Todd Burwell representing Karen Irby, Farese response has interesting info

Todd Burwell is now representing Karen Irby in the civil suit filed against her by the families of Mark Pogue and Lisa Dedousis. Mr. Burwell filed a notice of appearance with the court on February 22, 2010. Mr. Burwell is known for his current representation of Robbie Bell in other cases.

John Booth Farese, the attorney for the deceased, filed a response on February 26, 2010 to a motion Stuart Irby filed to quash his notice of deposition. The response is very interesting and quotes at length from the depositions taken by Zoraya Parrilla, M.D. and Clea Evans, PhD. earlier this year. Both doctors treated Mr. Irby in their respective capacities at Methodist Rehab Center in Jackson. All I will say is pages 11-12 are very interesting. Copy of response

'known bi-polar disorder'. Nuff said. I can guarantee you that IF he does have this mental illness, he and KI could have been laughing and hugging when they left JCC and 5 seconds down the road he could have been in a full fleded rage. I have not had one iota of sorrow for KI in this whole thing. I've known too many people who have seen her in action over a 10-15 year period to feel any. However, I have also lived thru 15 years with someone with this disorder (and no I couldn't leave 2 kids in it that I couldn't legally take with me so I had no choice but to tough it out till they got older. The week my youngest step-son turned 16 was the end. I knew I could convince any judge in MS he was better off with me.) and I can assure you this is possible. Since the only minor child living in this hell was her bio child why she would stay is even more so now, beyond me. Esp now with this knowledge. I still do not feel sorry for KI at all but it is possible for the complete turnabout in a nanosecond IF he truly has Bi-polar. Only if you have lived thru Bi-polar can you believe it but it is possible.

That was pretty amazing. Yes, the 11-12 pages were interesting, but in the end, I read, payday. Stuart is holding back financial records? After KI's conviction this appears to be a typical high dollar civil suit, replete with negligence on the Irby's part, but that is what the trial is for and depositions.

Now you got me wondering, what is KI doing? It really is looking like payback vs. SI. Did you notice the signature on the Representation motion was the 19th? On the criminal side of things, what is going on? It is not making sense other than a public display to discredit. If the SOL ran out, then how can she file? She waited to long. So what is the reason behind it?

Shoot me for saying this, and I am NOT a Stuart supporter at all, but I do NOT think he remembers anything from the accident.

If you do some research on similar stories with brain injuries, the people involved cannot even remember who they were sitting next to or where they were sitting at the time of the accident.

Once they start to come out of the coma, they receive therapy and many go on and pick up right where they left off, before the brain was injured.

3:47, I agree with you. I don't know why she didn't leave years ago. He didn't seem to want to be married to her after we saw that he filed in Sept. 2008.

Sad days lie ahead for Karen and the deceased families. No matter who you are, what your last name is and who you are married to, we ALL have a responsibility when we get behind the wheel of a vehicle, to respect ourselves and others on the roads which lie ahead. Speed and alcohol don't mix.

I think there is so much to this tragedy that we don't know and will never know......

Considering Burwell's semi-success at helping Robbie Bell dodge her undoubted accountability you'd have to think that Karen has retained a hired gun that may actually help her.

Though it is too bad she didn't seek her own attorney as many here urged long ago.

All this story is lacking at this point is Ladd claiming that Stuart was attempting to tie Karen up and shove sleeping pills down her throat.

If this is the case does this mitigate his responsibility from a negligence standpoint? And then, if KI is the only one to allege in the suit facts surrounding the accident, does he have any defense? If only Karen can enter facts to support Stuart's negligence, her actions then appear contrived and perhaps motivated to support the Plaintiff's claims. I don't know, not a lawyer, but really curious what the legal minds think out there.

Charles Irby said to Hilda Goff 3 days ago that he could remember him and Karen were trying to give each other a second chance at marriage, after the wreck Stuart can remember that him and Karen trying to patch up there marriage and go see a marriage counselor at Care Plus in Madison Mississippi, the Doctors name is Doctor Raza.

Now Stuart Irby is regretting that he did not go to the sentencing May 11th and really going ecstatic now.

There is no way I would let My Wife take all the blame from something that Stuart and Karen caused, if it was up to Me I would have taken blame just to where My Wife can Mother Our Children, apparently Stuart is cold hearted. I don't know or can't speculate it.

... It is absolutely conceivable, and probable, that a little Irby family birdy like Charles, the responsible Irby, whispered in Stuart's ear as he emerged from his comatose state to 'forget everything ... (wink, wink) permanently'.

Charles CONTROLLED EVERYTHING.

If you don't understand that Stuart is smart enough to understand what had happened as he exited his post-crash fog and what it meant to the Irby family teet that he and Charles fed off then you really don't know your head from your arse.

You are correct. Look back at some of the archived media footage from George Bell's standoff. Uncle Judge James (House call) Bell, Tom Royals and current Judge Dale Danks (with Frank Melton). Danks did not represent George, he sent a statement to the JPD clarifying that fact. But, he was clearly at the standoff that morning.

Sure makes me wonder if Tom Royals was retained prior to the discovery of Heather's body and if he knew his client had an active arrest warrant for a previous abuse offense. Not that it matters in the legal world, perfectly legal to hire an attorney at any time. Just saying, it looks pretty bad for the Bell's to have an army of lawyers lined up before an arrest was made.

Robbie chose to call Judge Bell to the murder/kidnap scene instead of seeking the assistance of authorities or medical help. Judge Bell gave a statement to JPD the same day that we was speaking to George in the capacity of his attorney that morning at Robbie's house. During his client privileged conversation Heather's body bled on the floor while her roommate was being held against her will at the murder scene.

Thank God, he had enough sense to leave with the kidnap victim after Robbie refused to leave her son. Got Gatorade?

Correction: One of Dank's associates sent an email to the Jackson Free Press, not JPD, disassociating himself from the Bell case. Still, why was he there in the first place and who called him and/or the Mayor.

Dale Danks' office just e-mailed wanting it clarified that *he* is not Bell's attorney. Verbatim e-mail:

Dear Ms. Ladd:
My name is Eric Ray and I am an attorney in Mr. Danks' office. He has asked that I contact you concerning the following quotes that were made by you on a recent public discussion concerning the tragic murder of Ms. Spencer and subsequent arrest of George Bell, III.:

The question is, "why"? Was Danks his attorney then, too?

I do worry about double standards at play here, and I'm curious what role Mr. Danks or others might have played in Mr. Bell not going to jail the first time.

If you will re-read the Clarion Ledger article, you will see that Mr. Danks does not represent George Bell, III in this matter. Further, Mr. Danks has never represented George Bell, III for any other matter in the past. As the article states, Mr. Danks received a phone call from Tom Royals, George Bell's lawyer, asking for advice. Mr. Danks then put Mr. Royals in touch with Frank Melton. That is the extent of Mr. Danks' involvement with this matter. Thank you for your attention to this matter, and we trust you will correct your statements.

George Bell III will spend the rest of his life behind bars after pleading guilty Monday to capital murder and kidnapping in the beating death of Heather Spencer in September.

Tearful members of Spencer's family looked her killer in the eyes, asking him "Why?"

"I don't know how you could so brutally rape her and kill her and leave her to die like a crumpled bag of trash," said Linda Francomb, Spencer's mother.

"It wasn't just brutal. It was beastly," Spencer's grandmother, Mary Henley, said to Bell. "I got the report. I know what you did to her."

Bell told them he'll spend the rest of his life struggling to answer "Why?" as he serves a life sentence without parole. He says he was high on cocaine and barely remembers raping and bludgeoning his girlfriend to death.

"I don't know what else to say but I'm sorry," said Bell. "I know this is my fate, and I accept responsibility."

A plea deal came with support of Spencer's family.

"We think the death penalty is too easy for him," said Francomb. "We'd rather him spend the rest of his life with the memory of what he did to Heather."

"I hope it torments him forever," she added.

Hinds County District Attorney Robert Smith had said the crime warranted the death penalty, but says he had to consider what Spencer's family wants.

"Sometimes families believe seeking the death penalty is the easy way out, and sometimes it is," Smith said.

Smith wouldn't comment on the case against George Bell's mother, Robbie, who's charged with accessory after the fact. Spencer's family says they will not support a plea deal in her case.

"For her not to report what happened and let my daughter lie on the floor dying is inexcusable," said Francomb.

As they continue seeking justice in the case, Spencer's family says they hope to raise awareness about domestic violence and keep the memory of Heather alive.

George Bell had a history of violence against Spencer. In court Friday he admitted beating her in the head with a rubber mallet last June, causing her to need 60 staples for her wounds.

Robbie Bell remains free on bond.

Who says the doctors are letting him drive? I've seen or heard no evidence that he was ever given a driving evaluation or a medical release to drive(standard procedure at MMRC for TBI patients). I would bet the farm that any driving he's been doing has been against medical advice.

I am no fan off the Irbys or the Bells, but I do not believe Karen would have let a woman be raped and murdered while she listened in a smallish house. Karen is a drunk driver, yes, but old hag Bell is in a class by herself, IMHO..

Here's a naive question from a non-lawyer: if Drs. Parrilla and Evans depositions are sealed to presumably protect Stuart's private medical information from disclosure, how is it that Farese can get away with disclosing Stuart's private medical information by quoting from the sealed depositions in his rebuttal? It's my understanding that doctors can't testify in cases like this without assurance that the records will remain confidential. Seems really confusing to me, and seems like Farese is violating the confidentiality agreement that he references in his rebuttal.

Gee, 8:50 PM, I guess we can't all be as smart as you. You must have been fooled by the reference in the document to the CPT- sustained attention test...this is NOT the driving eval that MMRC gives, which is an actual behind-the-wheel evaluation. My uncle had one after his stroke before they would clear him to drive.

First, I am asking questions because the actions being taken make no sense to a layperson like myself. Forgive yourself for assuming, you know what you do when you ASS U ME.

Next, KF, dropping in Heather does nothing for this discussion. It only embitters the readers towards the KI. If we want to analyze attorneys lets do so. But subject matter not on topic should be subject to deletion. Not telling you how to run your blog, but be consistent.

Why are we talking about the JFP? Oh yeah, off topic about George, and what????

C'mon, I was hoping to see some of the other blogs readership come here to answer some of the hypotheticals, instead, I seem to return back to Louaiadsffoasdifuasd.

After reading these comments Ladd posted on her own website it is amazing that anyone or business is still advertising with this entity know as the JFP. Quote, Ladd ADORES Robbie Bell. Does she have any sympathy for Heather, her family, her friends and the wonderful cause that Heather's tree represents? I adore the truth. And to read this quote from Ladd made sickens me. Domestic Violence needs to be stopped now. Donna truly shows her true colors once again. Jackson Farce Press - just say NO. For the record - I do NOT adore enablers like Robbie Bell. Thank you again JFP for all your contributions towards awareness and ending domestic violence. And thank you for adoring Robbie Bell, Donna. It's all part of the Irby machine that started on day one to protect Stuart. He doesn't remember, because he was told it was in his best interest to not remember. Also, he could not come to court to support his wife, but he can take trips and drive around town. SI is a cowart, and demons will be with him forever for letting his wife and the Mother of his child take all the blame for the accident.

Farese needs to focus more on the bipolar disorder more commonly known as manic-depression.
Most everything Evans describes sounds more like bipolar symptoms than head trauma and that is a pre-existing condition that could definitely impact on the tragic events that took place.
People with bipolar disorder do not like to stay on their meds as it makes them feel " flat" and behavior can be so extreme as to be psychotic.

Four of five suspects charged in the shooting death of a Jackson man in 2008 over a flat screen television pleaded guilty today in Hinds County Circuit Court.
Jermell Mobley, 24, was shot 10 times while sitting in a Cadillac in the Rally's parking lot off Woodrow Wilson Avenue on Nov. 25, 2008.
The shooter, Marcus Edwards, 27, pleaded guilty to manslaughter. He was sentenced to 12 years in prison.
Three others pleaded guilty to accessory after the fact to manslaughter.
Idris Hampton, 29, was sentenced to the maximum five years in prison.
Erica Brown, 28, who is Hampton’s girlfriend, was sentenced to five years probation subject to completing the nonadjudication program.
Kentrelo McDonald, 29, of Jackson was sentenced to serve three years in prison.
The fifth suspect, Demarrio Hodge, 26, of Canton, will have the charge dropped against him, his attorney Davey Tucker said today.
Police believe the shooting was over a flat-screen TV.
Detectives said Hampton arranged a meeting at the Rally's to purchase the TV from Mobley.
The suspects then allegedly shot Mobley and took the TV. Mobley died of his injuries days later at the University of Mississippi Medical Center.
Hampton told authorities Mobley pulled out a weapon first.
Mobley’s aunt, Ienka Byrd, said family members were told Hampton believed the TV had been stolen from his home.
Byrd said today her family received no closure with the guilty pleas and sentences.

The charge calls for the sentence given. The charges in the article you site says the shooter was given the maximum sentence. Without any facts beyond the article, I do not see where you can make this conclusion, but would love to hear it. I mean, were they fighting over the TV? Were they fighting over the price? Over something else. Just curious.

All right, time to put one rumor to rest.

Mr. Irby DID NOT get a DUI in North Carolina last year. period. He went there for his son's wedding. Karen's niece and the two kids went. The niece was a nanny/sitter. The police up there have made it clear he did not get a DUI and I frankly doubt he was even driving. That rumor needs to die a very quick and quiet death.

Karen was a lone actor according to her statements in the crime committed. Neither doctor is alleged to have pulled a weapon, used their car as a weapon during the commission of the crime KI plead guilty to.

In the article you site, it is alleged that both parties had weapons and that the victim pulled the gun first.

Now, if we take both cases and want to make a comparison, here it is. KI was originally charged with Depraved Heart Murder (2 counts). She eventually pleaded to a lesser charge because the evidence issues (as cited here on this blog).

Given the points I brought out above regarding your article, it appears that the evidence supported a 12 year guilty plea on Manslaughter because the victim is alleged to have participated in the escalation of the situation.

Again, the Doctors did nothing in the commission of the crime. It was all KI's actions that led to their deaths.

I have never claimed to be an expert, just call it like I see it. If you would like to share your opinion, I am happy to read it and disagree or agree with it. In this case your argument doesn't make sense to me. I do not see where this is about race. Its about the facts of the cases and the differences involved. If you would like to share how this is a racially driven difference, I would love to hear. I do not see where color played into any of this. In fact, it looks pretty cut and dry, comparing apples and oranges. Remember, she would have faced up to 50 years under the original charge.

Mississippi law enforcement officers plan to run checkpoints on state and local highways starting May 24 that focus on enforcing the state's primary seat belt law.
This is the 10th year Mississippi has participated in the national Click It or Ticket campaign. State troopers along with local police and deputies will pay special attention to unbuckled drivers and passengers from May 24 through June 6.
For the first time in state history, seat belt usage is above 75 percent, said state Department of Public Safety Commissioner Stephen Simpson. But that percentage is still too low, he said, compared to the national average of 83 percent.

Gary Taylor, deputy regional administrator for NHTSA, says the grant helps agencies buy TV and radio ad spots and pay overtime.
"We have steadily increased the amount of funding we give to states. We are fortunate that Congress sees this (campaign) as an important step to increasing roadway safety and saving lives," Taylor said.
Each of the nine Mississippi Highway Safety Patrol districts will schedule five patrolmen per day to work on the seat belt campaign, Maj. Rusty Miley said.
The Jackson Police Department will assist in enforcement in the capital city by charging its five DUI officers with running checkpoints and rotating the officers in its Traffic Division to work overtime.

Deputy Chief Eric Wall says the department will be able to work officers without draining the budget or taking away from regular patrol.
"We have prepared the entire year for this time because we knew it was coming," he said. "In the past couple years, Jackson has not participated (in Click It or Ticket) as strongly as it should have, but we're ready to go."

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Robbie Bell will perform Her two latest songs: My Best Friends are in the Media and Mama's, Don't Let Your Babies Grow up to be George Bell. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
