The CCID Court is still alive after U.S. District Judge Henry Wingate denied the NAACP's request for an injunction against the court.
The NAACP asked the Court to issue an injunction barring the creation of the CCID Court on January 1, 2024. Judge Wingate held a hearing on December 19 and promised to rule on the request by the end of the year. However, Judge Wingate did not move fast enough for the NAACP so it filed an emergency request for an injunction against the new court last week.
Judge Wingate held a quick hearing and denied the emergency request. True to his word, he issued a ruling on December 31 but the decision was not what the NAACP wanted as the jurist upheld the CCID Court's creation under HB #1020.
Unknown to Judge Wingate, the NAACP filed a request for an emergency stay with the Fifth Circuit in New Orleans. A Fifth-Circuit panel issued a temporary stay that expires this week. Judge Wingate held a hearing in accordance with the higher court's ruling today.
The short opinion posted below states what happened in court today as Judge Wingate yet again denied the NAACP's request for an injunction.

Let's see the grifting NAACP raise the race card. Oh wait...
Pretty soon they will run out grifts for more "billable hours."
good for Henry. 5th cir is a bunch of meddlesome eggheads. they'll parse the word "the" for hundreds of pages
The victims believe they have been victimized again.
His honor will go down in history as making a gallant effort to save Jackson from itself.
I wish he would run for mayor when he retires from the bench.
Not that I'm anyone special, but this judge continues to gain my respect.
This poor Judge. Thank goodness he is on top of it. Called every fact, down to the exact hour. And to say thank you, 5th circuit, but the docket wasn't even completed before you issued your directive.
Can we have Judge Wingate over everything in our state?
Maybe, just maybe, Wingate finally got them to understand. They ain't gettin' what they wantin'. Because they have no standing to be in his court.
And - their appeal to the fifth would be better done by just imbibing in a fifth. Much more enjoyable way to waste the afternoon, although they can't bill anybody for the time spent.
@4:19pm, of course they won’t be able to bill anyone but they can sure “strong arm” church members to make additional donations on Sunday’s like they have been know to do. And that statement came directly from a black man I know.
The NAACP knows what's it doing. Keep hammering and hammering away until it gets its way. Simple.
Henry T seems more concerned about the tone from the 5th admonishing him for not filing an appealable Order in a timely fashion. He is notoriously late in responding to Motions and allows his work to pile up.
@8:08 AM. He wasn't late. You didn't read the order. It was done on time but the clerk was late posting it.
Judge Wingate is also appointed, not elected. Too funny.
