Some major action will occur in the federal court fight over HB #1020 Friday.
U.S. District Judge Henry Wingate will hold a hearing at 9:30 on whether Chief Justice Mike Randolph enjoys absolute judicial immunity from the NAACP lawsuit. The NAACP included him as a defendant since the law directs him to appoint the special judges for Hinds County.
Judge Wingate will hold another hearing at 1:30 on the NAACP's request for a temporary restraining order that will block the appointment of the special judges. The new law directs the Chief Justice to appoint the special judges by May 8.

I would like to read the briefs, because I suspect the plaintiffs have a sound case. The appointment of special judges is routine but creating a district where no judge is elected is unique and likely unconstitutional.

Would that apply to, say Gluckstadt, a new 'district' created recently, where there will be an appointed judge, and 'no judge' will be elected, and therefore, unconstitutional?
Interesting concept. Where in the constitution is the legislature prohibited from creating inferior courts and also prohibited from having appointed judges for those courts?
