UPDATE: The suit was withdrawn today. JJ confirmed this action with the Rankin County Circuit Clerk.
The Circle Bend Homeowners Association sued Brent Powell for nonpayment of homeowners' association dues in Rankin County Court in August 2012. Mr. Powell is a candidate for House of Representatives District #59. The election will be held on January 8.
Mr. Powell owns a duplex unit on 121A Bent Creek Circle in the Northwoods subdivision in Rankin County. Circle Bend filed a lien on the property on June 22, 2012. The complaint includes a letter allegedly sent to Mr. Powell by attorney Ernest Stewart. The letter demands payment of $1,555. There is no service of process in the file. The Rankin County Tax Collector's website states the property was subjected to a tax sale for the prior year's taxes in 2011 and 2010. The complaint asks for damages of $1,555, court costs, attorney's fees, and interest (8% per year) and states Mr. Powell did not pay the dues from 2007 to 2012. Efforts to contact Mr. Powell for comment were unsuccessful. A message was left on his voice mail.

Trollfest '09
Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.
Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).
Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.
Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".
In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.
In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.
Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Shame on mr. Powell for not abiding by the property owners by laws. He may not be such an outstanding member of the community after all. I am sure he will have an excuse, but as a resident of the district I am extremely disappointed in this behavior. Not the kind of person I want representing me.
The reservoir residents have a right to know the truth about mr. Powell. You seem to be the only one willing to tell the truth. We sure are not gonna read it the rankin record or rankin news.

On the Lum story. Let's see who was the Hinds County Republican Chairman ....oh yes the all knowing Pete Perry. Now we all know Pete would have never given bad advice especially when it was self serving to him. I smell a rat here and I hope he gets caught in his own trap.
The reason why the Republican Party is so shallow in Rankin County is because follis are so sick of the old guard out here. They want to run everything, but they just lost the election commissioners race and I hope they lose this one too. They always use dirty tactics to win. The good news is that we have more and more new families moving in the area who don't even know who they are. We are smarter than they give us credit. Go vote for any one but Powell.

Anon @ 10. Yes, it was me, but I wouldnt call it 'advice'. I told Bradley, along with the other poll workers that they had to be a registered voter in Hinds County to be a poll worker. My understanding was that Bradley was a registered voter in Hinds County, therefore he met the requirements to be a poll worker - which was the issue at the time. Please tell me what "trap" I set that you hope I get caught in.
I may well have told Bradley that he could serve as a poll worker at the time - because he was a registered voter in Hinds County. If I had been "all knowing" enough to have been able to see a year into the future and known there would be a special election called, I would probably have probed deeper into the question at the time - as I am sure Bradley would have as well. But I wasn't that "all knowning" - I was concerned at the time with making sure he met the requirements to serve as a poll manager.
I guess I'm just not quite as devious as you must think I am.
Followup question for Pete, if I may. All of that said, what is your opinion as to whether or not he is currently qualified to run in Rankin? And please don't say "That's for someone else to decide".

He should simply come-out and state " I am a regular, working, broke-azz Mississippian, much like 80% of the rest of this state's population, I know what it is like to suffer under this rotten, declining economy. I have never been a friend of the good ole boys club that runs everything in Jackson, never received any no-bid contracts, gotten appointed to any high salary political patronage jobs, made any money off of any state agencies using YOUR tax dollars to pay me. If you want someone who lives like most of y'all, the regular taxpaying, paycheck to paycheck living folks, I am your man!"

Real estate talking head on Fox this morning was talking about banks being foreclosed on by HOA for property that the bank owns, but haven't paid the HOA dues.
HOA are just another example of what's wrong with this country. Little fiefdoms controlled by dictators, scolds, and hall monitors. Who in their right mind would join one of those?
What Powell should do is hold a press conference to clear the air.
The perfect backdrop would be the Whole Foods construction site since Whole Foods is transcendent for all Mississippians and, upon completion, will rescue not only Jackson but the entire state from the economic doldrums.
Sfax, good question. Wish I had a good answer. And to 7:56, if a contest is filed, you are wrong - it will be for the State Election Commission (and/or Hinds County Circuit Court) to decide.
Shadow, you took out my first response, so let me opine as requested.
Residency and domicile is MS Election statutes are really screwy - mostly in my opinion because of numerous court rulings on the matter. That said - it is hard to figure what the next court might come up with. I believe (as Lum has said I told him) that what Lum did in August 2011 was proper within MS statutes. He, being a registered voter in Hinds County at the time, could be a poll manager if he considered himself to have residency in Hinds County or "an intent to return".
As I said to WLBT last night, if the question asked in 2011 was "but I want to run for a special election that will be called 16 months from now, and have Rankin as my residency" I would have given him a different answer. Fact was, the question then was "am I eligible to be a poll manager in Hinds". As a registered voter, he met the requirements and therefore the answer was "yes".
Problem is, the one clear thing in residency is that for electoral purposes you can only have one. What the State Election Commission did in deciding as they did, based on the information they had, was probably correct. What they will do with this additional information may well depend on the arguments made in Keith's contest and the responses by Lum - trying to clarify the laws relating to residency.
So, to answer your question, I think he has a problem in that he couldn't be both a resident of Hinds and Rankin in August 2011. Having voted and worked appears to me that he "considered himself" (and yes, that is a criteria for determination) a resident of Hinds at that time. But what the three commissioners will decide will probably be based largely on how their lawyer advisors decide to cut the baby. Glad its not mine to decide or defend.

As a resident and home owner of the Res, Benny Hubbard has my vote. He is an upstanding citizen who owns his own business in FLOWOOD, has a wonderful family, and is active duty in the Guard. He has done several tours in dangerous areas. His wife is an EXCELLENT teacher. Benny puts his time and money in Rankin county. He is invested is us doing well. Yes, I am a Republican. Benny is running as an Independent. I have no problem with a quality man wanting a thankless job. BENNY HUBBARD is the man for his HOUSE SEAT!!!!

Benny Hubbard is looking better every day. HOA's are important and some them have been very effective in the reservoir area, so it is important that dues are paid. As a member of an association, it is important that all members participate or they can be a leech and just receive benefits at others cost. Mr. Powell needs to clear this up and fast, it is spreading like a wild fire out here. I have received several calls this morning already- because of this story. I am glad this truth was exposed. If you run for office, you need to be prepared to have everything uncovered- that's just the way the game is played. right or wrong- it is the facts.

Ya know, it is rather startling how some that comment around here immediately jump to conclusions relating to a candidate and a person's character simply because of some local HOA claiming that someone owes some dues or something. Powell is a businessman, private sector guy, in real estate and management, has been in the district for 40 years, I bet he even pays his taxes on time, unlike say, Dems like Banks, Eaves Jr., yea, check out his property taxes on the Hinds County collectors site, folks that always cry about "da man" holding down the little guy and regular folks, when they all claim to be millionaire successful trial lawyers, who most of which don't even pay their local taxes on time. Anybody can claim and sue anybody over anything, dues, dog bites, business deals run amok, heck, in Mississippi, even if your wife has an affair with some guy you can sue the guy for it, such as in Jamie Franks' case several years ago. Maybe Powell will address this HOA dues situation and satisfy some around here that are ready to tar and feather at the slightest hint of controversy.

It is pretty clear that the HOA does not have any records of having received dues for some time and that Rankin County has not received taxes in a timely manner if the property was sold for taxes! HOA's are a necessary entity in today's world and definitely serve an important purpose. If this one is run lousy, then run for a position on the Board and help change for the better. Maintaining and increasing property values is one of the main functions of a HOA. No fair blaming the group or government that was not paid, no matter the reason.

There have been more than enough instances where HOA's start out with low fees, then increase the fee at will. Then, the little dictator(s) want to put liens on "members" houses when someone can't/won't pay? Why would any sane person subject themselves and their property to such?

I will be publishing a post on the Lum voter registration controversy later today. I have all the papers that were posted on other websites. But unlike other websites, I verify things first. SO that means I went to the circuit clerk's office in Rankin. Got the voter registrations of all the candidates and yes, they will be posted. I also confirmed the voting registration in Hinds of Mr Lum with the Election Commission. You with me so far? I'd hate for you to get lost. SOOOOO... while I am at the courthouse, I decided to look for lawsuits. Standard procedure, not that you would know anything about that, and presto, there was one against Mr. Powell in County Court. I got a copy of it, noticed the lien, and then went over to land records and a nice lady helped me figure out how to use the computer to look it up. And if you don't believe me and still believe I was fed this stuff, ask the District Attorney as he happened to come in the Circuit Clerk's office and saw me doing the research. Gave me a nice update on the Brown case too (Has a hearing Monday).
I realize that may be a little bit hard for you to realize, Rodney, if that is indeed you, Rodney as when you went to the election commission warehouse in Hinds, you were so lost on trying to find Lum's voting records you had to go to leave and go to someone else for help. What I did was standard opp research and since you haven't read my website before, I am standard opp research in this area. I define it. Just because something is outside of your realm of understanding doesn't meant I had help from a campaign. I didn't.
I've posted negative news about politicians or candidates who advertise on this website before. Tate and Billy weren't always happy about my site and guess what, I criticized Dave Dennis on here as well, right next to his pretty ad.
If you want to blame someone, blame Mr. Powell. I called him for a comment. Guess what, I'm sure there is another side to this story as in these things, there usually is. However, you won't know what it is because Mr. Powell won't talk about it. That is worse than the actual lien in my opinion. 90% of the time when a politician or candidate talks to me about a story I am going to post, they come out looking better than if he had never talked to me in the first place. There is usually an explanation that makes sense and keeps things from being seen in the wrong light. Powelltool and his friends can't have it both ways: whine about critical things written about their candidate while they take dirt on other candidates to the media and try to get them to run it. As Mac said, grow a pair and put on your big boy britches. You're nothing but a crybaby.
As for the candidates, I've spoken to them all but Mr. Hubbard. They are all nice guys, seem pretty sharp and guess what? I think all three would probably do a good job in the legislature. Mr. Lum is pretty smart, about to earn his law degree, spent some time teaching and coaching, and has some sense. Mr. Powell is someone I found to be pretty nice, intelligent, and has some business experience about him. Same thing for Mr. Allen. He's a pretty sharp guy, not a great campaigner but that has nothing to do with the job of Representative, as we all know. I've never spoken to Mr. Hubbard so I will not comment on him. All three guys will probably vote the same way. If I were a constituent, I would probably be satisfied with any one of the three R's winning the seat.
And Shadow, one day I'm going to publish a post that is a collection of a bunch of your posts I didn't approve. That way people can see a pattern: How juvenile, insulting, and filled with foul language they are. I'm sorry but a comment filled with calling someone an a'hole and turd usually doesn't get approved. I've told you this for two years now but as usual, you don't pay attention. Deal with it.
I'm a Rankin County Rez Resident and have heard Scott speak and met personally. I dunno' who the other two are. But I am interested to know about the liens. Don't know about you, but I pay my debts; even if I don't like them.
I'm thinking this was a *mistake*, but am unsure at this point. All I've really seen on this is finger pointing and opponent bashing - not a leading strategy these days. This could be his own undoing unless they get a hold of it. Additionally, I have not read the article, but will today, I'm sure this will just solidify the notion that "going negative" is a sure fire sign of ruining a campaign at the local level.
As for Lum, I'm operating on the comments from Pete. It would appear to me that he was a student at the time, which, is kinda' a grey area - so no harm no foul in my mind.

I'm afraid, once again, that you are mistaken Kingfish. Unoffered apology accepted. Often you will allow no retort when someone refers to me or others in that manner. You'll censor the retort and leave the original insulting language in place. I've pointed this out to you several times. As you know, this blogsite is often infested with the F word as well as many others unfit for conversational consumption. You're plagued with the "selective censorship trigger finger". Deal with it. Kapt, since you are "operating on my thoughts" (what a scary idea) and since according to what I read in the CL today I am part of a cabal that is pushing the Lum qualification issue, let me offer a couple of thoughts.
I personally wouldn't put contesting a candidate's meeting the qualifications for office as "dirty politics". It is a legitimate part of the election process, as is poll watching, challenging a voter, or contesting an election for discrepencies.
Also, if KF discovered and ran the story on the HOA liens rather than one of the opponents, and KF did this as a "journalism" matter rather than on behalf of a candidate he is supporting (which I take KF at his word above, until shown differently) then I wouldn't call that dirty politics either.
As to my "role" in the Lum residency matter, I did tell him that - in my opinion - he could work as a poll manager in 2011. He was already a registered voter in Hinds County; he says he told me he was living at the time in Rankin County (don't remember the exact conversation but I have no doubt that he did tell me); the eligibility to work as a poll manager is to be a registered voter which requires residence in the county. But the kicker at that time was the "intent to return" concept.
As I told WLBT and CL, the question I was answering at the time was "if he was eligible to be a poll manager". Answer in my mind was yes. IF the question had been - "but late next year I am going to want to run for a special election that is going to be called, will this affect my residency issue then?" - I would have answered differently.
As a registered voter and a student in Hinds County, I felt that he was eligible to be a poll manager. But his problem - in my humble opinion only - is that you cannot have residency (for election purposes) at two places at the same time.
No surprise there. Probably paid and settled.

Meanwhile, Brent Powell (who apparently hates his neighbors and stabs them in the back) proudly lists Pete Perry as one of his supporters in a half-page ad in the Rankin County news.
I hadn't taken much interest in this race until now. Brent Powell must not win.

2:04, I certainly don't deny the inclusion of my name on the M&G for Powell - something I agreed to do when he called and asked for my support. But I don't consider that to be "involved in the current race". My involvement in races is generally much, much more active than being listed as a host for a M&G. In fact, I have at times been a sponsor for fundraisers for competing candidates. That's not the case here, but I gladly agreed to have my name listed.
My comment that you quote was in response to Mr. Lum's comments as to me being involved in Powell's race and behind these questions regarding his qualification for office.

Has anything been filed yet? I believe the alleged residency claims re: Lum said something was to be filed by the end of the week. Which week? Before or after election?
Lum should have claimed legal residency in Bogue Chitto, then he could live in Madison and run in Rankin :-)
