Police report in Irby case

JJ haf obtained a copy of a fubftantial part of the police report in the Irby cafe. Included in the report are officer ftatementf, witneff testimony, crime fcene report, and the actual police report. While there are interefting detailf in the report, there are no bombfhellf.

2:13 PM here, and Mr. McCarty made this request one to two days after the accident. Looks cover-up-ish.

You are right 2:27 PM, doesn't matter what she consumed, she was over the legal limit. IOW, legally intoxicated. She pled guilty. And for all of you who said she could have beat it, I cannot believe you. If your son/daughter/husband/wife/mom/dad was killed by a legally intoxicated individual, would you want them to get off because of a technicality? Would you want them to serve no time? All the KI fans are absolutely nuts with regards to saying she is innocent, could have beat it. Maybe yes, because of the ineptitude of the JPD, but still, I have the utmost respect for KI's integrity for accepting the consequences of her actions. All the KI innocence groupies diminish her integrity with fancy notions of getting out of it.

Based on her BAC report that was done about 2 or 3 hours after she murdered these innocent people, I would say that she consumed those 3 glasses plus... not to mention another wine glass was found in the car to go along with an empty 24 oz beer can outside the car... and the witness statement of her going over 100 mph... I'm sorry but....... they have scientific proof that she was drunk when she decided to drive that fast and murder someone with her vehicle.

Read report more carefully. the drinking glass was in the chevy if I'm not mistaken. The beer can means nothing. There are beer can littered up and down that part of Old Canton Road. Trust me, I know. Lived there for 15 years and always having to pick that crap up out of the yard thanks to all the drivers and apartment trash. and I do mean apartment trash over there.

There is a lot of could haves!
By the way the report looks, it looks half way botched and missing statements and plenty of double standards, some run end sentences!
Somebody's covering up fir someone and private pocketing with a little bit of sticky fingers!
If this would have been in Rankin or Madison Counties Law Enforcement Agencies the Investigation would have been truthfully made and finished in 12 hours after the accident not 2 days later after the accident!

No one knows that area as well as I do. Picked up those damn beer cans for years. beer can was in the grass. Its existence doesn't mean anything without further evidence.

I try to toss my cans out right near your family abode KF everytime I'm in the area and passing by.

When I'm in Fondren I toss out full un-opened cans because I know the elite there will pick 'em, crack 'em open and drink from them. Nothing like a warm Bud.

So, that appears they were in the bar for a while, then they had dinner that lasted until 10 PM.

Again, cover-up-ish.

Military Time:
Most of the world uses the 24 hour clock, rather than the 12 hour clock. As far as the 12 hour clock would go, that would be 4:30 PM. Anything you see over 13:00, just subtract 12, and you'll get the time you would on a 12 hour clock (PM).

2:13 and 4:00 are obviously paying very close attention. Page 17-Mr. McCarty said they arrived at the Club at 16:30, i.e. 4:30 p.m.. If they left at 10:00 that would be over 5 hours of drinking and eating. Then, Mr. McCarty went back a day or two later and told the Club to add the Irby's bill to theirs???? Wonder why he did that?

Karen Irby caused this accident due to her speed of her vehicle and her BAC results.....I find it very hard to believe that Stuart tried to pull her hair and caused any of this accident.

She was driving way too fast and lost control of her vehicle. Maybe she was the one who was angry and if anything, her speed showed that.

Are there any other cases that have similar stories to this case, such as husband attacks wife while driving and causes an accident where 2 people are left dead?

Karen may have been angry about something but I find it very hard to believe that anyone would attack another while driving...that's absurd.

AND, she could have pulled over and quit driving or slowed down. I respect her for taking responsibility for her actions, but her filing a suit against her husband for attacking her, is ridiculous at this point. She was driving fast from the get-go it sounds like from the witnesses on Old Canton Road, who she passed so recklessly.....

I believe that was an error. I think the officer was trying to state 6:30 in military time and put in 16:30.

The reason I draw this conclusion is the bartender states he didn't have a ticket for the Irby's, and that would not have been true had they been there 2+ hours prior to dinner.

I just can't understand why it took 2 days to file an accident report and it sounds like there is a lot of lazy slackers sitting on there booty eating there doughnuts, coffee and possibly watching some porn action on there computer in the office and the Crown Victoria Police Interceptor Vehicle, I have seen one cop watch stuff like that and too darn bad I did not have a camera without the flash on!

JJ, did you ever get the transcript of the deposition (for the civil lawsuit) that Karen gave just a few days before she was sentenced? If so, what's in it that apparently made the Pogue and Dedousis families, and Judge Green, believe Karen's account of things?

Like Anon at 4:55 PM (aka 1645 hrs) says donuts or something gettin in the way of the job.

It seems there were some significant delays in collecting these statements from witnesses and in filing these reports.

It obviously wasn't that high a priority...

Anyone else notice something strange about the death notifications? Need to go back to some old posts and check it out.

Its much more upscale btw to have beer cans empty or full rather than the empty 40's in brown paper bags on the yard.

I'm really not worried about the cans and the glass. I guess we could cast aspersions that perhaps the other drivers involved may have had a glass of Diet Coke in the car.

My points about the timing is there are three hours of discrepancy within multiple statements. I put most stock in McCarty; they were there to meet them. The other thing is Mr. McCarty goes back after a couple days and combines his tickets. At first, I thought, "oh, he wants to cover for Karen dinner." Now I think, "he wants to cover for an afternoon of drinking." Where are the records of the charges from that day? Why do the staff have such a consistent story, while McCarty completely contradicts their statements. Also, I do not buy the typo. The reports by the very same person are consistent vis-a-vis time stamps on his reports. Finally, 4:30 PM to 10:00 PM; that is five and a half hours of drinking. Based on the waiters statements in the bar, based on the bartender's statement, NO ONE served them except at dinner. Hmmmmm. This is where the important statement of combining bills comes into play. Why offer up that statement? Why is it relevant? Why combine the bills days later? C'mon folks.

Now, given all that, it does interest me that EVERY SINGLE PERSON says they did not appear angry, distraught, in a fight. I don't buy Karen's accusations.

Um, perhaps Mr. McCarty went back and had their bill put on his bill because at the time (a couple of days after the wreck) Karen and Stuart were in the hospital and Stuart wasn't expected to live. I'd do the same thing for any of my friends. It's a small gesture, but I don't think it was done to cover anything up.

There is something wrong here. If Karen had only three glasses of wine, why was she way over the limit? That doesn't explain her speed, either. I'm beginning to believe more and more that she was telling the truth about SI hitting her and pulling her hair, and am guessing maybe she was bracing with her feet. Not an excuse, but certainly plausible.

Also, I want to say that KI admirably pleaded guilty and is taking her punishment, which is more than some people would do, especially since it sounds like she had a fairly decent defense.

I am STUNNED. Both the Onyx bar and Magnolia grill at the CCJ are SO small that ANYONE entering would SEE EVERYONE ELSE!

I cannot believe JPD wasn't at CCJ when the doors opened the next morning interviewing employees SEPARATELY and a demand for all receipts from that evening!

What was the result of the DNA from the wine glass found at the scene?

Given the witnesses of speed,I'm surprised a plea agreement didn't include admitting to speeding.

There's some folks that when I see them socially from this moment forward, my view of their honesty and integrity is forever altered! " Thou shall not bear false witness" is not a suggestion and no exeptions are included.

Sounds to me like the crowd at the CCJ saw only what they thought they should see. JPD is terrible. Reports not thorough. Statements taken days after accident. Families notified 12 hrs after wreck. Definitely something happened in the car that night driving home, and I am more inclined to believe KI's account. No doubt the Irby machine took over almost immediately.

Normal reaction for most people who would've seen them is to try to avoid any involvement whatsoever. "Nope, everything looked fine to me, call me if you need anything else officer, thank you officer" and go home and give thanks they didn't have to say anything else. No one likes to go through depositions, police interviews, and testifying in court on tv as well.

KF, you are saying " most people" have no sense of civic duty and feel it is ok to lie in to the police conducting a criminal investigation when it's inconvenient to tell the truth?

Seems to me that several people came forward out of a sense of moral obligation and/or civic duty as they " get" there are things more important than themselves.

Beyond that, why lie so baldly? Why not say, " I saw them, but I didn't pay attention to what they were doing or saying". They were afraid to say THAT for fear someone else DID tell the truth.

It is IMPOSSIBLE not to see everyone in those two rooms the minute you walk in...not just because the rooms aren't large, but because of the way the tables are arranged.

I have been following this case from day one and have never commented. I know--I'm a lurker. I can't believe that some of you have such a hard time believing that KI's claims are not plausible. I can believe that she put on a smile, went to a social obligation with her husband, and returned to discussion of events concerning her child and his temper when they were alone again on the ride home. Can anyone not see him threatning, assaulting, pulling hair in his anger at her accusations of child abuse? She could have very well been telling him she would not lose her children b/c of him! She should have NEVER gotten behind the wheel of that car and she admits that, but there's more to this story. Also, to those asking why she didn't just leave an abusive relationship...read any case study on abused women/children. Shame, guilt, low self-esteem. Fear of the Irby's ablility (as all have spoken of the misuse of power and money) to take her son could have certainly been enough to keep her with him.
Unfortunatey, no amount of commenting can bring back the two lives that were lost. I will say that as tragic as it is that the two Dr.s can not fulfill their dreams of saving lives, in their death they will continue to save. I know for myself and countless others that have been touched by this, I will NEVER leave that Sat. afternoon cookout, Christmas party, dinner with friends after having a drink and think "I'm fine". NEVER!

Karen is in prison. Stuart is not and will not be. The civil trial will go on. The only thing "we the people" can change is the incompetence within the law enforcement community. For the largest city in Mississippi, and the capital, Jackson yields some bogus criminal investigations.

Karen Irby had her chance to leave the marriage before Stuart was released from the hospital last year. I am tired of hearing how spouses don't leave b/c of blah blah blah. Karen HAD and out at that point.

If he tried to beat her up in the car that night, she should have left Stuart then, told the truth about what happened in the car that night and then there may have been a different outcome for her.

There was documentation at that point for Stuart's abusive behavior. If you remember, Stuart filed for a divorce in Sept. 2008 from Karen for cruel treatment.

She was driving and driving fast from the beginning of the ride home from the JCC. There are witnesses to verify that if you read the Police Report.

So, everybody is now wanting Stuart to take some blame for the wreck; however It doesn't sound like Stuart was the only one with a temper in the mix......

It's hard to believe Karen at this point. 2 glasses of wine, her black out.......Any woman who would continue to stay with a man who tried to beat her while driving a car and caused the death of 2 people, has something wrong....It isn't low self-esteem, shame or guilt.

And, then she posed for a picture in April, 2009 at some charity event....it's the pic on the "karen irby" petition. She should have been home taking care of business and getting her bags packed before he got home from the hospital.

I don't believe her story........Obviously others don't either.

Man, why did I read that police report against my better judgment. I wish I hadn't read the contents of what was left of Dr. Pogue's burned wallet. That wasn't meant for my eyes to see, nor anyone's but his. I feel like I violated his privacy, that in death he deserves some privacy and respect.

I've followed this awful tragedy from day one, but here's where I leave it. Karen's in prison, serving time, and Stuart is at large being Stuart. As from the beginning of this ordeal, Dr. Pogue and Dr. Dedousis remain in the hearts of those who loved and knew them, God bless them.

The fact that it has now been revealed that Stuart has bipolar disorder is certainly a very interesting fact in this situation. Has it been made public yet whether he was diagnosed with bipolar disorder before or after the accident?

I don't know whether or not Stuart physically attacked Karen in the car that night, but I would at least like to hear in detail what Karen is now saying about the whole situation. You have to admit that it is at least very interesting that BOTH OF THE FAMILIES OF THE VICTIMS have apparently believed what Karen had to say. Also, Lisa Dedousis's brother stated something to the effect that they (the victims' families) believe that the investigation into the accident was flawed.

In addition, Judge Tomie Green apparently believed at least some of Karen's account (I'm assuming Judge Green got to read the deposition that Karen gave in the civil case). And when Judge Green remarked about Stuart that "his day is coming," and that Stuart's role in the accident would be for another court and another judge to decide, I don't think Judge Green was talking about Stuart standing before the Lord on the final Judgment Day, although certainly Stuart (and Karen and all the rest of us on this earth) will have to do that as well.

I just hope the complete deposition that Karen gave will be made public.

While I have no sympathy for that wart, Stuart, I do think Karen's assertions are totally unfounded. She had at least three glasses of wine. She was drunk. Multiple witnesses saw her driving like hell. There was no fight with the wart at the Club or getting into the car.

And the wart's friend and business associate, MacCarty, comes across as slime.

8:15 I simply don't find Karen's assertions totally unfounded. Surely you realize something was going on in that car that night of the wreck. Karen didn't just cross four lanes without even trying to brake without a very, very good reason. The reason is Stuart was beating the crap out of her. The families believed her after they heard what she said and looked at the evidence. So did Judge Green. You are right though, that ole Stuart won't go to jail, but he will live with demons the rest if his life by pretending he just doesn't remember anything and letting his wife and the Mother of his child take the complete blame for the deaths.

Whatever everyone's opinion re: Stuart Irby, He was not the driver of the car that was seen several miles prior to the fatal accident driving '100 mph' as the first witness states or ' like a sonic boom' as the second witness states.

The only indication that Stuart Irby was fighting and contributed or caused the accident comes from
statements made by the driver and makes those assertions more than a year later.

Time to ... MOVE ON.

@1:32 PM, Now if a car was driving at a fast rate of speed, I don't think I could see Anyone fighting! B/c indicating that absolutely No One or Nobody can see People in a Car going so fast fighting, so alleging that they didn't see any fighting/arguing don't mean anything!
Question is why didn't the State of Mississippi and Hinds County District Attorney and the JPD hire a Forensic Psychologist and do a Forensic Test on both KI and SI for because there is a way to see abuse under the naked eye with some type of high tech Forensic Equipment, a light and a Doppler X-Ray Equipment can see ages of bruises on Someones body, dead or alive and then do a M.R.I. detected with a Polygraph Test on both SI and KI, it can show patterns of deception or lying. There is People out there who went to College to get there MA and Doctors who when to College to get there Practicing License.
How can Anyone move'on when there is allegations and possibly what KI is saying might be telling the truth and SI is just a crook.
SI owes too many People and it is beginning to comeout now.
I do not and will not Trust SI with a life insurance policy-does that tell Ya anything!

I heard someone say that a nurse saw SI with a clenched fist full of Karen's hair when he was brought in to the hospital the night of the accident. And that KI had a bald area on the right side of her head with all other injuries being to the left side of her body. Hmmmm?

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Jackson Jambalaya is the home of Trollfest '07. Catch this great event which promises to leave NE Jackson & Fondren in flames. Sonjay Poontang and his band headline the night with a special steel cage, no time limit "loser must leave town" bout between Alan Lange and "Big Cat"Donna Ladd following afterwards. Kamikaze will perform his new song F*** Bush, he's still a _____. Did I mention there was no referee? Dr. Heddy Matthias and Lori Gregory will face off in the undercard dueling with dangling participles and other um, devices. Robbie Bell will perform Her two latest songs: My Best Friends are in the Media and Mama's, Don't Let Your Babies Grow up to be George Bell. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
