Sheldon Alston, Jr. is home for Christmas after serving half of a three-year sentence for brutally beating his girlfriend at Ole Miss. The St. Andrews graduate is the scion of some Mississippi legal royalty as he is the grandson of prominent north Mississippi attorneys Flip Phillips and the late Alex Alston. The Oxford media ignored the case.
Altson brutally beat, strangled, and kidnapped his girlfriend in September 2016.* They were both students at Ole Miss. A Lafayette County grand jury indicted Alston in June 2017 for aggravated assault, domestic violence, and kidnapping.
The case was repeatedly continued until a petition to enter a guilty plea was quietly submitted to the court. Quietly because the petition did not appear in the public court file under after his sentencing hearing on June 10, 2019. The hearing took place in the courthouse in out of the way New Albany. Out of sight, out of mind, except yours truly got a tip and attended the hearing. The circuit judge denied the camera request even with the victim's consent. Earlier post on sentencing.
District Attorney Ben Creekmore's office dropped the kidnapping charge and asked Circuit Judge Kelly Luther to sentence Alston to serve 15 years in prison but suspend 12 years of the sentence. Alston was released after completing 50% of his prison sentence under state law. He faced a maximum sentence of 20 years for the domestic violence charge and life for the kidnapping charge. The withdrawal of the kidnapping charge is important because a judge can not suspend any part of a sentence if the maximum penalty is life in prison. Merrill Nordstrum represented Alston.
MDOC released Alston Tuesday. The prep-school thug thus managed to make it home for Christmas thanks to a hearty helping of home cooking.
Posted below is the victim's statement to the Court. The victim describes Alston's attack in stomach-churning details. The statement tells the story of what took place afterwards as the young woman recovered, facing challenges she couldn't not have imagined just a few days earlier. There was an inability to trust the police. Days of tears. Frustrating attempts to get justice. "I felt as if all the lawyers in Mississippi were ganging up on me to protect Sheldon and do a favor to his extended family of legal experts" said the victim, describing her own lawyer who advised her to sell out her justice. Meanwhile the family of her abuser seemed to be more concerned with young Sheldon's ability to go to law school one day instead of her beating. We must preserve the ole family heritage at all costs. The statement is a story that should be read, as it represents too many women in the Magnolia State.

The complaint states they went out with friends on The Square in Oxford
on the night of September 7, 2016. Alston allegedly became angry,
demanded she leave with him, accused her of talking too much to her
girlfriends, and yelled at her. He pushed her down some brick stairs.
He took away her iPhone and destroyed it. The victim claims that she
suffered a scratch on her cheek. Then all hell broke loose (allegedly

15. As they turned south onto South 18th Street, a much less traveled road than University Avenue, Alston began to forcefully grope xxxx, sticking his hand up xxxx's skirt, while sliding his other hand over her mouth. Fearing for her safety, xxxx tried to push him away.
16. Infuriated by xxxx's rebuff, Alston willfully, wantonly, and maliciously threw her to the ground, pinning her under him, preventing her from escaping. At this point, he unleashed a torrent of blows, viciously and repeatedly striking her face with his hands. Alston's physical attack continued when he began strangling xxxx with both hands clasped around her neck.
17. Alston's attack left xxxx severely bruised. xxxx had cuts and aberrations on her legs,elbow, and back. Alston's actions further caused bruises and wounds around her neck and leaving her left eye swollen shut....
19. Once at Alston's house, Alston stated: "I am going to kill myself, and I am going to kill you, too." Apparently noticing the seriousness of his words coupled with the physical attacks he had already inflicted on xxxx, Alston quickly added: "Actually, I am not going to kill you." (How nice of him to say that. What a relief- KF)
20. xxxx begged Alston to let her go home or to call her a ride. However, Alston refused. He even stood in front of the door preventing her from leaving.
21. Instead he asked xxxx can they '"do it one last time." Bruised from his vicious physical attacks on her, xxxx began to cry. Alston responded by spitting on her and calling her selfish for not having sex with him.
22. After a while, when things had calmed down, xxxx saw her opportunity to leave Alston's house, and attempted to do so.
23. When Alston figured out that xxxx had attempted to leave his house without his permission, he again became furious, resuming his brutal physical attack on xxxx. This fourth attack of the night was the most vicious and brutal.
24. Alston slammed her against the wall. In an attempt to get away xxxx sunk down against the wall to the floor. But Alston did not let her get away. He pinned her under him, preventing her from escaping and continued the attack, again willfully, wantonly, and maliciously strangling her and striking her with his hands.....
28. Instead, Alston drove xxxx to his grandfather's secluded cabin in the woods located at ____ in Oxford, Lafayette County, where the two were completely alone.
30. Upon returning to Alston's house at around 6:00 AM, Alston forbade xxxx from leaving, fearing someone would call the police on him if they saw her injuries he had caused.
31. xxxx finally convinced Alston to allow her to leave by telling him that she planned to drive to her home in Columbia, Mississippi and stay there until she healed from the injuries he had inflicted on her.
a. Scratches and bruising on her right jaw
b. Scratches and bruising on the left jaw
c. Scratches on her left hairline
d. The area around her left eye was bruised, scratched and swollen
e. Both lips were bruised badly and the inside of her mouth was also bruised
f. Her back was scratched in several places
g. Her right elbow was scratched
h. Her right leg was bruised
1. Her neck was red, bruised, and scratched all the way around including the area around her hair line on the back of her neck. Some of the marks on her neck looked like scratch marks from finger nails scratching her neck.
Oxford police arrested Alston and charged him with felony domestic
violence-aggravated assault and felony kidnapping. He posted a $30,000
bond and was released.

I can tell you from experience that this is what happens: they can’t handle perceived “rejection”. There is alcohol, bruised ego, sense of entitlement. My soon to be ex had a habit of doing shots and being a private $&@#%^*, while being a public “great guy”. While I was recovering from chemo, mastectomy, radiation and finally couldn’t handle the drinking and assholery any longer, couldn’t do the sex, either, the verbal abuse crescendoed. Finally, he spit on me. That is what makes me POSITIVE her account is true. It’s the entitlement and contempt for the woman- who isn’t doing his bidding- and bruises his ego- that is the common denominator in abuse. His family enables it. He will kill a woman one day.
She needs help to figure out why she would stay with someone that long that abused her. She should have kicked him to the curb the first time he strangled her and I think that was in January.

If a black kid from a poor family did this in Madison, would the sentence have been the same??? Do you know how many young black males are serving lengthy prison sentences for selling drugs to some individual who wanted to buy the drugs. This story is a reminder why some people have no faith in the justice system.

Not really. But for a few cases, if they are serving long sentences for drugs, it's due to trafficking. Most of the drug offenders are placed under house arrest or supervised release. See the MDOC stats. They are on the MDOC website.

Two observations. Of course this is privilege at work. Of course DA Ben Creekmore is ultimately at fault, criminal-procedurally speaking. Of course young Mr. Alston is a violent little sociopath.
On the other hand, with respect to African American perpetrators of domestic violence, the system (with some few notable exceptions) is even more forgiving. Particularly in black-majority jurisdictions.
Secondly, nobody sees poor Mr. Alston as the victim he is. The last comment from the victim impact statement says a lot, "He does not have a support system that appreciates the seriousness of the crimes. He does not have a support system encouraging him to tell the truth. He does not have a support system committed to reforming him."
There is another way of putting that. Mr. Alston is a victim of negligent child-rearing. His life was ruined ab initio. It just took a while to figure it out. I feel sorry for him, for the victim, for both their families, for Mr. Alston's next victim. Yeah, he's rich and white in Mississippi. Big deal. I'd rather be the poorest Hispanic at the chicken factory with a decent mamacita and a stab at a decent life.

2019 legislative session HB 1300 would have developed a comprehensive policy concerning sexual assault ,domestic violence, dating violence ,stalking to apply more pressure on IHL to provide adequate training and funding for students safety. House passed bill Senate killed it at the direction of IHL. Schools image is more important than our children safety. Maybe on line education is the best approach less revenue but more safety. MOVE OUT OF THE WAY IHL SO OUR CAMPUSES CAN DEVELOPED ONE POLICY TO PROTECT OUR CHILDREN.

A Federal Law already exists in the form of Title IX of the Education Amendments of 1972 (20 U.S.C. §§ 1681-1688)- and nothing is stopping the "leadership" of any given institution from thoroughly explaining it.
...enforcing it is a whole other matter. Each college has its own little police department, where turnover is ridiculous because you have to be willing to look the other way, and NOT report everything as required. College's have insurance that requires adverse incident reporting, so it will make their premiums go up for one thing, and it also documents any pattern of negligence that would be helpful to someone that decided to sued them. IHL has no interest in keeping students safe....only milking those students (i.e. pimping) for billions in tuition through state and federal financial aid.
"Education" in Mississippi is a multi-billion dollar score for the upper class only every year. Keep those numbers churning, and don't expose us to litigation. That's ALL "education" in Mississippi is about.

For the question of whether he can attend law school, yes and no. He cannot ever be admitted to practice in Mississippi, given his felony conviction. He is unlikely to be admitted to law school in Mississippi since he is ineligible for admission to the bar. However, there are states that do admit persons to the bar with past felony convictions, but it depends on the felony, the circumstances, etc. My educated guess is, however, that he is a long shot for admission anywhere, especially in the current climate as to sex-related crimes, especially without some strong evidence of a reformed character, and it is far too soon to demonstrate that. Family connections in Mississippi won’t be of much help out of state. And even if admissible to the bar, few if, any law schools, would admit him.

Sounds like he is either a textbook Narcissist Pscychopath or at minimum Borderline Personality Disorder (Spoiler?). The immediate change to Temper/Violence (Splitting) can indicate an Exaggerated fear of abandonment. This side is kept hidden from ANYONE except someone they are in a relationship with, or some family members. Insane, unreasonable jealousy/Control is also a indicator.
With BPD, you get a buffet of almost every Cluster B Disorder. It is usually caused by neglect as a child. Studies show the condition can begin in the womb. The child knows it isn't wanted. Many times the BPD has 1 or more Narcissistic parent. People can have at least 3 ages. A physical age, a mental age, but those with BPD have a Emotional age. They NEVER progress past 3.5 years & everything they do is based on Emotion. They guard it Religiously from anyone outside. Even Psychiatrists are afraid to diagnose, much less treat BPDs. There is NO treating Psychiatrist/therapist in Mississippi.
PRAY your children NEVER get involved in with a BPD. BTW, the term below "Crazy-Making" is a defined psychological behavior. If U read the Court Summary, you saw the term "Gaslighting". This is just 1 of the several means a BPD uses to manipulate their victim. When he threatened suicide, that's another method used to manipulate the victim.
A BPD will NEVER legitimately take responsibility for ANYTHING, because guilt=Exaggerated intense Pain. So they always find & justify whatever they do. It is always caused by someone/something else. They say many times, "You made me do this". They have the ability to rewrite their memory of events & many believe their own version, thus the ability to pass a polygraph.
BPD wasn't even diagnosed until 1980. It's gotten more exposure now, & there are a few Attorneys who specialize in a divorce from a BPD. They can manipulate Police, Judges, Lawyers, everyone. It usually becomes a Nuclear/Scorched Earth situation. There are also written guides on how to break up with a BPD GF/BF.
If U ever get to watch the Documentary on SNL Comedian Phil Hartman, do so. His wife was BPD. Misdiagnosed as Bipolar. She killed him, then after she had split into a 3 year old tantrum, shot him. After she shot him, she went immediately to her BF, trying to find a way out. He came back to the house, called Police & when Police arrived, she shot herself because she couldn't see a way out of the responsibility & the pain she couldn't control at that moment.

BPD houses a panoply of other disorders; Attachment Disorder, Narcissistic Personality Disorder, Antisocial Personality Disorder, Histrionic Personality Disorder, Obsessive-Compulsive Disorder, Dependent Personality Disorder, Avoidant Personality Disorder, Eating Disorders, etc.
Even Anxiety & Panic Disorders can be part of a Borderline's symptomology. Hallmarks of BPD include; desperate attempts to gain attention, intense/irrational abandonment fears, lack of empathy, lying, extreme jealousy, poor impulse control, cheating or extramarital affairs, drug/alcohol abuse, hyper-sexuality, 'crazy-making' interactions, low self-esteem, rebound relationships, passive-aggression, cognitive distortion, suicidal ideation, self-harming behaviors, splitting (love you/hate you), etc.

This all makes me sad. That poor girl will not be the same, and he does a couple of years and is out to strike again. Why would Creekmore, and more importantly, Oxford allow this? Oxford has been a safe and chosen city fo some time due to maintaining order/stopping crime/protecting residents, but if this continues, it will decline even more. I would hate to see that - we need some safe havens in MS where rules and laws are adhered to and people can feel relatively safe.

The comprehensive assessment by 6:19pm could apply to a large portion of today's youth to a large degree.
Most of them were emotionally abandoned as children by their parents, yet given material things and a sense of entitlement to never worry about their future as the substitute. Now many are slamming into their young adult status, and realize everything's not handed to me, and everyone doesn't think I'm special - so they act out violently to get their way....and as long as judiciaries "give them a break" they only get worse pathologically. Research is conclusive on this.

Is there a way to track expungements in MS, if so, wonder how many involve cases like lil Alston’s? I know of a lot of those cases.... many of those occur n in the far reaches of the 3rd district. This turd will get his record expunged and will go on to become a turd lawyer. It is likely he’s been offending for many years and for many years to come - all will be expunged and any reference to these crimes would only be found in KF blogs (if they haven’t made KF remove them). The day will come when all those elite expungements get exposed and just maybe there will be lawsuits that will rattle universities, the state, law enforcement, judges. Still will not help the unlucky victims of these lil turds but maybe it will uncover the corruption.
