News Plead Guilty in New Summit Fraud

The Krewe of New will ride free no more after  Nancy New pleaded guilty to wire fraud while her son Zach pleaded guilty to conspiracy to commit wire fraud in federal court yesterday.

Nancy New faces a maximum sentence of a $250,000 fine and/or a prison sentence of 10 years.  She agreed to forfeit her home on Sheffield Drive as it was gained through fraud.  Zach faces a maximum fine of $250,000 and a prison sentence of 3 years.  They will be sentenced on November 9.

A federal grand jury indicted the Nancy New and her son Zach for conspiracy, 7 counts of wire fraud, 4 counts of aggravated identity theft, and conspiracy to launder money a year ago. The indictments accuse the News of bilking the Mississippi Department of Education for MAEP funds for New Summit schools.

The News submitted phony claims to MDE for reimbursement of MAEP funds.  The Krewe of New filed claims for teachers who no longer worked at New Summit, employees who were not teachers, a person who was never a school employee, and students who longer attended or never attended the school. The indictment states the fraud occurred from 2017 to 2020 and involved $4.7 million. The indictment provided a list of the transactions.  Earlier post.

The Justice Department alleged Nancy billed MDE for her own teaching even though she never taught a class:

For three of the four academic years, NANCY W. NEW and ZACHARY W. NEW fraudulently submitted false claims to the MDE that NANCY W. NEW worked full-time for the entire academic year as a teacher who taught eligible students at NSS in Jackson, knowing that NANCY W. NEW did not teach full-time during those years, which resulted in fraudulent reimbursement to NLR of $67,370.00 for NANCY W. NEW for each of those three years.

The alleged fraud covered identity theft as well.  The News allegedly used the names and Social Security numbers without permission to submit phony claims.  The new indictments charge the News stole the identities of RW, PC, PT, and JR to commit more fraud.

The News allegedly used the names and Social Security numbers without permission to submit phony claims.  A series of withdrawals occurred in the spring and summer of 2019.  Ms. New used the cash to purchase a home on 1800 Sheffield Drive in Jackson in June 2019.

Hinds County property records state Ms. New still owns the home. The home is assessed at nearly $200,000 but it undoubtedly has a much higher market value. The indictment states the feds will seek the forfeiture of assets gained through the use of fraudulent means.

The News face up to 20 years in prison for the wire fraud charges. The aggravated identity theft  counts have a prison sentence of 2 years that must run consecutive to any other prison sentence.  The money laundering counts have a maximum sentence of ten years in prison.  All counts have a maximum fine of $250,000.

State Auditor Shad White said My office was proud to continue our work with our federal partners to help achieve this result in this case. The gag order in the upcoming state cases bars me and everyone else in those cases from making additional comments.”

Attorney Cynthia Speetjeens represented Nancy New while attorney Thomas Bufkin represented Zach.  The case was assigned to U.S. District Judge Carlton Reeves.

Bad new for Phil.

Phil is screwed. Gonna be interesting to see how the Feds handle Shad covering for him too.

Friends of Phil Bryant last filed a campaign report in 2017. Had roughly $1 million on hand. Can he use that money for defense? Or to pay fines?

Does this group not have to file reports to show where the money went?

Ruh roh Phil. Democratic administration and local US Attorney. No blessings from the R's.

Uh oh Phil. I keep thinking of the ending of Shawshank when the warden realizes he’s been had as the police show up to clean up the garbage. Hopefully Phil and Nancy and Brett are made to pay back all the money they stole from taxpayers and get a good 20 years to think about where their greed got them.

Anonymous said...

On the bright side, maybe with Phil and Brett likely spending some time at Parchman, the state legislators will finally have some incentive to clean up that hell hole.

@11:43 This may help answer your question about left over campaign funds.

"Politicians can legally use their campaign funds for personal reasons as long as it’s money they raised before 2018, when reforms took effect banning the practice."

Deppity Pheel knows all about how this stuff usually works... but just in case he doesn't remember...I suspect he's about to find out!

Also is there a "Plea Supplement" under seal as referenced in the posted Plea Agreement? If there is...Deppity Pheel best be like Bert the Turtle and DUCK AND COVER!!!!

Question: KF is there a sealed filing filed along with this Plea Agereement? Asking for Pheel

Kingfish said...

Who knows? In the federal system, the sealed stuff usually doesn't pop up until unsealed. Just the way it is.

How puckered up are Phil Bryant and John Davis right now?

Anonymous said...

How puckered up? It Depends!

Anonymous said...

Is this the proper place to use the term "finito?"

Anonymous said...

Good thing for Phil that he was the whistleblower.

@1:05 PM Phil wears "Depends?" TMI. (And don't call me Shirley).

Davis works out deal with Feds to bring down Phil?

Dang it! I was thinking bout gettin' a new pair of them fancy cowboy boots, but they ain't allowed in no prison.

This has huge potential for an epic remake of "The Longest Yard". Phil gets to coach Brett.

All will be ok. Club Fed bound.

The zestimate for Nancy's house is $284k, it is a nice older 4 BR/2.5 BA home that looks decently updated inside. It butts up to JA property, so that likely will increase the value.

Is there going to be any other restitution other than the $250k fine and losing the house? If not, Zack may have gotten a decent deal. Assuming federal prison (not state).

Anonymous said...

Club Fed beats Parchman, or for that matter anywhere in the MDOC.

ALthough, the feds are probably much more diligent and competent about prosecuting their clawbacks and asset seizures.

This should get more interesting before it gets less interesting...

The Peter Principle is not really an affirmative defense not even in Mississippi said...

Given this plea deal Phil looks even more (insert own adjective here) for thinking he should sit for a recorded interview with Anna Wolf to discuss anything pertaining to TANF. Even if the former deputy still thought the wrongdoing and investigations didn't involve him.

Phil to Chris Epps “I’ve got dibs on top bunk”

Kingfish said...

And that's the problem with the Phil and John made me do it defense. Those two had nothing to do with this case. This was all on the News. That's why white collar cases rarely go to trial. It's hard to be a paper trail.

Justice for Philbilly said...

Wow. Didn’t realize Sir Fish was covering for Philbilly and JohnBoy.

The docket sheet in each of there cases reflects that a plea supplement will be filed under seal, which is the usual case when a defendant has a cooperation agreement with the government. If those pleas supplements were a matter of public record, cooperating drug co-defendants could (and have) wind up dead. Also, it is worth noting that Zach New entered plea to a new criminal information (not an indictment) which was just filed yesterday. Waiving indictment and pleading to an information are also usually sure signs that cooperation is part of the plea deal.

Kingfish said...

How so? They can indeed be guilty in the DHS case. I'm talking about the MDE case. Two separate cases. Pay attention.

1203, & 1203

Friends of Phil Bryant transferred all their cash (roughly $1.7 million according to two different news articles at the time - guess you spend all your munchies over blogs and ignore other reporting) to a 'leadership PAC' IMAGINE MISSISSIPPI. Those funds cannot be used for personal purposes - only for contributions to campaigns, candidates and issues.

1203, you correctly reported the law as it applies to campaign accounts raised prior to 2018 or so, but Phyll chose not to take that route.

Good story, though - just not the whole story.

Anonymous said...

How does that $250k fine work? Is that in addition to paying back the stolen 4 million?

Anonymous said...

Thanks 2:26, those are the answers to the PACER docket questions I was asking earlier. Particularly that detail about the plea to a new criminal information.

Wow said...

3 years maximum for this?

Wow. White Collar Crime really pays.

When Phil was governor, and the Chris Epps story broke out in the news, Phil made a point to get on all 3 TV Stations and make a point, that all donations to his campaign from all the defendants in the Chris Epps case would be turned over to a charity of his choosing!!!!! Just wondering, did all the people in the this case made any donations to his run for his 2nd turn for Governor??? Phil was quick in the Epps case, but very slow in this case and other cases to come to make any kind of statements!!!!!!!

This one sparks joy!

The leaks to Wolfe by Davis I suspect, only made these coincidental plea bargains make more sense. Phil, Farve, and the rest better lawyer up.

Phil’s not the only one to sweat- lots of legislators, DHS employees, venders, others to be named. And Shad’s got questions to answer. $70 million in misspent money is a lot of misspending!

Anonymous said...

Phil kept his campaign funds and only after he had moved the funds to use himself from the campaign fund did he change the law where you could no longer keep the funds. Everyone fell for his good will of returning the money BUT it did not apply to him because he kept his and then changed the law for everyone else to follow.
He has always been a dirty, filthy liar who loves to thump a Bible. HYPOCITE

"Governor Bryant has never tolerated public corruption of any kind,” Joey Songy, Bryant’s chief of staff and current business partner, told Mississippi Today in a statement. “On the same afternoon the Governor was informed of possible wrongdoing at DHS he called the State Auditor and personally reported it to Shad White. He believes anyone found guilty of any wrongdoing should be held accountable.”

503, you are just flat wrong. I'm not in any way a Phil apologist, but Phil did not do what you say. He moved his campaign funds to another PAC, which can only spend the money as contributions to others.

He could have done what you said. (Although he couldn't change the law as you claimed, that had to be done by the legislature, and after they enacted it he made it law by signing the legislation). He could have, after that law was passed, moved his entire $2 million in the fund to private money, only having to pay the taxes on it.

But he didn't. Check the records and then come back and apologize for your lies.

I am no fan of Phil but nothing I have seen to this point makes me think he will face any charges. He always has his hand out but did it very smartly.

Remember Bennett Malone? About the time Epps started sweating profusely, Bennett decided it would be a good time to retire from the legislature. Then he died and his wife was convicted of partnering with Epps.

Of course there is zero possibility of a similar connection between the sudden resignation notice given six weeks ago by the president of Southern Miss (where Miz New built the volleyball facility with TANF money), the sudden notice of Carey Wright's retirement and Phil's coincidental motivation to profit financially from the 'concussion scheme'.

federal time cannot run concurrent to state time.
if and when they get state time it will be run concurrent to their federal time.

Yes, dummy. "This group" just like all groups have to file reports to show where the money went.

And if you are capable of knowing that they last filed a campaign finance report in 2017 (Actually - filed in January 2017 for the calendar year 2016) you should be able to read that report. And if you are able to read it, you should be smart enough to interpret it, so I assume you are just trying to stir a pot with conspiracy theories.

Yes, they filed a report - looking at it on the MS SOS website, it shows that the group was terminated with the filing of that report.

And - if you look at the six pages (1-6) of the report that are headed as "Disbursements" --- that for you if you can't interpret, means "SHOWING WHERE THE MONEY WENT". Look now at page four, lines 2-5. You will see that they disbursed almost $800,000, which was the balance remaining after paying all the other expenses, to a PAC -- IMAGINE MISSISSIPPI. It is a "Leadership PAC" which means the money in that PAC can be contributed to political campaigns. It cannot be spent for personal expenses or pocketed by the candidate.

Got it now? Need some more help? If so - don't know where you can find it if this isn't spoon fed to you enough.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
