Squatters Bill Clears Hurdle

 Despite opposition from some Democrats, a bill cracking down on squatters and phony realtors cleared a Senate committee this week.  

The bill strengthens the ability of law enforcement to prosecute and remove squatters from properties. Squatters have become a problem nationwide as they take advantage of weak laws that allow them to use the court system to their advantage. Several states such as Florida, Georgia, Alabama, New York, and Louisiana recently passed laws cracking down on squatters. Some of the legislation passed with unanimous votes.  

State Representatives Shanda Yates, Brent Powell, Clay Mansell, Lance Varner, Gene Newman, Lee Yancey, Fred Shanks, Hank Zuber, Noah Sanford, Jill Ford, Kevin Felsher, and Price Wallace sponsored HB #1200.

The bill allows law enforcement to prosecute squatters as well as phony realtors.  An increasing number of scam artists scour land rolls for properties whose owners are out of state.  They find one of their properties that has been vacant for some time, post an ad online, and voila, start collecting rent.  A total con job.  A synopsis of the bill is posted below.  

The bill passed the House of Representatives and moved on to the Senate, where it was assigned to Judiciary Committee A.  State Senator Brice Wiggins is committee chairman.  

The committee took up the bill Tuesday.  The video is posted below (start at 15:00).  


State Representative Yates (I-Nandy's Candy) presented the bill to the committee.  She said squatters fall into a "gray area" of the law.  Thus law enforcement is often unable or unwilling to prosecute squatters.  Ms. Yates said law enforcement said it wanted a clear enforcement mechanism to handle squatters as and sham realtors.  

State Senators Derrick Simmons and Angela Turner-Ford fought against the bill.  They questioned how squatting was different than trespass, arguing trespass law could handle squatters.  Mr. Simmons tried to get the maximum penalty for acting as a phony realtor from five years in prison to two years but his amendment failed by one vote.  One point left out of the debate was this crime will be classified as non-violent.  Thus the convicted would probably be released after serving only 25% of the sentence.  Although the law states five years, those convicted will likely serve at most 15 months in prison.  

The committee approved the bill unamended.  If the Senate passes the bill unamended, it will go to the Governor's desk for his signature.  History & text of bill.





Highlights of HB #1200

* Squatter is defined as someone who remains on a property for a period of time or after "a rental agreement has ended."  The bill makes it harder for squatters to use the court system to their advantage as in other states as HB #1200 states the squatter will not have the same rights or "eviction process" as a tenant.  

*  Only the owner of the property has the right to manage or receive payments for use of the property.  This clause is important for prosecuting sham realtors.  

Enforcement.  The owner of the property or agent must file an affidavit with a law enforcement agency that has jurisdiction over the area.  The law enforcement agency includes the Sheriff's office.  Thus if a Mayor (can't imagine who) doesn't want his police to arrest squatters, the owner can go to the Sheriff for help.  

The law enforcement agency must issue a citation to the squatter within 24 hours after the affidavit is filed.  The citation orders the squatter to immediately leave the premises.  The squatter has three days to challenge the citation in court or leave.  No writ of removal is required.  If the squatter does not challenge the eviction and does not leave, law enforcement can remove him from the premises. 

The owner is not liable for any damage to the squatter's personal property. 

If the squatter challenges eviction in court and loses, the squatter must leave the premises within 24 hours.  The court must hold a hearing within seven days after receiving notice the squatter is challenging eviction. 

The squatter can be removed in less than 24 hours if he "poses an immediate risk of damage to the premises."  

The Court can levy civil and criminal penalties against the squatter.

I'm glad to see something done about this, but isn't this already against the law? To post an ad for a vacant property that isn't yours, so you can claim to a would-be renter that it IS yours, and then fraudulently collecting rent? Is it legislation this problem needs, or simply enforcement?

The bill in the House passed 99-14. So rest easy as there are at least 14 other people in Mississippi in your leaky boat.

Another bill with Fred Shanks name attached to it. Meanwhile, his hometown is still littered with squatted trucks that his bill has done nothing about.

@230 - obviously you are not in favor of Shanks' campaign for Mayor, based on you blaming him for Brandon not enforcing the law; but I guess you failed Civics back in the 7th grade. Legislators pass laws, they don't enforce them. Yes, the bill Shanks sponsored passed dealing with the squatter trucks. But Shanks (at least at this point) is not responsible for enforcing the statute, in his city or anywhere else.

"Squatting" is easily solved with the aid of a couple of buddies with baseball bats and a 9mm. Tell them 1 time to leave. If they open their mouth, negotiations are over. Problem solved. It is the only language thugs understand.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.
