Library employee: Jim Crow runs the system

Library employees and Hinds County Supervisor Kenneth Stokes teamed up today as they accused the management of the Hinds County Library System of engaging in Jim Crow practices against black employees and patrons:

How is accusing the library system of discrimination considered being a racist? That comment was ignorant. What is happening in that library system has nothing to do with,Kenneth Stokes. This mess has been going on for too long and it appears that these people are fed up with being treated like second class citizens. How is it right that the library director want to get rid of the homeless and low income patrons? That is DISCRIMINATION! And,not to allow a diabetic staff member to have their REQUIRED lunch break is against the law. Come on, citizens and politicians of Hinds County,open your eyes and stop allowing this mess to happen.

There is no law that REQUIRES an employer to give anyone a lunch break.

The Americans with Disabilities Act does indeed require an employer to reasonably accommodate those employees with disabilities. This includes allowing diabetics time and space to administer necessary medications.

But, 10:59 is correct, there is no law requiring lunch or other rest periods in Mississippi, for the disabled or anybody else.

More continued focus by the City on inane items which, whether of merit or not, should not be the focus of a city in Jackson's conditions.

Jackson needs to work big to small, instead of absurd to slightly less absurd. Once we address budget issues and maybe get the water lines to quit busting, then we can hold hearings on who had their feelings hurt at the library/shelter.

Thank you to Kingfish for keeping a light on the absurdity. Otherwise we risk complacency while the city crumbles.

Why did this person not apply on the day the notice of opening went up? If she was so interested in the job, why did she had she not applied in 3 weeks? Was the position listed as until filled or was it listed as the applications would be taken until August? That would make a big difference. I would like to see that job posting and the situation could be judged. Does the city of Jackson list job openings on the internet or where are they posted? I work in HR and would like to see the city's policy.

I was under the impression that lunch times were regulated by federal work laws. If an employee works over 6 hours they are given a lunch break according to law and the company not doing so can be fined.

I probably missed it but ... regarding the statements by the "Story Teller" and the concerned citizen in the video ... where is the evidence that these actions actually took place? I heard a lot of allegations but actually saw only one piece of paper being waved around by Ms. Crow proclaimed to show plans of some expenditures being proposed. I may have missed the hard evidence, but until putting eyes on such proof, these charges seem to be unsupported in fact.

Ignorance abounds here. You people (I know that irritates you) should either consult an employment law attorney or get someone to help you use Google. Federal law does NOT require rest or lunch breaks. Although most (practically all) employers do allow rest periods and lunch breaks, various states (California for example) do have laws regulating such periods required. But, those are state laws. Mississippi does not have a law regulating rest breaks or lunch breaks.

The commenter implied that someone with a disability is required by law to have a lunch break. That is inaccurate.

There ARE, however, federal regulations that address pay for breaks that an employer does allow.

You might also be interested in knowing that federal law (and there is no Mississippi law) does not require vacation time, paid sick leave or maternity leave, as such. You might want to bitch about that as well.

Some of you might also want to educate yourself as to which groups are covered by federal discrimination laws. Those are referred to in the law as protected groups. Being homeless and being low income are not protected groups under federal anti- discrimination laws. Sorry, but nice try.

No law, federal, state or local requires that public buildings be accessible to the homeless or low income as a comfort station.

@2:59.... You can't keep a certain set of people from coming into a library,just because you don't like them. It just doesn't work like that. In fact,even when someone does something to warrant having themselves barred or kicked out of a library for any reason,you have to actually go through the proper channels to do so. Because a library or any place of business can get sued,if they're not careful. That is just fact because it has happened many times. So,before you comment next time and attempt to "act" as if you're smarter than other why don't YOU learn to use Google or whatever.

I'm sure, as 8:50 am posted, the media would be more than happy to publish it. After all, simple transparency & justice is what everyone wants, correct? "Dog & Pony" show claims vs. "Solid, verifiable, openly disseminated evidence" for all to plainly see seems to me to be the simplest way forward with this matter, IF simple transparency & justice truly is the goal. At least that is my understanding of this matter.

Perhaps ... but several times in life I've seen people very capable of doing a job not get selected for the big chair for one reason or another, usually because the powers that be simply think the selected party's butt fits the chair better, in a rhetorical way. It's not uncommon. Stuff happens. Some of the time, the aggrieved or their supporters get miffed, but they can suck it up and move on or, perhaps ... it was Jim Crow all those times as well and everyone needed to make fancy dancy signs and show up at meetings and be a "Storyteller"

I use the library system a lot and if what is going on is true it is a damn shame that these workers are being treated this way. What is even more shameful is how people just want to look away from a problem and pretend that nothing is going on. Someone could at least take the take and check this mess out.

If an employee works during a lunch break that is supposed to be unpaid, an employer may be obligated to pay additional wages, including unintended overtime, to that employee.

Maybe, the lady who is getting screwed out of getting a break should have them pay her for all the extra hours. If, I am correct, the library system is supposed to give an hour lunch break and 2 fifteen minute breaks. At least that was what their policy was when I was employed there. In fact it is written in the employee handbook.

From what I can understand, she was never not allowed to apply for,the position. It is just that the position was filled. She thought she had until a certain date to submit her appication. Obviously, the board wasnt operating under a deadline. If there was a conspiracy to keep her out of consideration and that conspiracy was based on her race , age or sex , then that sounds illegal.

In any case, it doesnt sound like the board didnt handle this situation very smartly. Regardless of how the EEOC
rules, she will be able to sue . i did hear that the County has insurance

Everything being said here is a total and complete lie. I know several people who work there. Employees get 15 minutes of break time every four hours and one hour lunch if they work all day. The library director is a real sweet person. She asked the library employees to bring scarves, hats and gloves for the homeless instead of gifts for themselves this year and greets the homeless on a frequent basis. Very sad that these disgruntled employees have to lie about the situation.

Btw,this director picks and chooses who she is sweet to,she DOES NOT treat everyone equally. Bull shit claims and trumped up charges have harmed many a good manager. And the race pimps who encourage such bogus actions know that will be the result.

This cannot be about giving out scarves at Christmas or a vagrant sleeping in the stacks or who missed their break. If there is proof of illegal discrimination in the hiring process, it must be produced to be actionable.

It's absurd to claim someone who did not apply for a job suffered from illegal discrimination in the hiring process. If her attempt at filing an application was refused, prove it.

EQ: Breaks in this state are not required by law. Get over it. If a non-exempt employee works more than 40 hours in a work week, they must either be paid overtime, or granted comp time (if they are government employees - which I assume these are). If they're not paid in accordance with that rule, there is an avenue through which to challenge that. If the employees at the library are required to work an eight hour day without breaks, that's legal and if you don't like it, that's tough. Have I said 'get over it' yet?

Jackson-Hinds Library President Harriet Kuykendall is the antithesis of racism. Doubtful that Kenny Stokes, who is the grand poobah of racism, knows that Harriet has fought for civil right her entire life. Doubtful that Stokes knows Harriet gave the eulogy at Willie Morris' funeral or that she has numerous friends that were actual civil rights activists in the 60s. One of them is Ed King, who was very close to Martin Luther King and Medgar Evers. Doubtful that Stokes knows that Harriet surrounds herself with such people.

Not only government jobs (city, county, teachers, police, library, every board, etc) but EVERY job in the city and county.

The purpose of this post is not to criticize Stokes (although he deserves that). The purpose is only to spotlight reality and to suggest we all acknowledge it. Work around the Stokes' twins until they can be gotten rid of, then get rid of them (through the election process, of course).

By the way,she isn't the president anymore,she is still somehow on the Board though. Her friend is the president,but Kuykendall is still calling the shots.For her to have the nerve to claim that she fought for civil rights is laughable at best. I've seen her reactions towards black folks and other minorities. She acts as though we are all on welfare and she herself is paying our way through life. She treats most library staff as though they do not exist and that they are beneath her. As someone said before,Kuykendall has "plantation views." She is not the picture perfect model for civil rights and anti racism. She is the picture perfect model for civil "wrongs" and racism. Kuykendall surrounds herself with the type of people that she can dictate and control by using her money to do so. Almost every picture of her that you see is of her rubbing elbows with white people who are exactly like herself. I've never noticed her socializing with anyone who is of a different race than herself. So,when you say that she surrounds herself with different types of people,that is a lie. And,if you know her SO well how did you not know that she was no longer the president of the Board?

Willie Morris’ books are taught in college-level African-American Studies classes.

In the late 60s, Harriet was one of the only white teachers at the all-black high school in Yazoo City.

Not sure where your going with the race of Harriet's friends. FWIW, Ed King, who was a major figure in the civil rights movement in Mississippi, is white.

Apologizes for not knowing that Harriet is no longer president of the board. That tidbit may be important in your worldview, but, to the rest of the world, who is on the library board is very very minor.

EQ; I'm 9:50. The remarks I made regarding pay for breaks and overtime and whether or not breaks are allowed were based on federal law, not some employee handbook.

Claims were made numerous times on here that federal law requires breaks and others believe both lunch and rest periods must be allowed by law, perhaps even paid. If you will produce such a federal or Mississippi law, I will eat your Dashiki. None exist.

Now if you want to discuss employee handbooks, that handbook section would need to be introduced here in order for a discussion to result. In general, however, even if such rules do exist in handbooks, an employer cannot be sanctioned for violating its handbook unless a complainant can show injury or harm as being a member of some protected class or one who has been terminated or suffered protected class harm. "I didn't get my break" is a meaningless, piss-ant charge in government or private sector, non-union setting. But, as always, in our society, you're certainly able to put on a warm coat and tote a piece of poster board on the sidewalk protesting your mistreatment.

Otherwise, again, get over it.

In the latest edition of the Jackson Advocate, Mrs. Alice Thomas-Tisdale wrote a piece in her Critic's corner on the Library. It is very interesting. Now all this evidence is coming out and it appears that what this lady was standing up for is true. I hope that someone is held accountable for all this mess!

Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online).
