in discovery.

Surely there would be a class action lawsuit in this for every landlord/property owner who failed to honor the terms of the contract or lease, if the lease / rental agreement included water as a part of the contract.

I love that idea @Kingfish. But it will require the tenants to turn in the Landlord. They have to show the term in the lease, payments made, and then payment wasn't passed along. It isn't on JXN Water, but they can provide the necessary proof of non-payment.

Will the DA or City prosecutors file it?

Calm down people. Chok already announced in a presser that the water system was waaaay better managed under his supervision compared to the management of Jackson Water.

On Canton water they turn off after the 20th if you don’t pay.

They don’t wait for months and years.

The apartment water cutoffs are a different issue than residence cutoffs. For individual homeowners who do not pay their water bills, it's a simple matter of them opting not to pay for something...so that something gets discontinued. But landlords and apartment managers who fail in their duty to keep water connections in good order to their properties are subject to more than just cutoffs...that's a civil matter, too, and residents can take responsible parties to court. Tenants are not given control over their water and instead agree, by contract, to pay for said water through their rent...and same contract holds responsible the owner/manager to keep those connections in good order. This is a slam dunk in court.

The City of Brandon gives you two billing cycles. Late for one cycle and they give you some grace. Miss the second cycle and they cut you off immediately. This happened to me once when I just forgot that bill. I payed the delinquent bill immediately and have never let that happen again. That's how you handle delinquent accounts.

I know they are going after the bigger fish, but why haven't shut offs of residential customers begun? In the case of residential customers, you know the resident is responsible for not paying. These residents of apartment complexes have no control over the owners not paying.

Here's how it is going to go down:

These landlords, under pressure, will now work out payment arrangements with JXN Water, but will instead pass the cost of the payments onto the renters via rent increases.

I really hate this for the residents of these apartments, but this is absolutely a reasonable and necessary step for JXN Water to take when the building's property management group is basically daring JXN Water to cut them off by not working with them to get current.

Some residents (and evidently property management groups) have gotten so accustomed to getting away with not paying a dime for water that they viewed JXN Water's numerous warnings of shutoffs as empty threats. Hopefully this will light a fire under them to get current quickly.

In the meantime, it would be nice if all of these organizations the Mayor's sister is involved in would step up and provide some bottled water for residents of these apartment complexes who are being impacted despite making water payments through their rent instead of making whatever snide comments are surely coming Ted's way!

Perhaps a tenant group can put their rent in escrow such that all future rent pays off past utility bills, insurance, etc. The water/trash bill is likely not the only fraud committed by landlord-owner.

i assume, based on this report, that there are very few if any home owners delinquent on their water bills. That certainly should be a selling point for Jackson real estate.

Its upsetting that people like this landlord and many residents were allowed to become so comfortable with not paying a water bill.

Who would have thought that refusing to turn off a service for non-pay would result in a pattern of non-paying customers?

One could almost say, I told you so.

Failure to provide water would likely permit the tenant to claim a constructive eviction, entitling the tenant to move out without penalty, regardless of what the lease provides. If the apartment management sued for rent, the tenant might file a counterclaim for damages incurred because of the constructive eviction, including moving costs, increased rents at a new place for the duration of the old lease, etc.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!
