The impeachment effort needed to fail. To prosecute a former public official under an impeachment provision sets a terrible precedent. If there is a law broken, charge the official. But, the legislative body serving as jurors for a former official is not a good precedence.

As they should have... the whole thing was total BS. The left is the absolute definition of hypocrisy.

Everyone should listen to Mitch McConnell's comments after the vote. He took Trump to the woodshe and finally stood up as a Ronald Reagan Republican.

Trump will go down in all of the history books but it will not be for what the democrats wanted it to be for.

Sorry to see Mr Trump wasn't convicted because he was clearly guilty beyond any doubt. We saw great courage today from the 7 Republican senators who voted their consciences. Thank you men and women. You stand tall. Unfortunately our senators supported the criminal and corrupt ex-president out of fear of their voters. At least Minority Leader McConnell spoke the truth about Mr Trump's conduct after the vote.

As a political question the Democrats did not want to "bar" Trump from seeking reelection. Neither do they want him convicted of a felony. Their reasoning is simple. Trump has done more damage to the Republican Party than they could. Why stop him now?

The real problem lies with "what happens if some U.S. Attorney actually follows his oath and prosecutes Mr. T?" That's what Mr. McConnell was saying, "you got him, have at it." Kind of daring the process.

If Mr. Trump were one of the thugs KF posts videos of burgling convenience stores he would be prosecuted. Why not Mr. T? Present the facts to a grand jury and if they indict, put 12 in the box. I feel pretty good about the federal criminal justice system but I would feel better if some right thinking team of Christian prosecutors allowed Mr. T to spend the rest of his days in federal custody. After all, he's the guy that turned the USA into Venezuela.

A year ago I was saying, no new wars, the economy is fine, there's nothing to complain about. Yeah, I'm embarrassed whenever he opens his mouth. It would be worse if it were Ms. Clinton. Mr. T's failure to act like an adult both before and after the election changed all that. On January 6, 2021, the USA officially became a banana republic. It will never, ever, not in 100,000 years, recover from the POTUSA egging on a mob to stop certification of an election. Never. Being barred from running for federal office is an impeachment remedy, which is not mooted upon expiration of a term. So I disagree with them on the constitutional issue, although I acknowledge that’s up for debate. That’s unlike the Louisiana GOP, who has a newfound appreciation for cancel culture, apparently.

As far as the Senator Hyde-Smith’s defense on the merits, the case against Trump was not based just on the Jan. 6 speech, and having sat through the proceedings, she was well-aware of that fact. With her misleading statement, she failed to be honest with her voters.

All in all, the GOP has shown there is absolutely no line Trump and like politicians can cross for which the party will hold them accountable. They are clearly not the adults in the room.

It was a futile effort from the start since there was no way the Trumplicans were going to convict their crime boss. Joe Biden needs Congressional Dems to put the Trump era behind us and move on with his agenda.

I think if Trump is going to be held to account in a criminal court, it will have to be done by the states. Georgia certainly could indict him. NY state WILL indict him.

The president's actions on January 6 were just plain disgusting and completely un-presidential. He brought shame on the high office he held. But he did not commit a "high crime or misdemeanor" and he should not be impeached. Let's take a look at what the Constitution and History really say about the impeachment of an official by the House, and the conviction of the official by the Senate.

Cindy Hyde-Smith states:
"First, the impeachment of a former President is not part of the Constitution, which states clearly that ‘impeachment shall not extend further than to remove from office.’ Donald Trump is no longer the President."

Senator Hyde-Smith only quotes that portion of the constitution that is convenient for her to quote. Here is what the United States Constitution actually says:

"Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States; but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law."

Notice what Senator Hyde-Smith left out. The punishment for impeachment by the House of Representatives and conviction by the Senate is limited to removal from office and disqualification from office. The Constitution does not state that impeachment and conviction can only be limited to current office holders.

That leads a reasonable person to ask: "Is there any time in the history of the United States where a person was impeached by the House of Representatives, but who was no longer in office?"

The answer to that is yes, there is one individual who resigned and thus was no longer in office but who was impeached by the House of Representatives.

William Belknap was the 30th United States Secretary of War, serving under President Ulysses S. Grant. William Belknap received kickbacks from a contract a Fort Sill. The House of Representatives, which was led by Democrats opposed to Reconstruction, investigated the issue. Belknap saw the writing on the wall, and resigned as Secretary of War. Still, the Democrats voted to draw up five articles of impeachment. The House of Representatives unanimously voted to impeach former Secretary of War Belknap.

The Senate debated over whether it had jurisdiction to try a former official. They voted 37–29 that they did have the jurisdiction to try a former official.

Senator Hyde-Smith is wrong. The Senate has voted twice that they did have the jurisdiction to try an official no longer in office.

Meanwhile, Senator Wicker is correct. He states "no public official has ever been convicted in an impeachment trial after leaving office." The Senate voted 35 to 25 to convict Belknap, with one Senator not voting. They needed 40 votes for it to pass.[2] Thus Belknap was acquitted, and Senator Wicker is correct.

I do so love reading the clown comments as though one slept through the last four years. It was clear the day Trump said he would run was the day the manure eaters decided he had to go.
